AN ORDINANCE CREATINGCHAPTER 19.06 OF THEMOSESLAKEMUNICIPAL
CODE ENTITLED"INTERIMCLASSIFICATIONANDDESIGNATIONOF WETLANDSANDREGULATIONSFORTHEINTERIMCONSERVATIONANDPROTEGTIONOFWETLANDS"
THE CITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS:
.Section 1.Chapter 19.06 of the MosesLake Municipal Code entitled "InterimClassificationand Designation
ofWetlands and Regulationsfor the Interim Conservationand Protectionof Wetlands"is created as follows:
19.06.010 Statutory Authorization:The legislature of the State of Washington has,in RCW36.70A.060,
mandated localgovernments who plan under 36.70A.040 to adopt developmentregulations to
ensure the conservation of agricultural,forest,and minerallands and to adopt development
regulations precluding land uses ordevelopmentthat IsIncompatiblewithcriticalareas designat-
ed under RCW36.70A.170
19.06.020 Findings of Fact:
A.Growth management,resource land conservation,and critical areas protection share
problems related to governmental costs and efficiency.
B.Sprawland the unwise development of resource lands or critical areas susceptible tonaturalhazardsmayleadtoinefficientuseoflimitedpublicresources,jeopardizeenvi-
ronmentalresource functions and values,subject persons and propeityto unsafe condi-tions,and affect the perceivedqualityof Ilfe.
C.The cost to remedy the loss of resource lands or criticalareas îs greater than conservingandprotectingthemfromlossordegradation.
D.The inherenteconomic,social,and culturalvalues of resource lands and critical areasshouldbeconsideredinthedevelopmentof6trategiesdesignedtoconserveandprotectsuchlands
O E.This ordinance implements the goals and policies of the critical areas element of theComprehensivePlan
19.06.030 Purpose:It is the purpose of this oitlinance to promotethe public,health,safety,and generalwelfareinareasassociatedwithwetlands.It is further intended to promotethe enhancementangpreservationofcriticalareasbyavoidingorminimizingadveiseImpactsfromconstructionanddevelopment.Thisordinance shallalso implementthe goals and policies of the State ofWashingtonGrowthManagementAct(s)of 1990 and 1991 thmugh the classificationand desig-nationof wetlands and the development and implementation of interim regulationsto protectwetlandsinthepublic's Interest and welfare.It is not the intent of this ordinanceto deny areasonableuseofprivateproperty,but to assure that developmenton or near wetlands is ac-complishedin a manner that is environmentally sensitivetotheresources ofthe community
19.06.040 Goals:The general goalofthese regulationsis to avoidimpacts towetlandswhere such avoid-
ance is feasible and reasonable.Where such impacts are unavoidable,the standards of thisordinanceseektominimizeimpactsonwetlandsasaresultoflanddevelopmentby:
A.Maintaining and enhancing the biological and physicalfunctions and valuesof wetlands.
B.Maintainingthe naturalvalue ofwetlandsto control flooding and storm waterrunoffthmughthestorageandregulationofnaturalflow.
C.Providing opportunities for recreation,scientificstudy,and natural resources education.
D.Providing for reasonable buffers aroundwetlands in order to stabilize soil,filter suspendedOsolldsandexcess,nutrients,moderate impacts from storm water runoff,provide a localhabitatforwetlandplantandanimalcommunities,and to reduce or minimizeintrusionsfromhumansanddomesticanimals.
E.Implementing the goals,objectives and policies of the State of Washington GrowthManagementAct,the State Envimnmental Policy Act,and the City of Moses Lake'sComprehensiveLandUsePlan.
19.06.050 Definitions:
A.Alteration -anyactivitywhich materially affectsthe existingconditionofland improvements

B.Applicant -means the person,party,firm,corporation,or other legal entitythat proposes
any activity.The applicantis eitherthe owner of the land on which the proposed activity
would be located,or the designated reposentative.
C._Cgy-means the Cityof Moses Lake
D.Clearing-means the removalof brush,grass,ground cover;or other vegetative matterfromasitewhichexposesthesurfaceofthesite.
