1571_00001ORDINANCENO.1571 AN ORDINANCEAMENDINGCHAPTER14.06 OF THE MOSES LAKEMUNICIPALCODEENTITLED"STATEENVIRONMENTALPOLICYACT" THE CITYCOUNCILOF THE CITYOF MOSES LAKE,WASHINGTONDO ORDAINAS FOLLOWS: Section 1.Chapter 14.06 of the Moses Lake MunicipalCode entitled"State Environmental Policy Act"isamendedasfollows: 14.06.020 GeneralRequirements: A.Purpose:This part containsthe basic requirementsthat apply to the SEPAprocess.ThecityadoptsthefollowingsectionsofChapter197-11 ofthe Washington Administrative Codebyreference: 197-11-040 Definitions 197-11-050 Lead Agency 197-11-055 Timing of the SEPA Process 197-11-060 Content of Environmental Review 197-11-070 Limitations on Actions During SEPA Process197-11-080 Incomplete or UnavailableInformation 197-11-090 Suppolting Documents 197-11-100 InformationRequired ofApplicants B.Additional Definitions:In additionto those definitionscontained withinWAC197-11-700through197-11-799,when used in this ordinance,the following terms shall have thefollowingmeanings,unless the context indicatesotherwise: 1."Department"means any division,subdivision,or organizational unitof the city estab-lished by ordinance,rule,or order. 2."SEPA rules"means Chapter 197-11 WACadopted by the Department of Ecology. 3."Ordinance"means the ordinance,resolution,or other procedure used by the citytoadoptregulatoryrequirements. O 4."Earlynotice"means the city's response to an applicantstating whether it considers issuance ofa determination of significancelikelyfor the applicant's proposal [mitigateddeterminationofnon-significance (DNS)procedures]. C.Designation of Responsible Official/Appeal From Decision: 1.For thoseproposalsfor which the cityis the lead agency,the responsibleofficial shallbetheSeniorPlannerorothersimilarpositionoradesignee,hereinalter referredto as"SeniorPlanner" 2.For all proposals for which the cityis the lead agency,the responsible officialshallmakethethresholddetermination,supervisescoping,supervisethe preparationofanyrequiredEnvironmentalImpactStatement(EIS),and perform any other functionsassignedtothe"leadagency"or "responsibleofficial"by these sections of the SEPArulesthatwereadoptedbyreferenceinWAC173-806-020. Any party aggrieved by a decision rendered by the Senior Planner on a thresholddeterminationmayappealthedecisiontothePlanningCommission,subject to theprovisionsofMLMC18.74 ofthis title. 3.The city shall retain alldocuments requiredby the SEPA rules (Chapter 197-11 WAC)and makethem availablein accordance with Chapter42.17 RCW. D.Lead Agency Determination and Responsibilities: 0 1.The department withinthe city receiving an applicationfor or Initiatinga proposal thatinvolvesanonexemptactionshalldeterminetheleadagencyforthatproposalunderWAC197-11-050 and 197-11-922 through 197-11-940;unless the lead agency has beenpreviouslydeterminedorthedepartmentisawarethatanotherdepartmentoragencyisintheprocessofdeterminingtheleadagency. 2.When the city is the lead agency for a proposal,the department receiving the applica-tion shall determine the responsible official who shall supervise compilancewith thethresholddeterminationrequirements,and if an EIS is necessary,shall supervisepreparationoftheEIS. 3.When the cityis not the lead agency for a proposal,all departments ofthe cityshalluse and consider,as appropriate,either the DNSor the final EISof the lead agency in making decisions on the proposal.Nocity department shall prepare or require prepara- tion of a DNS or EISin addition to that prepared by the lead agency,unless required under WAC197-11-600.In some cases,the city may conduct supplemental environ- mental reviewunder WAC197-11-600. 4.If the city or any of Its departments receives a lead agency determination made by another agency that appears inconsistent withthe criteriaof WAC197-11-922 through 197-11-940,it may object to the determination.Anyobjection must be made to the agency originally making the determination and resolved withinfifteen (15)days of receipt ofthe determination,or the citymust petition the Departmentof Ecology for aleadagencydeterminationunderWAC197-11-946 withinthe fifteen (15)day time period.Any such petitionon behalf of the citymay be initiated by the SeniorPlanner. 