AN ORDINANCECREATINGA PLANNED UNIT RESIDENTIALDEVELOPMENTDISTRICTOFMOSESLAKEPURSUANTTOMOSESLAKEMUNICIPALCODE18.22.020 (8)AND MOSESLAKEMUNICIPALCODE18.67
THECITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.The following described propertyshall be permitted to developas PlannedDevelopment DistrictNo.3,and shall be named Hayden Estates Planned UnitResidentialDistrict as recorded withtheGrantCountyAuditor
Section2.All requirementsand standards ofthe R-1,SingleFamily Residential Zone shall apply to thePlannedDevelopmentDistrictNo.3 with the following deviationsand conditions:
A.Deviations to the corner lot exteriorside yardsetback requirement to allowa set back of 15'.
B.Deviations to the rear yard setback requirement to allow a setback of 15'.
C.Deviations to the side yard setback requirementto allowa setback of5'.
D.The planned unit residential development district major subdivision be approved with thefollowingvariances;
1.A 50'wide right-of-waywiththe street to be constructed 36'wide back of curbto backofcurb.
Section3:The developershall payto the city $3,000to be used toward the constructionofa signal lightattheIntersectionofHighway17andNelsonRoad.The $3,000shall be refunded to thedeveloperafter10yearsifasignalhasnotbeenconstructed.
Section4.This ordinance shalltake effectand be in force five (5)days after its passage and publication
as provided by law.