E.Compensatory Mitigation -means mitigationfor wetlandlosses or impacts resultingfrom
alterationof wetlands and/or their buffers.It includes,but is not limited to,creation,
enhancement,and restoration
F.Creation-means the producingor forming of a wetland throughartificial means from anupland(non-wetland)site.
G.Designated Wetland -means those lands identified through the classification processestablishedbythischapter.
H.Development -means alteration(seedefinition for Alteration)
I.Division -means the CityofMoses Lake Department of Community Development Division,
J.Earth/Earth Material-means naturally occurring rock,soil,stone,sediment,organic
material,or combination thereof.
K.Enhancement -means actions performedto improvethe conditionof existingdegraded
wetlands and/or buffers so that the functions they provideare of a higher quality (e.g.,increasing plant diversity,increasing wildlifehabitat,installing environmentallycompatible
erosion controls,removingnon-indigenousplant or animalspecles,removing fillmaterial
or garbage,etc.).
L.Erosion-means the wearingawayof the earth's surface as a result of the movement of
wind,water,or Ice.
M.Excavation -means the manualand or mechanicalremoval of earth material or fill.
N.Existinqand Ongoing Aqricultural Activlties-means those activitiesconducted on lands
defined in RCW84.34.020 (2),and those activitiesinvolvedinthe productionof crops and
livestock,including but not limited to operation and maintenanceoffarm and stock ponds
or drainage ditches,irrigation systems,changes betweenagriculturalactivities,and normal
operation,maintenance or repair of existingserviceable structures,facilities or improved
areas.Activitieswhich bringan area into agricultural use are not part of an ongoing activi-
ty.An operation ceases to be on going when the area on which it was conducted has
been converted to a non-agriculturaluse or has lain idle more than five (5)years and solongthatmodificationstothehydrologicalregimearenecessarytoresumeoperations,
unless the idle land is registeredin a federal or state soils conservation program.
O.Fill/Fill Material -means a deposit of earth material,placed by human or mechanical
means,and whichis not definedas solidwaste according to RCW70.95.
P._Filling-means the act of placingfillmaterial on any surface.
Q.Gradinq -means any excavating,filling,clearing,leveling,or contouring of the ground
surface of a site.
R.In-Kind Mitigation -means to replace wetlandswith substitute wetlands whose character-
istics and functions and valuesare intended to replicate those destroyed or degraded by
a regulatedactivity.
S.Mitigation -means to avoid,minimize,or compensate for adverse wetlandimpacts.
T.Out-of-KindMitigation -means to replace wetlands whose characteristics do not closely
appraximatethose destroyed or degraded by a regulated activity.
U.PermanentErosion Control-means continuous on-site and off site control measures that
are needed to control conveyance or deposition of earth,turbidity,or pollutants after
development,construction,or restoration.
V Restoration -means the re-establishmentof a viable wetland from a previously filled or
degraded wetland site.
W.SignificantImpact -means a meaningfulchange or recognizable effectto the ecological
function and value of a wetland,which is noticeable or measurable,resulting ina loss of
wetland function and value.

X.SinqIe-Family Residence or Dwelling-means a buildingor structure,or portion thereof,which isdesigned for and used to providea place of residence for humanhabitation.
Y .Sjite-means any parcel or combination of contiguous parcels,or right-of-way or combi-nation of contiguous rights-of-way under the applicant'sownershipor control where theproposedprojectimpactsawetland(s).
Z._Slop_e-means an inclined earth surface,the inclination of which is expressed as the ratio
of horizontaldistance to vertical distance.
AA.Substrate-means the soll,sediment,decomposingorganicmatter,or combination,located
on the bottom surface of the wetland.
BB.UtilityLine-means pipe,conduit,cable,or other similarfacilityby which services areconveyedtothepublicorindividualrecipients.Such services shallinclude,but are not
limited to,watersupply,electric power,gas,and communications.
CC.Wetland(s)-means areas that are inundated or saturated by surface water or ground wateratafrequencyanddurationsufficienttosupport,and that under normal circumstances do
support,a prevalenceof vegetation typically adapted for life in saturated_soil conditions.
Wetlands generallyinclude swamps,marshes,bogs,and similaramas.Wetlandsdo notincludethoseartificialwetlandsintentionallycreatedfromnon-wetland sites,including but
notlimitedto,irrigation and drainageditches,grass linedswales,canals,detention facilities,retention facilities,wastewatertreatmentfacilities,farm ponds,and landscape amenities.However,wetlands includethose wetlands intentionally created to mitigateconversion of
wetlands.
