AN ORDINANCEAMENDINGCHAPTER 18.19 OF THE MOSES LAKEMUNICIPALCODEENTITLED"R-2,SINGLEFAMILYANDTWOFAMILYRESIDENTIALZONE"
THE CITYCOUNCILOF THE CITYOF MOSES LAKE,WASHINGTONDO ORDAINAS FOLLOWS:
Section 1.Chapter 18.19 of the Moses Lake Municipal Code entitled "R-2,SingleFamily and Two FamilyResidentialZone"is amended as follows:
18.19.020 PermittedUses:Hereafterinthe SingleFamily and TwoFamilyResidential2one,no building,
structure,or land shall be used and no buildingor structure shallbe erected,altered,enlarged,
or relocated thereinwhich is designed or intended to be used for any other than the followingOoutrightpermittedusesorasaconditionaluse.Outrightpermitteduses or conditional uses in
the SingleFamily and Two Family Residential 2one shall be in compliance with the conditions,the performance standards,and the bulkregulations of this chapter.
A.OutrightPermitted Uses:
1.Duplex -a structure on one lot of record containingtwo (2)dwellingunits.
2.Singlefamily dwellingunits,including
a.Single family detached dwelling units,
b.Single family dwelling units sharing a common wall or attachment on two lots of
record.
c.Condominiums -singlefamily attached dwelling units developed as a horizontal
regime in compilancewiththe requirements of this chapter or incompliance with
Chapter 18.67 ofthis titleentitled"Planned Development District."
3.SubordinateUses -any use whichis incidental and subordinateto the principaluse of
the land or building;is located on the same lot withthe principal use;and is not
otherwise prohibited.
4.Accessory buildingsand/or structuresappurtenantto anypermittedusesincompliancewithSection18.19.040 of this chapter.
5.Factory-built housing constructed to the standards of the Uniform BulldingCode.
6.Keeping of household pets (dogsand cats)not exceeding three (3)in number which
are four (4)months oldor older.
7.Planned DevelopmentDistricts in compliancewithChapter 18.67 of thistitle,entitled"PlannedDevelopment District,"
8.Parks and non-commercial recreational uses.
9.Home occupation in compliance with Chapter 18.55 of this title.
10.An accessory dwelling unit Intended to accommodate a member(s)of the immediatefamilyrequiringdailycare,supervision,or guardianship in compliance with Section
18.19.190 of this chapter entitled"Residential Density."
11.Other unmentioned uses ruled by the Planning Commission to be similarto andcompatiblewiththespecifiedpermitteduses.
12.Family day care homes as an accessory use to a privatefamily residence providing
care during part of the twenty-four (24)hour day to six (6)or fewer children.Family
day care homes shallbe IIcensed by the State ofWashington,Department ofSocial andHealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.A city business license shall be required.
B.ConditionalUses:The following uses may be permittedby the Planning Commission as aconditionaluseIncompliancewiththeprovisionsofthischapterandChapter18.51 ofthistitleentitled"Conditional and UnmentionedUses."
1.Churches
2.Schools
3.Group homes for the developmentallydisabled
4.GolfCOUrses
5,Manufactured homes not located in manufactured home parks providedthat the size,construction,siting,and other features shall be harmonious with the surroundingresi-dential propertiesandshall presente the general character and Integrity ofthe neighbor-hood.
6.Cemeterles
7.Rental of an apartment appurtenant to a single family residence
8.Manufactured home parks in compliance with Chapter 18.63 of this code entitled
"Mobile(Manufactured)Home Parks."
9.Essential publicservices and utilities including buildings and structures.
10.Boardinghouses for not more than three (3)people
11.MiniDayCare Facility and Day Care Centers:
a.MiniDay Care Facility:A day care facilityfor the care offromseven (7)through
twelve(12)children inthe familyabode of the person holding the license issued by
the State of Washington,Department of Socialand Health Services.
b.Day Care Center:Aday care facilitythat provides for the care of from thirteen (13)throughtwenty(20)childrenin the family abode of the person holding the license
issued by the State of Washington,Department of Socialand Health Services.
c.Requirements:Miniday care facilities and day care centers shall be in compliance
with the following requirements:
1)Outdoorplay areas shall not be located in front yards.
2)One (1)on-site parkingspace is required for each employee in addition torequiredresidentparking.
3)An on-site,off-streetloading and unloading area shall be required.
4)Acity business license shallbe required.
5)Signage shall not be permitted.
6)No structural or decorative alterationwhich would alter the character or be
incompatible with the surrounding residences shallbe permitted.
7)The use and structures shall be in compliance with zoning regulations and
Uniform Building Code requirements.
8)Miniday care facilities and day care centers shall be licensed by the State of
Washington,Department of Social and Health Services and shall operate in
compliance with the licensed capacity requirement as determined bythe State
ofWashington,DepartmentofSocialand Health Servicesexceptthat day care
centers shalloperate in compliance withthe capacityrequirementsas stipulat-
ed in this section.
9)The Planning Commissionmay impose conditions to mitigateany potential
adverse impacts on the surrounding area.
10)Notification and agreement ofadjacent propeity ownersof an application for
a day care facility.
12.Other uses ruledbythe Planning Commissionto bea conditionaluse provided that the
use shall be similar to and compatiblewiththe expressed permittedand conditional
uses.
Section 2.This ordinance shalltake effectand be in force five (5)days after its passage and publication
of its summary as provided by law.
