AN ORDINANCEAMENDINGCHAPTER 18.72 OF THE MOSESLAKEMUNICIPALCODEENTITLED"PUBLICHEARINGPROCEDURES"
THE CITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTONDO ORDAINAS FOLLOWS:
Section 1.Chapter 18.72 of the Moses Lake Municipal Code entitled "Public Hearing Procedures"is
amended as follows:
O 18.72.010 Public Hearing:Whenever a publichearing is specificallyrequiredby any applicablelaw,such
as RCW 35A.63,for the adoption or amendment of a zoning oitlinance,one hearing shall beheldbeforethePlanningCommissionandonehearingshallbeheldbeforetheCityCouncil.In addition,wherevera publichearing is required by Title 18 of this code,it shall be held beforethedesignatedbodyinthemannersetoutinthischapter.
18.72.015 PublicHearing Notification Requirements:Apublichearingnotice shallbe given withinten (10)days of a completed permitapplication.Land use permitsshall require a publichearing notice
be providedto affected property ownersas follows:

18.72.020 Notice:Noticeof a public hearingshall be given to affected propertyowners as establishedunderthischapter.The publichearing notice shallinclude at least the following:
A.A descriptionofthe location of the property.
B.A description of the proposed action.
C.The name and address of the Planning Department and or other City department fromwhomadditionalinformationmaybeobtained.
D.The application name and file numbet
E.The date,time,and place of publichearing.
R Astatement thatany person or affectedparty may be heard at the hearing.
G.A statement that any person or affected party may submit written comments on anyapplicationrequiringapublichearing.Written comments must be made seven (7)dayspriortothepublichearing.
18.72.030 Time of Hearing:Upon the filing of an applicationfor an action requiring a public hearing,adateforthehearingshallbeadministrativelysetbytheMunicipalServicesDepartment,Community Development Divlsion.
O 18.72.040 Fee:The applicationfor allzone change requests,conditionaland unmentioneduse requests,non-conforming use requests,and zoning variance requests requiringa publichearingshall beaccompaniedbyaonehundredandtwenty-fivedollar ($125)fee to cover costs of publishingnoticeofthehearingandnotifyingadjacentpropertyownersoftherequest.The fee for anyotheractionnotpreviouslyspecifiedrequiringapublichearingshallbesixtydollars($60).
18.72.050 Records:The proceedings of all hearings and the reasons for the ensuing decisions shall bemadeapartoftheminutesofthehearingbody.
18.72.060 Dismissal of Application:The Senior Planner,MunicipalServicesDirector,or Planning Commis-
slon shall dismiss an application,without prejudice,upon a request bythe applicantto withdraw
the application requiring a public hearing.Failureof the applicam to provide all required
information or attend all required hearings may result in dismissäl ofthe applicationwithout
prejudice.
Section2.This ordinance shalltake effectand be in force five (5)days after its passage and pubilcation
of its summary as providedby law.