5.Departments ofthe cityare authorized to make agreements as to lead agency status or shared lead agency duties for a proposal under WAC 197-11-942 and 197-11-944; Provided,that the responsible officialand any departmentthatwillincur responsibilities as the result of such agreement approvethe agreement. 6.Any department makinga lead agency determinationfor a private project shallrequire sufficient information fromthe applicantto identifywhlchotheragencies have jurisdic- tion over the proposal. E.Transfer of Lead Agency Status to a State Agency:For any proposal for a private project where the city would be the lead agency and for which one or more state agencies have jurisdiction,the city's responsible officialmay elect to transfer the lead agency duties to a state agency.The state agencywithjurisdictionappearing first on the priority listing inWAC 197-11-936 shall be the lead agency and the cityshall be an agency with jurisdiction.To transfer lead agency duties,the city's responsible official must transmit a notice of the transfertogether with any relevantinformation available onthe proposal to the appropriate state agency withjurisdiction.The responsible official of the city shallalso give noticeof the transfer to the privateapplicant and any other agencies with jurisdictionover the proposal. F.Additional Timing Considerations: 1.For nonexempt proposals,the DNSor FinalEISfor the proposalshall accompany the city's staffrecommendation to any appropriateadvisorybody. 2.Ifthe city's onlyaction on a proposal is a decision on a bulldingpermitor other license that requires detailed project plans and specifications,the applicant may request in writing that the city conduct environmentalreview priorto submission of the detailed plans and specifications. 14.06.040 Environmental Impact Statement: A.Purpose and Adoption byReference:This part contains the rulesfor preparing Environmen- tal impact Statements.The city adopts the following Washington Administrative Code sections by reference,as supplemented by this part: 197-11-400 Purpose ofEIS 197-11402 GeneralRequirements 197-11-405 EIS Types 197-11-406 EISTiming 197-11-408 Scoping 197-11-410 Expanded Scoping (Optional) 197-11-420 EISPreparation 197-11-425 Styleand Size 197-11-430 Format 197-11-435 CoverLetter or Memo 197-11-440 EISContents 197-11-442 Contents of EISon Nonproject Proposals 197-11-443 EIS Contents When Prior NonprojectEIS 197-11-444 Elements of the Environment 197-11-448 Relationship of EISto OtherConsiderations 197-11-450 Cost-benefit Analysis 197-11-455 Issuance of DEIS 197-11-460 Issuance of FEIS B.Preparation of EIS-Additional Considerations: 1.Preparation of draft and finalEISs (DEISand FEIS)and draft and final supplemental EISs (SEIS)is the responsibility of the Senior Planner.Before the city issues an EIS, the responsibleofficialshall be satisfiedthatItcomplieswith this ordinanceand Chapter 197-11 WAC. DRD.1671/Page 3 2.The DEISand FEIS or draftand final SEISshallbe prepared bycitystaff,the applicant, or by a consultant selected by the city or the applicant.If the responsible officialrequiresanEISforaproposalanddeterminesthatsomeoneotherthanthecitywill prepare the EIS,the responsible officialshall notifythe applicant immediatelyaftercompletionofthethresholddetermination.The responsible officialshallalso notifytheapplicantofthecity'sprocedurefor EISpreparation,including approvalofthe DEISandFEISpriortodistribution. 3.The city may requirean applicantto provide information the citydoes not possess,including specific investigations.However,the applicant is not required to supplyinformationthatisnotrequiredunderthisordinanceorthatisbeingrequestedfromanotheragency.(This does not apply to Information the city may request underanotherordinanceorstatute.) 