Recitals:
1.The assessment roll levying the special assessments against properties located in SidewalkImprovementDistrictNo.3 in the Cityof Moses Lake,Washington,created under Resolution No.
1647 has been filed with the Cityof Moses Lake Finance Director,who acts as the CityClerk,asprovidedbylaw.
2.Notice of the time and place of the hearing on the assessment roll and for providing commentsand/or makingobjectionsto said rollwas duly published at and for the time and in the mannerprovidedbylaw,fixingthe time and place of hearing all comments and/or objections for February
23,1993 at 7 p.m.in the Council Chambers inthe Police/Court Facility,Moses Lake,Washington,and further notice ofthehearing was duly mailed by the Finance Director to each property ownershownonsaidroll.
3.At the time and place fixed and designated in said notice the hearing was duly held and all
O comments and/or objectionsmade inwritingwere read and submitted to the CityCounciland werebyitconsidered,
THECITYCOUNCILOF THECITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS:
Section 1.The assessments and assessment roll of SidewalkImprovementDistrict No.3 which has beencreatedandestablishedforthepurposeofpayingthecostofimprovingPlatofNeppel,Block 11,Lots 1and2,as theyfront on Broadway Avenue and Balsam Street,Block 21,Lots 13 through 24 as they front onAlderStreet,Third Avenue,and Division Street;Block 26,the northerly24.29 feet of Lot 24 as itfronts onDivisionStreet;Block 31,the northerly 90 feet of Lots 1 through 6 and Lots 7 through8 as they front on AshStreetandBroadwayAvenueandLot12asitfrontsonBeechStreet;Block 36,Lots 2 through 12 as theyfrontonBroadwayAvenueandCedarStreet;Block I,Lots i through 13 as theyfront on BroadwayAvenue;GuffinTract,Block 32,Lot 13 as it fronts on ThirdAvenue and Lots 1 through 8 as they front on ThirdAvenueandAshStreet;and GuffinTract2,Block 37,Lot1 as itfronts on Third Avenue in the Cityof MosesLakeasthesamenowstands,be and the same as hereby in all things and respects approved andconfirmed.
Section 2.That each of the lots,tracts,parcels of land and other property shown upon the said rollbeherebydeterminedanddeclaredtobespeciallybenefittedbysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameisinproportiontotheseveralassessmentsappearinguponsaidroll.There is levied and assessed against each lot,tract,parcel of landandotherpropertyappearinguponsaidrolltheamountfinallychargedagainstthesamethereon.
Section 3.The assessment roll as approved and confirmed shall be flied with the Finance Director of theCityofMosesLakewhoactsastheTreasurerforcollection.The CityCouncil,by separate resolution,shallprovidethemannerinwhichtheassessmentshallbepaidandshallprescribethetimeandamountofsuchpayments.The resolution shallalso providefor intereston the unpaid installments and shallfixthe rate ofinterestontheunpaidinstallments.
Section 4.This ordinance shall take effect and be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
Adopted by the CityCouncil and signed by its Mayor on March 9,1993.
