AN ORDINANCEREPEALINGCHAPTER 8.12 OF THE MOSESLAKEMUNICIPALCODEENTITLED"NUISANCES"ANDENACTINGCHAPTER8.14 OF THEMOSESLAKEMUNICIPALCODEENTITLED"NUISANCES"
THE CITYCOUNCILOF THECITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS:
Section 1 Chapter 8.12 of the Moses Lake Municipal Code entitled"Nuisances"is repealed in its entirety.
Section 2.Chapter 8.14 ofthe Moses Lake Municipal Code entitled "Nuisances"is created as follows:
8.14.010 Definitions.The words and phrases used inthis chapter,unlessthecontextotherwise Indicates,shallhave the following meanings:
A."Correct"means to abate,repair,replace,remove,destroy or otherwise remedy theconditioninquestionbysuchmeansandinsuchamannerandtosuchextentasthecomplianceofficer,in hisjudgment,determines is necessary in the interestof the generalhealth,safety and welfare ofthe community.
B."CodeComplianceOfficer"means the CityManager's designee.
C."Health Officer"means the Director of the Grant CountyHealth District or his designee.
D."Responsible Person"means any agent,lessee,or other person occupying or havingchargeorcontrolofanypremises.
E."Buildingmaterials"means and includes lumber,plumbing materlais,wallboard,sheetmetal,plaster,brick,cement,asphalt,concrete block,roofing materials,cans of paintandsimilarmaterials.
F."Premises"meansany building,lot,parcel,realestate,or land,or portionof land,whetherimprovedorunimproved,including adjacent sidewalks and parking lanes.
8.14.020 Public Nuisance Defined.A public nuisance is anything,act,failure to act,occupation or useofpropertywhich:O A.Annoys,injures,or endangers the safety,health,comfort,or repose of one or morepersons
B.Offendspublicdecency
C.Unlawfullyinterferes with,obstructs,tends to obstruct,or renders dangerous for passage,a publicpark,street,sidewalk,alley,highway,or other publicarea
D.In any way renders one or more persons insecure in life or the use of property,
8.14.030 Nuisance Defined.Each of the following conditlons,unless otherwlse permitted by law,isdeclaredtoconstituteapublicnuisance,and wheneverthe CodeCompliance Officerdeterminesthatanyoftheseconditionsexistuponanypremisesorinanystream,drainage way orwetlands,the officermayrequireor provideforthe abatement thereof pursuantto thischapter.
A.The existence of any trash,dirt,filth,andcarcass of any animal,waste shrubs,accumula-tion of lawnor yard trimmings or other offensive matter.
B.Defective or overnowingseptic or sewage systems,and the existenceofany noxious,foul,or putridliquid or substance whichposes a health ha2ard or creates a noxious odor.
C.Any man-caused poolofstanding or stagnant water,exceptstorm drainagesystems,whichservesasabreedingareaforinsects.
D.Accumulation of garbage,decaying vegetation,manure,dead animals,or other noxiousthingsinastreetoralley,or on public or privateproperty to an extent injurious to thepublichealthasdeterminedbytheHealthOfficer.
E.Allother acts,failure to act,occupations,or use of property whichis determined by theHealthOfficertobeamenacetothehealthofthepublic.
F.Alllimbs of trees which are less than seven (7)feet above the surface of any publicsidewalk,or twelve(12)feet above the surface ofany street.
G.Allbuildings,otherstructures,or poltionsthereofwhichhave been damaged by fire,decay,
neglect,or have otherwisedeterioratedorbecome dilapidated so as to endanger the safety
of the public.
H.AIIexplosives,flammable liquids,and other dangerous substances stored or usedin any
manner in violationofthe UniformFire Code.
I.The keeping or harboring of any dog,fowl,or other animalwhich by frequent or habitual
howling,yelping,barking,crowing,orinthe makingof other nolses,annoys ordisturbs the
public,or the habitual allowingof dogs kept at anyone address to runat large in violation
ofChapter6.05 of the Moses 1.ake MunicipalCode entitled"AnimalControl".
