AN ORDINANCE AMENDINGCHAPTER 13.12 OFTHE MOSESLAKEMUNICIPALCODEENTITLED"WATERANDSEWER RATES"
THE CITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS:
Section 1.Chapter 13.12of the Moses Lake Municipal Code entitled"Waterand SewerRates"is amended
as follows:
13.12.010 Residential Water Rates:
A.The following shallbe the monthly rate charge for water from the citywater systemfrom allresidentiallivingunitswithinthecorporatelimitsofthecityandoutsidethecorporatelimits
of thecity:

13.12.030 Residential Sewer Rates:The following shall be the monthlyrate charged customers residing
withinthe corporateIlmits of the city and outsidethe corporatelimits ofthe cityfor sewerservice
from the city sewersystem for single-familydwellingsand each unitof a duplexwith separate
meters:flat rate,$17.15per month.
13.12.035 Duplex SewerRates:The following shall be the monthlyrate charged customers residing within
the corporate limits ofthe cityand outside the corporate limits ofthe cityfor sewer service from
the city sewer system for duplexes with only one meter serving two Ilvingunits or for two living
units on a single lot served by one meter:flat rate,$34.25per month.
13.12.040 CommercialSewerRates:
A.The following shall be the monthly rate chargedcustomers residing withinthe corporate limits
of the city and outside the corporate limits ofthe cityfor allchargeable water discharged into
the city sewer system by commercialusers and dwellingswith three or more living units
served by one meter:

B,For purposes of calculatingsewercharges,chargeable water shall be defined as follows:Chargeablewater shall be measured bythe waterconsumed on the premises,whateverthesourceofsuchwater,and the same willbe metered either by a public utilitymeter or oneinstalledandmaintainedbytheownerofthepremisesathisownexpenseandapprovedandinspectedbythecity.As an option,ifrequested by the owner of the premises,the citywillinstallawatermeterwiththecostforthemeterandinstallationbeingpaidbytheownerofthepremisesinaccordancewiththechargesassessedinMLMC13.08.020 for water/sewerconnections.Undersuchcircumstances the watermeter becomes the propertyofthe ownerofthepremisesandallcostsofreplacementandrepairaretheresponsibilityoftheownerofthepremises.Inall circumstanceswherethe water is metered bya privatelyowned waterOmeterandisusedtodeterminesewercharges,the cityshallbe allowedaccess to the meterinordertoreadsuchmetetWheretheuseofwaterissuchthataportionofallthewateruseddoesnotflowintothesewersystem,for whatever reason,but is lost by evaporation,irrigation,sprinkling or is used in manufacturing or in a manufacturedproduct,or Is lost forwhateverreason,and the person in control providesproofofthis fact and installsa meterorothermeasuringdeviceapprovedbythecitytomeasuretheamountofwatersousedandsolost,or ifthe city is capable of determining the amount ofsewage entering the city'ssewersystembysomeothermechanicalmeans,this water may be deducted from the actual waterconsumptionusedincalculatingthesewercharge.
The sewercharges for triplexesand apartments,mobile home parks,schools,hospitals andothercommercialestablishmentswithincreasedusageforirrigation,only iftheirlandscapingexceedsfivethousandsquarefeet,shall be computed on the average consumption duringthepreviousnon-Irrigationseason,unless the user elects to install,at his expense,anapprovedmeasuringdevicetomeasurewaternotenteringthesewersystem.When a userhasaswimmingpoolorcoolingunitsdischargingtothesanitarysewer,he must install anapprovedmetertodeterminetheamountofwaterexemptfromsewerchargesduringtheirrigationseason.The irrigation season shall be defined as the period in which statements
are mailedfor the Aprilthrough Novemberbilling cycles.
C.Sewer rates for commercial uses discharged into the sewer system may be separatelydeterminedbytheCityCouncil,based upon bothvolume and chemical characteristicsof the
sewage.The City Councilreserves the privilegeto require pre-treatment of any materialdischargedintothesaweragesystem,or to prohibit discharge into the system of industrialwastesthat,because of either volume or concentration,will overload existing seweragefacilities.9 D.Allair-conditioningand refrigeration units that are installed,replaced or that have capacityincreasedaftertheeffectivedateoftheordinancecodifiedinthischaptershallberequired
to install recirculatingunits.Disposal may not be accomplished by discharging Intothesanitarysewersystem.
Section 2.This ordinance shalltake effect and be in force withbillings afterJune 1,1993.
