3624RESOLUTION NO.3624 A RESOLUTION ALLOWING SAGEBRUSH HOLDING,LLC TO BUILD ON UNPLATTED PROPERTY RECITALS: 1.Moses Lake Municipal Code 16.12.030 allows forthe issuance ofa building permit toa proponent who wishes to build on unplatted propertyafter a resolutionfromthe City Council. 3.Sagebrush Holding,LLC has requested the City Council to allow building on unplatted property described as follows (herein the "Property"): Thatportion ofthe south half ofthe Southwest Quarter ofSection 30,Township 19 North,Range 28 East,W.M.,County ofGrant,Stateof Washington,as delineated and described onthe Record ofSurveyDrawingpreparedbyWesternPacificEngineeringandSurvey,Inc.,dated April,2014,lying southerly oftheparcel described in theWarranty Deed Filed under Grant County Auditor File Number 572365,and lying westofthe following described line:Commencing at a 2"aluminum cap marking the southeast corner of the Southwest Quarter of said Section 30;Thence North 88°57'10"West, coincident with the south line of the said Southwest Quarter,a distance of 1533.15 Feet to thebeginningoftheline;Thence North 00°30'20"Eastadistance of439.47 Feet,more orlesstothesaid southerly right ofway boundary for saidState Route 90andthe terminus ofsaid line. RESOLVED: 1.Applicant,SagebrushHolding,LLC,shall beallowed toconstruct a 3,000 squarefoot building onthe westerly one-half of the Property,located adjacent to South Frontage Road East.This grant is personal to Applicant and is specificto the building activity proposed by Applicant. 2.Given the unique location ofthe Property,the City Council findsthat itwould be impractical to require the extension of City water and sewer utilities to the Property and the mandatory connection requirement is hereby waived.The City Council further finds that the Property is isolated,is surrounded on twosides by publicly owned property,that the formal platting process would provide noadditional benefittothe City,andthatthe public interestwill notbeadverselyaffected by thisgrant. 3.Applicant shall be required to comply with the requirements of the Moses Lake Fire Department regarding required fire flow and fireprotection plan as a condition of this grant. 4. Thisgrantisconditioned uponApplicant's executionofa binding covenant running with thelandwhich requires the installation of infrastructure,including deficient infrastructure,in accordance with the City's current development standards at the time of installation.