J.Making or causíng to be made by any means whatsoeverany noise ofany kindwhich is
a violationof Chapters 8.28 of the Moses Lake MunicipalCode entitled "NoiseControl".
K.Dumping,throwing,placing,leaving orcausingorpermittingto be dumped,thrown,placed
or left,any filth,paper,cans,glass,rubbish,trash garbage,grass trimmings,shrub
trimming,and shrubberyof any kind,in or upon anystreet,alley,sidewalk,ditch,or public
or privatepropertyofanother in the city.
L.The erecting,maintaining,using,placing,depositing,leaving or permittingto be or remain
in or upon any privatelot,building,structure or premises,or inor upon any street,alley,
sidewalk,park,parkway or other public or private place in the city,any one or more ofthe
following disorderly,disturbing,unsanitary,fly-producing,rat-harboring,disease-causing
places,conditionsor things:
1.Any putrid,unhealthyor unwholesomebones,meat,hides,skins,or whole or any part
of any dead animal,fish or fowl,or waste patts of fish,vegetable or animalmatter in
any quantity;but nothing herein shall prevent the temporary retention of waste in
approved covered receptacles.
2.Any prívies,vaults,cesspools,sumps,pits or like places which are not securely
protected fromflies and rats,orwhich are foul or malodorous.
3.Any filthy,littered or trash-covereddwellings,cellars,house yards,barnyards,stable
yards,factory yards,vacant areas inthe rear of stores,vacant lots,houses,buildings
or premlses.
4.Any animalmanurein any quantitywhichis not securely protectedfrom flies or weather
conditions,or which Iskept or handled inviolation of any ordinanceof the city.
5.Any poison oak or poison ivy,Russian thistleor other noxious weeds,as defined by
Chapter 8.22 of the Moses Lake Municipal Code entitled "NoxiousWeed Control"
whethergrowingor otherwise;but nothingherein shall preventthe temporaryretention
of such weeds in approved covered receptacles.
6.Any bottles,cans,glass,ashes,smallpieces of scrap iron,wire,metalarticles,bric-a-
brac,broken crockery,broken glass,brokenplaster and allsuch trash,orabandoned
material,unless it is kept in approved covered bins or galvanizediron receptacles.
7.Any trash,litter,rags,accumulationsor empty barrels,boxes,crates,packing cases,
mattresses,bedding,excelsior,packinghay,straworotherpackingmaterial,lumber not
neatly piled,scrap iron,tinor other metal not neatly piled,or anythingwhatsoever in
which flies or rats may breed or multiply or which may be a fire ha2ard.
M.The permitting to remain outsideany dwelling,building,or other structure,or withinany
unoccupied or abandoned building,dwelling,or other structure,Ina place accessible to
children,any abandoned,unaltended,or discarded ice chest,refrigerator or other airtight
contained,which does not have the door,lid or other looking device removed.
N.Any pit,hole,basin or excavationwhich is unguarded or dangerous to life or has been
abandoned,or is nolonger usedforthe purpose constructed,or is maintained contraryto
statutes,ordinances,or regulations.
O.Any well or storage tank permittedto remain on any public or private property without
being securely closed or barring any entrance or trap door thereto,or withoutfillingor
capping any well.
P.The repair or abandonment ofany automobile,truck,or other motor vehicle of any kind
upon the publicstreets or alleys of the city.
Q.Thekeepingor permitting the existence ofany bees or other insects,reptiles,rodents,fowl,
or any other animals,domestic or wild,inany manner contraryto law,orwhich affect thesafetyofthepublic.
R.The existence of anyfence,otherstructure,or thingon privateor publicpropertyabuttingorfrontinguponanypublicstreet,sidewalk,or place,which is sagging,leaning,fallen,decayed or Is othenvisedilapidatedandcreating an unsafe condition.
