1481_00001ORDINANCENO.1481 ANORDINANCEAMENDINGCHAPTER13.04 OF THE MOSESLAKEMUNICIPALCODEENTITLED"SEWER REGULATIONS" THECITYCOUNCIL OF THECITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: Section 1.Chapter 13.04 ofthe Moses LakeMunicipalCode entitled"SewerRegulations"is amended asfollows: 9 13.04.145 Discharge to SewerSystemWithout Physical Conneetion te SewerSystem:Regular orintermittentdischargeofwastewatertothecity's sewer system by anyone not physicallyconnectedtothesewersystemmaybepermitted.Authority to so discharge can only begrantedbytheMosesLakeCityCouncilwhentheCouncildeterminesthatpermittingthedischargeshallnothaveanydeleteriousordamagingeffectsonthehealthandwelfareofthecity's residentsand that permitting the discharge willbe in the city's best interests. Permission,if given,to discharge wastewater to the city's sewer system shall be upon suchtermsandconditionsdeemedappropriatebytheCouncilînitsdiscretion.Thepermitshall,ataminimum,contain provisionswhichshall: 1.Require the payment of the rate which shall be set bythe CityCouncil. 2.Set limitations on the quantityand quality or characteristics of the wastewater. 3.State that the permit is terminableby the Councilat willwithin thirty (30)days of noticebeîngprovidedinwritingbythecitytothedischarger. 4.Providewhere and how the wastewater is to be discharged to the city's sewer system. 5.Require periodictesting of thewastewater according to the standards established by thecity. The permissionto discharge wastewaterto the city sewer system willincludethe requirement to execute an extra-territorialutilityextension agreement uponforms prepared by the cityifthewastewaterisgeneratedfromasiteoutsidethecorporatelimitsofthecityunlesstheCouncilOentersintotherecordafindingthatthewastewaterdischargerisincapableofexecutingsuchanagreementasdistinguishedfromthewastewaterdischarger's reluctance to execute theagreementandsuchawalverisinthebestinterestsofthecitizensoftheCityofMosesLake. Section2.The CityCouncildeclares that an emergency exists and this ordinance shalltake effectand beinforcefive(5)days after its passage and publicationas providedby law upon one reading if2/3 oftheentireCityCouncilpresentvoteinfavorofpassage.