This is an interim definition and is subject to change if necessary.The Planning
Commission shall deem when changes in the definition am warranted.
DD.Wetland Buffer Zone -means a designated area contiguous or adjacent to a wetland that
is requiredfor the continued maintenance,function,and structuralstabilityofthe wetland.
EE.Wetland Class -means the U.S.Fish and WildlifeServicewetland classification schemeusingahierarchyofsystems,subsystems,classes,and subclasses to describe wetlandtypes.
FE Wetland Specialist -is a person with a minimum of a four (4)year degree in wildlifesciences,biology,environmentalscience,or an equivalentacademic background whoalsohasexperienceinperformingwetlanddelineations,analysis of wetland functions andvaluesandprojectImpacts,and wetland mitigation and restorationtechniques.The person mustbefamillarwiththeFederalManualforIdentifyingandDelineatingJurisdictionalWetlands,and the City ofMoses Lake Wetlands Ordinance.
19.06.060 Data Maps:The Community Development DIVIsionof the Municipal Services Department shallutilizetheNationalWetlandsinventory(NWI)maps and any other related informationand mapsasageneralguidetodeterminethelocationandextentofwetlandswithinthecitylimits.Thedatamapsshallbeconsultedwhenadevelopmentapplicationisreceivedtodetermineifthesiteiswithinanyareasshownaswetlands.Itshallbe the responsibility of the applicant to notify thecityofanywetlandswhichareonornearthesiteofthedevelopmentappIlcation.The locationofwetlandsshallbedeterminedbyawetlandanalysisreportconductedbyawetlandsspecialistusingtherequirementsfoundwithinthischaptet
19.06.070 Interpretation ofData Maps:The Municipal Services Director is charged with the administrationoftheCityofMosesI.akea Zoning Ordinancefor the purpose of interpreting data maps.AnaffectedpropertyownerorotherpartywithstandinghasarighttoappealtheMunicipalServicesDirectoradeterminationtothePlanningCommissionwhichisfurtherappealabletotheCityCouncil.
AIIdevelopment applications are requiredto show the boundary(s)of allwetlands on a scaleddrawingpriortothedevelopmentapplicationbeingconsidenedcompleteforprocessingpurpos-es.
19.06.080 Applicability:All development proposals located within or adjacent to an affected wetland(s)shallcomplywiththe provisionsof this chapter,including but not exclusiveto:
A.Building permitfor any new construction
B.Anyshoreline management permit as authorized under RCW90.58
C.Siteplan review
D.Subdivision,short subdivision,planned unit development,or binding site plan
E.Zoningvariance or conditionaluse permit

19.06.090 Site Analysis:When an applicationfor a development permitor license is received bythe city,
the applicationshall indicate whether the proposal Is withintwo hundred feet (200')of anaffectedwetland(s)area.Ifit is indicated on the application that an adjacent wetlandoraffected
wetland is present,a wetlandanalysisreportshall be filed,unlessthe Division determines that
a wetlandis not adjacent to orwithin an affectedwetland on the site.Ifthe data maps and/or
the application do not indicate the presence of a wetland,but there are other indications that
a wetland may be present,the Municipal ServicesDirector or designee shallmake a determina-
tionwhether a wetlandanalysisreport shall be required.
19.06.100 Wetland Analvsis Report:A wetland analysis report shall be submitted to the CommunityDevel-
opment Divisionforthe MunicipalServicesDepartment for reviewofa proposal for activitywhich
lies adjacent to or withinan affectedwetland.The purpose ofthe wetland analysis report is todeterminetheextentandfunctionofwetlandstobeimpactedbytheproposal
19.06.110 Appeals:Any decisionof the MunicipalServicesDirector in the administrationofthischapter
may be appealedto the Planning Commission.Such appeal shall be in writingand must be
submitted to the city within ten (10)days from the date of the Director's decision,which is
furtherappealableto the CityCouncil.