S.The existence of any vine,shrub,or plant growing on,around,or In front of any firehydrant,utilitypole,utilitybox,or any otherappliance orfacilityprovided for fire protection,O publicor private utilitypurposes in such a way as to obscure from view or impair accessthereto.
T.Exceptfor any designated publicpark land,naturalarea,or environmentally sensitivearea,orany undeveloped parcelsofland notadjacent to developed areas or which are used foragriculturalpurposes,allgrasses,weeds,or other vegetationgrowing or whichhas grownanddied,whichis determinedto be a fire or safety hazardor a nuisanceto persons,shallnotexceedtwelveinches(12")in height measured above the ground.
1.The above exception maybe waived and additional maintenance required bythe CodeComplianceOfficerifhedeterminessuchactionisnecessarytoprotectthesafetyofpersonsoradjoiningproperty.
2.AIImaintenance shall be done in a manner so that soilstabilitywillnot be disrupted ordisturbed.Grass,weed,or vegetation control shall not include plowing,discing,orscrapingthesoiltoeliminatethegrasses,weeds,or other vegetation unless a soilstabilizationplan,whichwillminimize blowing dustand maintain soil stabilityand whichshallbeapprovedbythecitypriortoanyplowing,discing,or scraping,is implementedimmediately.
V.The existence of any dead,diseased,infected,or dying tree,shrub,or other vegetationwhichmayposeadangertovegetation,crops,property,or persons.
W.The existence of any accumulationof materialsor objects in a location when the sameendangersproperty,safety or constitutes a fire hazard.
X.The depositing or burning or causing to be deposited or burned in any street,alley,sidewalk,parkway or other publicplace whichis open to travel,of any hay,straw,paper,wood,boards,boxes,leaves,manure or other rubbish or material.
Y.The storage or keeping onany premisesfor more than thirtydays ofany used or unusedbuildingmaterialsasdefinedinSection8.14.010 (B),whose retail cost new wouldexceed
one hundred dollars,withouta special permitfrom the buildingofficial;provided,thatnothinghereinshall:
1.Prohibitsuchstorage withouta permitwhen done in conjunctionwith a constructionprojectforwhichabuildingpermithasbeenissuedandwhichisbeingprosecuteddiligentlytocompletion.
2.Prohibitsuch storage withouta permitupon the premises of a bona fide lumberyard,dealer in buildingmaterialsor othercommercial enterprisewhenthe same is permittedunderthezoningordinanceandotherapplicablelaws.
3.Makelawfulany such storage or keepingwhen it is prohibitedby other ordinances orlaws.
Z.The existence on any premises of any unused and abandoned trailer,house trailer,automobile,boat or other vehicle or majorparts thereof.
AA.The keeping or maintenance in any area on private property which is clearly visible from
O a publicstreet,sidewalk,park or other publicarea any accumulation,collection or untidystorageofanyofthefollowing:old appliances or parts thereof;oldiron,steel,aluminumorothermetal;inoperable junkvehicles,vehicleparts,machinery orequipment;mattresses,bedding,clothing,rags or cloth;straw,packing materials,cardboard or paper,tin cans,wIre,bottles,glass,cans,barrels,bins,boxes,containers,ashes,plaster or cement;orwood.This determination shall not apply to conditions completelyenclosed within abuildingorfencingsoasnottobevisiblefrompublicproperty.
BB.The keeping,permittingor harboring ofany fowl,rabbits,hoofedor cloven footed animals.
CC.The depositing of any debris,vegetation,lawn clippings,lumber plies,wood piles,auto
parts or bodies,garbage and the like,or storingofany materialofany kind,providedthat
inresidential zones thatshallincludegarbage cans or refusecontainersin the alleysofthe
city,except on garbage plckupday.
DD.The existenceof graffiti,which isdefined as a defacing,damaging,or destructiveinscrip-
tion,figure or designpainted,drawn orthe like,on the exteriorofany building,fence,gate,
or other structures or on rocks,bridges,trees,or other realor personal property.
