AN ORDINANCEAMENDINGCHAPTER 5.40 OF THE MOSES LAKEMUNICIPALCODEENTITLED"TAXICABS"
THE CITYCOUNCIL OF THECITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 5.40 ofthe Moses Lake MunicipalCode entitled "Taxicabs"is amended as follows:
5.40.070 License Application Qualification-TaxiDriver's License:An Identification card or a taxidriver's
IIcense may not be issued by the Police Chiefunless the applicant:
A.Is at least 18 years of age.
B.Is of sound physiquewith good eyesight and not subject toepilepsy,vertigo,heart trouble,
or any other infirmityof body or mind whichmightrender him unfitfor the safe operationofataxicab.
C.Is able to speak,read,and writethe English language.
D.Is not addicted to the use of Intoxicating liquors or drugs.
E.Has a current Washington driver'slicense.
F.Has not been convictedor forfeited ball to any of the following when it involves crimespertainingtocontrolledsubstances,alcohol,prostitution,gambling,physical violence,orcrimesdirectlyrelatedtotheapplicant's honesty and integrity (suchas,but not limited to,fraud,larceny,extortion)or Is directlyrelated to the abilityand fitness of the applicant to
engage inthe operation of a for-hire vehicle:
1)Felony withinten (10)years precedingdate ofapplication.
2)Gross misdemeanor or misdemeanorwithin two years precedingdate of application.
3)Criminal trafficwithinorie year precedingdate ofapplication.
4)Traffic infraction within six months precedingdate of application.
O Ifthe issuance ofany IIcensehereunder is denied,the applicant shallhave the rightofa hearingbeforetheCityCouncil,byfiling an appealwithin10 days with the CityAttorney,afterthe permitisdenied.The findings of the CityCouncilon such an appeal shall be finaland conclusive.
Section2.Thisordinanceshall take effect and be Inforce five (5)days alter its passage and publicationasprovidedbylaw.
