A RESOLUTION ESTABLISHING THE BILLINGTO BE IMPOSED AGAINST BONITA THEREAS
EVENS EXT. AS THE OWNER OF CERTAIN REAL PROPERTY UPON WHICH THE CITY
CAUSED ABATEMENT OF A NUISANCE TO BE PERFORMED AFTER A FAILURE OF THE
PROPERTY OWNER TO ABATE THE SAME.
RECITALS:
1.RealPropertyLocationandOwnership.TherecordsofGrantCounty showthat Bonita Thereas Evens
Ext.Isthe owner of property within the city limits located at 1061 S.Division.The parcel numberofthis
property is101520000.Bonita Thereas Evens Ext.was provided notice ofa hearing held before theCity
Council on September 27, 2016, to consider the allegations of the Code Enforcement Officer that a
nuisance requiring abatement existed on propertyowned byBonitaThereas Evens Ext.
2. OnSeptember27,2016 the City Council conducted a hearing to determine if a nuisance existed onthe
property at 1061 S.Division.At the conclusion ofthat hearing,the City Council adopted Resolution No.
3647 which provided a nuisance existed on the property at 1061 S.Division,that the ownerhad fifteen
(15)days toabate such nuisance and if the nuisancewas notabated within fifteen (15)days of adoption
ofthat resolution,the City would cause the nuisance to be abated and the costs of that abatement to be
charged against the property owner.
3.The nuisance identified in Resolution No.3647 was not abated by the property owner within fifteen (15)
days of the adoption of that resolution. On November 11,2016 the Citycaused the nuisance identified
to be abated through the use of contracted and/or City labor and equipment.
RESOLVED:
1.The costs to the City to abate the nuisance identified in Resolution 3647 on the property at 1061 S.
Division are set forth below.Thosecosts are derived from the attached documents which detail the costs
incurred.
2.The costs to be recovered from Bonita Theresa Evens Ext are:
City labor and equipment costs $0.00
Contracted labor and equipment (Tatum Lawn Care)$242.78
Total $242.78
3. This charge is certified bythe CityCouncil as due and owingthe City.This charge shall be forwarded in
writing to Bonita Theresa Evens Ext for payment. If payment is not received within thirty (30) days of
submittal, the same shall be submitted for collection with other unpaid billings of the Cityand collected
or reduced to judgment on the rolls of Grant County Clerk.