EE.The locating of automobiles,trucks,recreationalvehicles,trailers,boats,or any other
vehicles,vessels,or the like for the purpose of advertising its sale on propertylocated in
any commercial or industrial zone not owned by theseller.
FF.The permittingof any condition or situationwhere the soilhas been disrupted,disturbed,
or destablizedso as to allowblowingdust to exist.
8.14.040 Prohibited Conduct:
A.Itis unlawfulforanyresponsible person or owner to permit,maintain,suffer,carry on,or
allow,upon any premises or in any lake,river,stream,drainage way or wetlands,any of
the acts or things declared by this chapter to be a publicnuisance.
B.It is unlawful for any person to create,maintain,carry on or do any other acts or things
declared bythis chapter to be a public nuisance.
8.14.050 Compliance-Notice.The Code ComplianceOfficer,to be designated by the CityManager,
having determined that a publionuisance exists,shallcause any owneror responsible person
to be notifiedofthe existenceofa publicnuisanceon any premisesand shalldirect the owner
or other responsibleperson to correct the conditionwithinten (10)days afterissuance of the
noticeor as otherwiseordered.The notice shall be substantiallyin the followingform:

whichis contrary to the provisions of the MosesLake MunicipalCode Section No.
You are notifiedto correctsaid condition to the satisfaction ofthe undersignedwithin
days of the date of this notice.Ifyou do not correct the conditionwithin the specified time
period,a notice of infraction will be issued,and the city may correct the condition at your
expense.

8.14.060 Correctionbv Owneror OtherResponsible Person:Ifand whenan owner or other responsiblepersonshallundertakeactiontocorrectanyconditiondescribedinthischapterwhetherbyorderoftheCodeComplianceOfficer,or otherwise,allnecessary and legal conditionspertinenttothecorrectionmaybeimposedbytheCodeComplianceOfficer.It is unlawfulfor the ownerorotherresponsiblepersontofalltocomplywithsuchconditions.Nothing in this chapter shallrelieveanyownerorotherresponsiblepersonoftheobligationofobtaininganyrequiredpermitsorapprovalstodoanyworkincidentaltothecorrection.
8.14,070 Correction by the City:In all cases where the Code ComplianceOfficerhas determined toproceedwithcorrection,then (10)days after gMng notice,the city shall acquire jurisdictiontoOcorrecttheconditionattheresponsibleperson's expense,as herein provided.Uponcorrectionofthecondition,or any portionthereof,by the city,all the expenses thereof shall constitute acMIdebtowingtothecityjointlyandseverallybysuchofthepersonswhohavebeengivennoticeashereinprovided.The debt shallbe collectible Inthe same manneras anycivildebtowingtothecity.
8.14.080 Immediate Danger -SummaryCorrection:Whenever any conditiononor use ofpropertycausesorconstitutesorreasonablyappearstocauseorconstituteanimminentorImmediatedangertothehealthorsafetyofthepublicorsignificantportionthereof,the Code ComplianceOfficershallhavetheauthoritytosummarilyandwithoutnoticecorrectthesame.The expense of suchcorrectionshallbecomeacivildebtagainsttheownerorotherresponsiblepartyandbecollectibleinthesamemannerasanycivildebtowingtothecity.
8.14.100 Penalty:
A.Everyperson who violates any ofthe provisionsof this chapter shallbe deemed to havecommittedacMIinfractionandshallbesubjecttoaC-5penaltyas providedin Chapter1.08 of the Moses Lake Municipal Code entitled "GeneralPenalty".Each violation shallconstituteaseparateviolation.Each day a violation exists constitutes a separate violationofthischapter.
B.Each second or subsequent violationof thischapterwithina 12 monthperiod shallsubjecttheviolatortoaC-2 penalty as providedin Chapter 1.08.
Section2.Thisordinance shalltake effectand be in force five (5)days after its passage and publicationasprov1dedbylaw.