14.06.100 Agency Compliance: A.Purpose and Adoption by Reference:This part contains rules for agency compliance withSEPA,Including rules for charging fees under the SEPA process,designating environmental-ly sensitive areas,IIstingagencies with environmentalexpertise,selectingthe lead agency,and applyingthese rules to currentagency activities.The city adopts the following sectionsbyreference,as supplemented by WAC173-806-045 and 173-806-053 and this part: 197-11-900 Purpose of This Palt 197-11-902 AgencySEPA Pollcles 197-11-916 Application to OngoingActions 197-11-920 Agencies with Environmental Expertise 197-11-922 LeadAgency Rules 197-11-924 Determining the LeadAgency 197-11-926 Lead Agencyfor GovemmentalProposals 197-11-928 LeadAgency for Public and Private Proposals 197-11-930 Lead Agency for Private Projects WithOne Agency With Jurisdiction197-11-932 Lead Agency for Private Projects Requiring Licenses From More Than OneAgency,When One Ofthe Agencies is a County/City197-11-934 Lead Agency for Private Projects Requiring Licenses From a Local Agency,not a County/City,and One or More State Agencies 197-11-936 Lead Agency for Private Projects RequiringLicenses From More Than OneStateAgencyO197-11-936 Lead Agency for Private Projects Requiring Licenses From More Than OneStateAgency 197-11-938 Lead Agenciesfor SpecificProposals197-11-940 Transferof Lead Agency Status to a State Agency 197-11-942 Agreements on Lead Agency Status197-11-944 Agreements on Divisionof Lead Agency Duties 197-11-946 DOE Resolutionof LeadAgency Disputes 197-11-948 Assumption of Lead Agency Status B._Fee_s:The city shall requirethe following fees for its activities in accordance with theprovisionsofthisordinance: 1.Threshold determination.For every Environmental CheckIlst the city will review whenitisleadagency,the city shall collect a fee as set forth in Moses Lake Municipal Code3.54.010 from the proponent of the proposal prior to undertaking the thresholddetermination.The time periods provided by this ordinance for making a thresholddeterminationshallnotbegintorununtilpaymentofthefee. 2.EnvironmentalImpact Statement: a.When the cityis the lead agency for a proposal requiring an EISand the responsi-ble officialdetermines thatthe EISshallbe prepared by employees of the city,thecityshallchargeandcollectareasonablefeefromanyapplicanttocovercostsincurredbythecityinpreparingtheEIS.The responsible officialshalladvise theapplicant(s)of the projected costs for the EIS prior to actual preparation;theapplicantshallpostbondorotherwiseensurepaymentofsuchcosts, b.The responsible official may determine that the citywillcontract directly withaconsultantforpreparationofanEIS,or a portionof the EIS,for activitiesinitiatedbysomepersonsorentityotherthanthecityandmaybillsuchcostsandexpens-es directly to the applicant.The city may requirethe applicant to ensure paymentofsuchcostsinanyreasonablemanner.Such consultants shallbe selected bymutualagreementofthecityandapplicantafteracallforproposals. c.If a proposal Is modifiedso that an EIS is no longer required,the responsibleofficialshallrefundanyfeescollectedundera.or b.of this subsection whichremainafterIncurredcostsarepaid. 3.The city may collecta reasonable fee from an applicantto cover the cost of meeting the public notice requirements of this ordinance relating to the applicant's proposal. Thisfee is in additionto those specified inMLMC3.54.This fee may be requiredto be paid at the time a proposal is submitted or at any timethereafter. 4.The cityshall not collect a fee for performingits duties as a consulted agency. 5.The city may charge any person for copies of any document prepared under this ordinance,andfor mailingthe document,ina manner provided by Chapter42.17 RCW. 14.06.120 Severability:Ifany provisionofthis ordinance or its applicationto any person or circumstanceisheldinvalid;the remainder of this ordinance,or the application of the provision to other persons or circumstances,shallnot be affected. Section 2.This ordinance shall take effect and be inforce five (5)days after its passage and publication of its summary as provided by law.