19.06.120 WetlandsClassificationand Ratings Guidelines:A wetland lating and classificationshall be
established based upon a completed delineation report prepared by a wetland specialletto
determine boundary,size,function,and value.Guidelinesfor preparinga wetland delineation
report are defined in Section 00.080 ofthischapter and the Federal Manual for Identifying and
Delineating Jurisdictional Wetlands.Guidelinesfor ratingwetlandsare definedinthe Washington
State Department of Ecology Four-Tier Wetlands Rating System for Eastem Washington.
Wetlands shallbe classifiedin accordance withthe Washington Department of Ecology Four-Tier
WetlandsRating Systemand is as follows:
A.CategoryI Criteria:
1.Documented habitat recognized by federal or state agencies for threatened or endan-
gered plant (orpotentiallyextirpatedplant),animal,or fish specles;or
2.Documented NaturalHeritage wetland sites or high quality native wetland communities
whichqualifyas NaturalHeritagewetlandsites;or
3.Documented habitat of regional(Pacific Coast)or national significance for migratory
birds;or
4.Regionally rare native wetlandcommunities;or
5.Wetlands withirreplaceableecological functions;or
6.Documented wetlands of local significance.
B.Category 11Criteria:
1.Wetlands that satisfyno Category I criterlaand are;
2.Documented habitatrecognizedbyfederal orstate agencies for sensitive plant,animal,
or fish species;or
3.Documented priority species or habitats recognizedby state agencies;or
4.Wetlands with significantfunctions which may not be adequately replicatedthrough
creationor restoration;or
5.Wetlands withsignificanthabitat value;or
6.Documented wetlands of local significance.
C.Category IIICriteria:
1.Wetlands that satisfyno Category I,II,or IVcriteriaand are;
2.Wetlands withsignificanthabitat value;or
3.Documented wetlands of local significance.
D.Categorv IVCriteria:
1.Wetlands that satisfy no Category I,II,or IIIcriteria and are;
2.Wetlands less than one (1)acre and hydrologically isolated and comprisedof one (1)
vegetated class that is dominated by one (1)species;or

class.
E.CategoryVCriterla:
1.Wetlands that satisfy no CategoryI,II,III,or IVcriteriaand are;
2.Wetlands that are directly associated with the shoreline of Moses Lake and comprisedofonevegetatedclassthatisdominated(greaterthan eighty (80)percent areal cover)by Cattailand/or SpikeRush and the widthof the wetland is less than five(5)feet.
O 19.06.130 Requiated Activities:AIIdevelopmentproposals requiring a land-use permitor license,unlessotherwisespecificallyexemptedbySection00.110,shallbe regulatedpursuant to the require-
ments of thischapter.The followingregulatedactivities in a wetland and or its associated buffer
are as follows:
A.Removing,excavating,disturbing,or dredging
B.Dumping,discharging or fillingwith any material.
C.Draining,flooding,or disturbing the water levelor watertable.
D.Alteration of the size of anystructure or infrastructure except nepair ofan existingstructureorinfrastructure,wherethe existing square footage or foundationfootprintis not altered.
E.Destruction or alteration of vegetation through clearing,cutting,intentional burning,shading,or plantingvegetationthat wouldalterthe naturalcharacteristicsof a wetland.
19.06.140 Exempt Activities:The following activitiesshall be exempt from the provisions of this chapter:
A.Existing and on-going agricultural activities,as defined in this chapter.
B.Maintenance,operation,normalrepair of existing roads,streets,utilitylines,and associatedstructures,providedthat reconstructionof any such facilitydoes not extend outside the
scope ofany designated easement or right-of-way.
O C.Normal maintenance and reconstruction of structunes,providedthat reconstructionmaynotIncreasetheexistinggroundcoverage.
D.Site study worksuch as surveys,soillogs,and other relatedactivitiesnecessary for the
submittal of a land-use application.
E.Activities determined by the MunicipalSenricesDirector as having minimal adverse impact
on wetlands,such as sport fishing or hunting,scientific or educational programs.
19.06.150 Wetlands Analysis Report Requirements:
A.Awetlandanalysisreport shallbe prepared bya qualified wetlandspecialistinaccordancewiththeUniformFederalManualforIdentifyingandDelineatingJurisdictionalWetlandsandsubmittedtotheDivisionforreviewforanyproposalsadjacenttoorwithinanaffectedwetlandarea.
