AN ORDINANΠSETTINGTHE WASTEWATER DISCHARGE RATES FORWASTEWATERDISCHARGETOTHECITYOFMOSESLAKESEWERSYSTEMBYROCKETRESEARCHCOMPANY
THECITYCOUNCILOFTHECITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Rocket Research Co.shallbe charged the following for industrial wastewater discharge to theCityofMosesLake'ssewer system.The ratesare set pursuant to MLMC13.04.140,MLMC13.04.145,andIndustrialWastewaterDischargePermit#6 for RocketResearchauthorized for issuance bythe MosesLakeCityCouncil.
Minimum monthly rate for up to the first
1,000 ofofwastewaterdischarge $394.73per month
Each 100 of or partthereofofwastewaterdischarge $12.56per 100 ofor part thereof
Additional fee per discharge $30per discharge
Section 2.In addition to the rates estabilshed In Section 1,a surcharge shallbe assessed,pursuant toMLMC13.12.050.The surcharge shallbe assessed at twenty-five percent (25%)upon all rates and charges
established in Section 1.
Section 3.Testing and monitoringperformedat cityexpense shallbe charged at the actual cost plusfifty
percent (50%)for overhead and administrativeexpenses.
Section 4.A maximumpenalty per occurrence may be assessed as followsfor non-compliancewith the
wastewaterdischarge permit:
First day $500
Second day $1,000Thirdday$1,500
Each day thereafter untilcorrected or serviceis terminatedshallhave an additional maximumOpenaltyassessmentof$500added on to the previousday's maximum penalty(forexample-4th
day,$2,000;5th day,$2,500;etc.)
The discharge amountmay exceed the maximum daily flow for emergencies ifapproved by the CityofMosesLakeinwritingforalimitedtime.A new monthly rate will be assessed to the user by the CityofMosest.akefor month(s)In whichthe emergency occurred.
The user shall havethe opportunityfora hearingbeforethe CityCouncilof the Cityof Moses Lakeand anypenaltyassessedbytheCityofMosesLakeprovidedtheuserrequestsahearinginwritingwithinten(10)calendar days after receipt ofthe writtennotification providedby the cityestablishingsuch penalty.Failuretorequestahearingwithinsaidtimeshallbeconsideredasaforfeitureofsaidfineorpenaltyascompensa-tionto the city.
Sectien 5.Paymentof the rateassessedRocketResearch Co.does not relieve RocketResearch Co.ofitsresponsibilitytomaintainitseffluentandcomplywithallfederal,state,county,and citylaws and permits,
Section 8.The rates established for Rocket Research Co.shall run concurrently withthe wastewaterdischargepermitissuedbythecityandshallterminatewiththeterminationofthepermit.Furtherrates willbenegotiatedinconjunctionwiththenegotiationoftermsforanewwastewaterdischargepermitifoneisrequested.
Section7.The CityCouncildeclares that an emergency exists and this ordinance shalltake effect and beInforcefive(5)days after its passage and publicationas provided by law upon one reading if2/3 of theentireCityCouncilpresentvoteinfavorofpassage.
