1562_00001ORDINANCENO.1562 AN ORDINANCEAMENDINGCHAPTER 18.16 OF THE MOSES LAKEMUNICIPALCODEENTITLED"R-1,SINGLE FAMILYRESIDENTIALZONE" THE CITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: Section1.Chapter18.16 ofthe Moses Lake MunicipalCodoentitled"R-1,SingleFamily Residential Zone"is amended as follows: O 18.16.020 Permitted Uses:Hereafter in the Single Family Residential Zone,no building,structure,or landshallbeusedandnobuildingorstructureshallbeerected,altered,enlarged,or relocatedthereinwhichisdesignedorintendedtobeusedforanyotherthanthefollowingoutrightpermittedusesorasaconditionaluse.Outrightpermitteduses or conditional uses inthe SingleFamilyResidentialZoneshallbeincompliancewiththeconditions,the performancestandards,and bulk regulations of this chapter. A.OutrightPermitted Uses: 1.Singlefamily dwelling units,including a.Singlefamily detached dwellingunits. b.Singlefamily dwelling unitssharing a common wall or attachment on two lots ofrecord, c.Condominiums -single family attached dwelling unitsdeveloped as a horizontal regimeincompliancewith Chapter 18.67 ofthistitleentitled"Planned Development District." 2.SubordinateUses -Any use whichis incidental and subordinateto the principal use of the land or building;is located on the same lot withthe principal uses;and is nototherwiseprohibited. 3.Accessory buildings and/or structures appurtenant toany permitted uses incompliance withSection 18.16.040 of this chapter. 4.Factory-built housingconstructed to the standards of the UniformBuilding Code. 5.Keeping of householdpets (dogsand cats)not exceeding three (3)in number which are four (4)months old or older. 6.Planned Development Districts in compliancewith Chapter 18.67 of this title. 7.Home occupations in compliancewithChapter 18.55 of this title. 8.Parks and non-commercial recreatlonal uses. 9.An accessory dwelling unitintendedto accommodate a member(s)of the immediate family requiringdailycare,supervision,or guardianship in compliance withSection18.16.190 of this chapter entitledResidentialDensity. 10.Other unmentloned uses ruled by the Planning Commissionto be similar to andcompatiblewiththespecifiedpermitteduses. 11.Family day care homes as an accessory use to a private family residence providing care during part of the twenty-four(24)hour day to six (6)or fewer children.FamilydaycarehomesshallbelicensedbytheStateofWashington,Department ofSocialandHealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.A city business license shall be required. B.Conditional Uses:The following uses may be permitted by the PlanningCommissionas aconditlonaluseincompliancewiththeprovisionsofthischapterandChapter18.51 of thistitleentitled"Conditionaland UnmentionedUses." 1.Cemeteries 2.Churches 3.Essential public services and utilities including buildings and structures. 4.Golfcourses 5.Other unmentioned uses ruled by the Planning Commission to be a conditionaluseprovidedthattheuseshallbesimilartoandcompatiblewiththeexpressedpermittedandconditionaluses. 6.Rentalof an apartment appurtenant to a singlefamily residence 7.Schools 8.MiniDay Care Facility and DayCare Center: a.MiniDay Care Facility:A day care facility for the care of from seven (7)through twelve(12)childreninthe familyabode ofthe personholding the license issued by the State of Washington,Department of Soclaland HealthServices, b.Day CareCenter:Aday care facility that providesfor the care offrom thirteen(13)throughtwenty(20)childrenin the family abode of the person holding the license issued by the State of Washington,Department ofSocialand Health Services. c.Requirements:Minîday care facilities and day care centers shallbe in compliance with the following requirements: 1)Outdoorplay areas shall not be located in front yards. 2)One (1)on-site parkingspace is required for each employee In addition to required residentparking.3)An on-site,off-street loadingand unloadingarea shallbe required. 4)A citybusiness license shall be required. 5)Signage shall not be permitted. 6)No structural or decorativealterationwhich would alter the character or be incompatible with the surroundingresidences shall be permitted. 7)The use and structures shall be in compliance with zoning regulations and UniformBuilding Code requirements. 8)Miniday care faellitiesand day care centers shall be licensed by the State of Washington,Department of Social and Health Services and shall operate in compliance withthe licensed capacityrequirementas determinedby the State ofWashington,Department of Socialand Health Servicesexcept that day care centers shalloperate in compliance with the capacity requirements as stipulat- ed in this section. 9)The Planning Commissionmay impose conditions to mitigateany potentialadverseimpactsonthesurroundingarea. 10)Notification and agreement of adjacent property owners of an applicationfor a day care facility. Section 2.This ordinance shall take effectand be inforce five (5)days after its passage and publication of its summary as provided by law.
