3511u u u RESOLUTION NO.3511 A RESOLUTION ACCEPTING AN EASEMENT TO THE CITY OF MOSES LAKE FROM GESA CREDIT UNION Recitals: 1.Resolution No.238 provides all grants of real estate,or any interest therein,tothe City of Moses Lake,shallnotbe accepted until a resolution hasbeenduly passed bythe City Council. 2. GesaCreditUnionhaspresentedan easementto the City ofMosesLake. Resolved: 1.Easements for municipal purposes and uses forthefollowing described property is hereby accepted by the City ofMoses Lake: Forand in consideration ofthe benefits derived and tobe derived by Grantor herein,and other good andvaluable consideration,receipt whereof is hereby acknowledged,Grantor,Gesa Credit Union (hereinafter "Grantor"),hereby gives,grants,conveys and warrants to Grantee,the City of Moses Lake in Grant County,Washington,a Washington municipal corporation,its successors and assigns,a perpetual,permanent,nonexclusive easement and right of way on,over,through and across the property described as follows: 721 S Pioneer Way, Block 3, Riviera Addition Parcel #110980000 &110982002 Moses Lake,WA 98837 forthe purpose of maintaining,operating,repairing,replacing,and reading water andsewer meters andfortesting and flushing private fire hydrants,together with all rights reasonably necessary or incident thereto,including therightof ingress and egress toand from saidproperty consistent with said purpose ofthe easement. SUBJECT TO THE FOLLOWING: 1.Granteeshallhavethe right at all timesto enterthe premisesdescribedabovefor the purpose ofmaintaining,operating,repairing,replacing,reconstructing andreadingwater andsewermetersandrelatedinfrastructure,andfortestingand flushing privatefire hydrants. 2. Saidgrantofeasementandright ofwayis fora publicuseandshall includeall rights reasonablynecessaryor incidentfor Grantee's municipalpurposes,includingthe rights of ingress and egress. 3.Grantor shall not use or make use ofproperty described above so as to interfere with impede,restrict,or otherwise conflict with Grantee's use ofthe easement.Grantor may grant easements to others in the area ofthe easement so long as such easements are not in conilict with nor interfere with this easement granted to the City of Moses Lake. Any additional easements granted shall referenced this easement and Grantor shall be responsible to the City ofMoses Lake for any damage to its property or interference with the easement granted herein. 4. This grant ofeasement and right ofway is a covenant running with the land and shall be binding upon the heirs,personal representatives,successors and assigns of both parties.