B.Within forty-five(45)days of thesubmittalofthe wetlands analysîs report,the Divisionshalldeterminetheappropriatewetlandcategory,buffering requirement,and potentialmitigationbasedupontherecommendationofthewetlandsreportanalysis.The wetland analysisreportshallbeforwaitledforreviewandcommenttoagencieswithexpertiseorjurisdictionontheproposal,including,but not Ilmited to:
1.Washington State Departmentof Wildlife
2.Washington State Department of Fisheries
3.Washington State Departmentof Natural Resources
4.U.S.Fish and WildlifeService
Commentsreceived from reviewagencies withinforty-five (45)days ofthe wetlandanalysisreportshallbeconsideredbytheMunicipalServicesDepartment.
19.06.160 BufferAreas:Followingthe Divlsionkdetermination ofthe category ofwetlandassociated withtheproposal,the appropriate bufferwidths.shall be determined.Wetland buffer zonesshall beevaluatedforalldevelopmentproposalsadjacenttoawetland(s)inorder to protectthe ecologi-cal functionand value ofthewetland.Exceptas otherwisepermittedby this chapter,the buffer Iareasshallconsistofanundisturbedareaofexistingnativevegetationandnon-nativevegeta-tion.The following minimumbufferwidths shall be requiredfor the following wetland categories:

19.06.170 Buffer Alteration:The aforementioned buffer widths may be reduced,wlth the exception of
Category5 Wetlands,ifthe site demonstratesthatthe adjacent land is,and willremain,densely
vegetated,and that the intensity ofthe proposed land use for the developmentsite does not
contributeto a "netloss".The PlanningCommissionshall reviewrequestsfor buffer alterations
and approve,conditionally approve,or deny the request based on staff comments and
comments receivedpertinentto the proposalfrom agencies with expertise or jurisdictionon the
proposal,including,but not limited to:
A.Washington State DepartmentofWildlife
B.Washington State Department of Fîsheries
C.Washington State Department of Natural Resources
D.U.S.Fish and WildlifeService
At no time shall the minimum bufferbe less than fifty percent (50%)of the widths established
under this section.
19.06.180 Permitted Uses in Buffer Areas:The following activltiesam permittedwithin a wetland buffer:
A.Wells and necessary appurtenances including a pump,pump house.Access to the well
and pump house shallbe allowed.
B.Liftstations and necessary appurtenances.Access to the liftstationshall be allowed.
C.Pervious trailsand associated viewingplatforms.
19.06.190 Alterationof Wetlands:Alterationof wetlands may be allowedwhen all significantadverse
impacts to wetland functions and valuescan be shownto be fully mitigated.
19.06.200 Mitigation Plan Submittal Requirements::Following submittal of any proposed alterationsto
wetlandand bufferareas,the applicant shall submitto the department a wetlandmitigationplan
substantially in the following form:
A.Conceptual Phase:A conceptual compensatory mitigation planshallbe submitted to the
department.In cases in whichenvironmentalreview Is required,a threshold determination
may not be made prior to department review of the conceptual mitigation plan.The
conceptual mitigationplan shall Include:
1.Generalgoals ofthe compensatory mitigationplan,including an overall goal of no net
loss of wetland functionand acreage,and to strivefor a not resource gain inwetlands
over present conditions
2.AppraKimate site topography following construction
3.Location of proposed wetlandcompensation area
4.Generalhydrologic patterns on the sitefollowing construction
5.Natureofcompensation,includingwetlandtypes (in-kindand out-of-kind),general plant
selection and justification,approximateproject sequencingand schedule,and approxl-
mate size ofthenewwetland buffer
6.A conceptual malntenance plan
B.Detailed Phase:Following approval of the conceptual mitigation plan by the department,
a detalled mitigationplan shall be submitted to the department.The detailed plan shall
contain,at a minimum,the following components:
1.Text and map of the existingconditionof the proposed compensation area,including:
a)Exitingvegetation community analysis
b)Hydrological analysis,including topography,of existingsurfaceand significantsub-
surface flowsinto and out of the area in question
c)Soilsanalysis providing both Soi!ConservationServicemapping and data pmvided
by on-siteverifieddeterminations

e)Description of existing site conditions in relation to historic conditionsfor thosesiteswhichhavebeenrecentlyalteredordegraded
2.Text and map of the pmposed alterations to the compensatlon area,including:
a)Relationship of the projectto the watershedand existingwater bodies
b)Topographyofsite using one foot contour intervals
c)Water leveldata,including depth and durationof seasonally highwater table
d)Water flowpatterns
e)Grading,fillingand excavation,including a descriptionof importedsoils
f)Irrigation requirements,if any
g)Water pollutionmitigationmeasures during construction
h)Aerial coverage of planted areas to open water areas (ifany open water is to bepresent)
I)Appropriate buffers
The compensation plan shallincludedetailed site diagrams,topographicmaps showingslopepercentageandfinalgradeelevations,and any other drawings appropriate toshowconstructiontechniquesoranticipatedfinaloutcome.The plan shallprovidefor
elevations which are appropriate for the desired habitat type(s)and which providesufficienttidalprismandcirculationdata.
