1537_00001ORDINANCENO.1537 AN ORDINANCEAMENDINGCHAPTER 12.10 OF THE MOSESLAKEMUNICIPAL CODE ENTITLED"DRIVEWAYCONSTRUCTIONSTANDARDS" THE CITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: Section 1.Chapter 12.10 oftheMoses Lake Municipal Codeentitled "DrivewayConstructionStandards"isamendedasfollows: 12.10.020 Deviations: A.The Municipal ServicesDirector may approve a reduction ofthe minimum drivewayset back and separation distance standards.Reduction of the drivewayset back and separationdistancesshallnotexceedtwenty-fivepercent (25%)of the set back and separationdistancesstandardsasstipulatedinSection12.10.010 ofthis chapter,except that:The Municlpal ServicesDirector may approvea reductionofthe minimum drivewayand set backseparationdistancestandardsinlowvolumetrafficareasorforlowvolumetrafficgenerating uses.Reduction ofdrivewayand separation distances shall not exceed thirty-fivepercent(35%)ofthe set back and separation standards as stipulatedin Section 12.10.010 of thischapter.Atraffic study prepared by an engineerlicensed by the State of Washington mayberequiredbytheMunicipalServicesDirector. B.A reduction in the minimum drivewayand set back separation distance standards in lowvolumetrafficareasorforlowvolumetrafficgeneratingusesshalltakeintoconsiderationthecumulativeimpactsofsuchuses.A reductionin the minimumdriveway and set backstandardsinlowvolumetrafficareasmaybedeniedorconditionedbaseduponthecumulativeimpactsoflowvolumetripgeneratinguseswithinanarea. C.The Municipal ServicesDirectormay require an increase indrivewayset back and separa-tion distances in high volumetrafficareas or hightrafficgenerating developmentsas maybewarrantedbyatrafficstudywhichmayberequiredbytheMunicipalServicesDirector.Traffic studies must be prepared by an engineer licensed by the State ofWashington. D.The CityCouncilmay grant varlances from the standards set forth in this chapter uponthe0findingsthatthegrantofavarianceisinthebestinterestsandwelfareofthecommunityandthatatraffichazardwillnotbecreated.Atrafficstudy prepared by a engineerlicensed bythe State of Washington may be required bythe CityCouncilbefore grantinga variance. Section 2.The City Councildeclares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 ofthe entireCityCouncilpresent vote in favor of passage.
