AN ORDINANCEAMENDINGCHAPTER 18.22 OF THE MOSESLAKEMUNICIPAL
CODE ENTITLED"R-3,MULTI-FAMILYRESIDENTIALZONE"
THE CITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTONDO ORDAINAS FOLLOWS:
Section 1.Chapter 18.22 ofthe Moses Lake Municipal Code entitled"R-3,Multi-familyResidential Zone"is
amended as follows:
0 18.22.020 Permitted Uses:Hereafter in the Multi-familyResidential Zone,no building,structure,or landshallbeusedandnobuildingorstructureshallbeerected,altered,or relocated herein which
Is designed or intended to be used for any other than the following outrightpermitted uses orasaconditionaluse.Outright permitted uses or conditional uses in the Multi-familyResidential
Zone shall be In compliancewith the conditions,the performance standards,and bulk regula-tions ofthis chapter.
A.Outright Permitted Uses:
1.Multi-familydwelling unitstructure -a structure containing more than twodwelling units
on a single lot.
2.Duplex -a structure on one lot of record containingtwo (2)dwellingunits.
3.Singlefamily dwelling units,including
a.Single family detached dwelling units.
b.Singlefamily dwelling units sharing a commonwall or attachment on two lots ofrecord.
c.Condominiums-single family attached dwellingunits developed as a horizontal
regime in compliance with the requirements of thischapter or incompliancewithChapter18.67 ofthis titleentitled"PlannedDevelopment District,"
O 4.Subordinate Uses -any use which is incidental and subordinate to the principal use ofthelandorbuilding;is located on the same lot withthe principal use;and is nototherwiseprohibited.
5.Accessory buildings and/or structuresappurtenantto any permitted uses incompliancewithSection18.22.040 of this chapter.
6.Factory-built housing constructed to the standanis ofthe UniformBuildingCode.
7.Keeping ofhouseholdpets (dogsand cats)not to exceedthree (3)innumberwhich arefour(4)months old or older.
8.Planned Development Districts in compliance with Chapter 18.67 of this title,entitled"Planned DevelopmentDistricts."
9.Parks and non-commercialrecreational uses.
10.Home occupations in compliancewithChapter 18.55 of this title.
11.An accessory dwellingunit intended to accommodate a member(s)of the immediatefamilyrequiringdailycare,supervision,or guardianship in compliance with Section18.22.210 of this chapter entitled"Residential Density."
12,Other unmentioned uses ruled by the Planning Commission to be similarto andcompatiblewiththespecifiedpermitteduses.
13.Family day care homes as an accessory use to a private family residence providingcareduringpartofthetwenty-four(24)hour day to six (6)or fewer children.FamilydaycarehomesshallbelicensedbytheStateofWashington,Department of SocialandHealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.A city business license shall be required.
B.ConditionalUses:The following uses maybe permittedbythePlanning Commissionas aconditionaluseincompliancewiththeprovisionsofthischapterandChapter18.51 ofthistitleentitled"Conditionaland Unmentioned Uses."
1.GolfCourses
2.Cemeteries
3.Manufactured homes not located in manufacturedhome parks providedthat the size,
construction,siting,and other features shallbe harmonlous withthe surroundingresi-
dentialpropertiesand shallpreservethe general character and integrity ofthe neighbor-hood.
4.Manufactured home parks in compliance with Chapter 18.63 of this code entitled
"Mobile (Manufactured)HomeParks."
5.Clubs,lodges,and assembly halls
6.Athletic clubs
7.Boarding houses
B.Grouphomes for the developmentally disabled
9.Schools
10.Churches
11.Clinics
12.Professional offices
13.Rental of an apartment appurtenant to a single family residence
14.Essential publicservicesand utilitiesincluding buildings and structures.
15.Hospitals
16.Hotels
17.Motels
18.Marinas located along the lake shore
19.MiniDay Care Facilities and Day Care Centers:
a.MiniDay Care Facility:
1)Aday care center forthe care oftwelve(12)or fewer children in a facility other
than the family abode of the person or persons under whose direct care and
supervision the childis placed;or
2)For the care of from seven (7)through twelve (12)children in the family abode
of such person or persons.
b.Day Care Center:A day care facility that providesfor the care ofthirteen (13)or
more children provided that the capacity of day care centers located in private
famlly residences in residential zones shall not exceed twenty (20)childrenat anygiventimeandthepermittedcapacityofdaycarecenterslocatedinresidential
zones in other than privatefamily residences shallbe set bythe Planning Commis-
sion on a case by case basis.
c.Requirements:Miniday care facilltles and day care centers shallbe in compliance
with the following requirements:
1)Outdoor play areas shallnot be located In front yards.
2)One (1)on-site parking space is required for each employee in addition to
required resident parking.
3)An on-site,off-street loading and unloading area shall be required.
4)A city business license shallbe required.
5)Signage shallnot be permitted.
6)No structural or decorative alteration whichwould alter the character or be
incompatible withthe surrounding residences shall be permitted.

7)The use and structures shall be in compliance with zoning regulations andUniformBuildingCoderequirements.
8)Miniday care facilities and day care centers shall be licensed bythe State ofWashington,Department of Socialand Health Services and shall operate incompliancewiththelicensedcapacityrequirementasdeterminedbytheStateofWashington,Department ofSocialand Health Services except that day carecentersshalloperateincompliancewiththecapacityrequirementsasstipulat-ed in this section.
O 9)The PlanningCommissionmay impose conditionsto mitigateany potentialadverseimpactsonthesurroundingarea.
10)Notification and agreement of adjacent property owners ofan application for
a day care facility.
20.Otheruses ruledbythe Planning Commissionto be a conditional use providedthattheuseshallbesimilartoandcompatiblewiththeexpressedpermittedandcondi-tionaluses or other uses permitted by specificprovisionof thischapter as a condi-tionaluse.
Section 2.This ordinance shall take effectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