3.Aschedule shallbe providedshowing dates for beginningandcompletingthemitigationproject,includinga sequence of constructionactivities.
C.Approval of thedetailed mitigationplan shallbe signified by a notarized memorandum of
O agreement signed bythe applicantand Director of the department,and recordedwith theGrantCountyAuditonTheagreementshallrefertoallmitigationrequirementsfortheproject.
D.Approval ofthe detailed mitigation plan shall occur priorto the issuance of building permits
or other development permits.No development activityshall occur on the site prior toapproval.Required mitigation may also be required priorto issuance of permits or priortocommencingdevelopmentactivity.Timingof required mitigationshall be determined onacasebycasebasis.
19.06.210 Criteriafor Compensatory Mitigation:The applicant shalldevelop a planthat provides for con-struction,maintenance,monitoring,and contingenciesofthe replacement wetland,In addition,the applicant and landownershall meet thefollowing criteria:
A.The restored,created,or enhanced wetland shall be as persistent as the wetland itreplaces.
B.The applicant shall demonstratesufficientcapability to carryoutthe compensation project.
C.The compensationarea shall be providedwith permanent protectionand management toavoidfurtherdevelopmentordegradationandtoprovideforthelongtermpersistenceofthecompensationareaasdesigned.
19.06.220 Criteriafor Compensation Locationand TiminaofCompensatory Mitigation:In cases in whichitisdeterminedthatcompensatorymitigationisappropriate,the following shallapply:
A.Compensatory mitigationshall be providedon-site,except where on-site mitigationis notscientificallyfeasibleorpracticalduetophysicalfeaturesofthesite.The bunien of pmofshallbeontheapplicanttodemonstratethatmitigationcannotbeprovidedon-site.
B.When compensatory mitigationcannot be provided on-site,mitigation shallbe providedintheimmediatevicinityofandwithinthesamewatershedasthepermittedactivity.
C,Compensatorymitigationshallduplicatethe overall values and standards of the wetland tobereplacedandshallincludeat50%In-kind compensation mitigation unless it can bedemonstratedbytheapplicantthattheoverallwetlandvaluesofthemitigationareaandadjacentorconnectingwetlandscanbeenhancedbyahigherpercentageofout-of-kindmitigation.

D.Onlywhen it is determined by the department that A,B,and C above are inappropriate
and/or impractical shall off-site compensatory mitigation be considered.
E.Mitigation projects shall be completed concurrentwithother activitieson the site,unless
a phased schedule is agreed upon.betweenthe department and the applicapt.
19.06.230 Wetland Replacement Criteria:Where wetlands are altered,the applicant shall meet theminimumrequirementsofthissection.Whenit is proposed to alter or eliminatea wetland,the
applicant shall be requiredto replace the affetted wetland.A reduction in overallwetland area
is allowedif approvedby the Department.The recommended ratios for replacement and orcompensationforTypeI,II,III,IV and V are as follows:
Category I:
Scrub Shrub 2:1
Emergent 2:1
Category IIand III:
SotulMihrub 1.5:1
Category IV 1:1
CategoryV NOREPLACEMENT

jurisdiction,such decision shall not affect the validity or constitutionalityof the remaining por-
tions ofthis ordinance.
