1590_00001ORDINANCENO.1590 AN ORDINANCEAMENDINGCHAPTER 18.55 OF THE MOSESLAKEMUNICIPALCODEENTITLED"HOMEOCCUPATIONS" THE CITY COUNCIL OF THECITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS: Section 1.Chapter 18.55 of the Moses LakeMunicipalCode entitled "Home Occupations"is amended asfollows: 18.58.040 GeneralRequirements:The general requirements for a home occupation are as follows: A.There shall be no structural alterationto accommodate the occupation.Entrance to thespacedevotedtotheoccupationshallbefromwithintheresidence,exceptwhen otherwiserequiredbylaw. B.The use,including allstorage space,shallnot occupymorethantwohundred (200)squarefeetoftheresidencehfloorareawhichisfinishedforlivingpurposesIncludinganattached garage.No home occupation shalloccupy an accessory buildingora detached garage. C.No home occupationshallhave anyoutsidestorage of goods and materials associated withthehomeoccupation. D.Onlymembersofthe familywho reside on the premises and inany case no more than three(3)persons in any dwelling unitshallbe engaged in the occupation(s). E.There shall be no windowdisplay nor shallsample commodities be displayed outside thebuilding. F.Home Occupation Signs: 1.Signs identifying home occupations which are unlighted,placed flat against thestructure,and which do not exceed two (2)square feet in size are permitted in the R-2Zone,Single Family and Two Family Residential,and the R-3 Zone,Multl4amily Residential. 2.Signs identifying home occupations located inthe R-1Zone,SingleFamily Residential, am prohibitedexcept as required by law.Such signs,ifallowed,shallnot exceed two(2)square feet in size except as may be allowedbythis chapter. 3.Signs identifyinghome occupations may be permittedto exceedtwo (2)square feet in size subject to the reviewand approvalofthe Planning Commissionand after it hasbeenshownthatthesignwillnotadverselyaffectadjacentresidentialusesandthattheextrasizeisessentialtothesignbeingseen. G.No material or mechanical equipment shall be used which will be detrimental to theresidentialuseoftheresidenceoradjoiningresidencesbecauseofvibration,noise,dust,smoke,odor,interference withradio or television reception,or other factor. H.Materials or commodities deliveredto or from the residence which are of such bulk orquantityastorequiredeliverybyacommercialvehicleoratrailer,or the parking ofcustomer's automobiles in a manneror frequency causing disturbance or Inconvenience tonearbyresidencesorsoastonecessitateapublicparkinglotshallbeprima-facieevidencethattheoccupationisaprimarybusiness,and not a home occupation. I.Examplesofuses or occupationswhich mightnormally satisfythe criteriaofthissectionare:barbers,"bedand breakfast"facilities,custom florists,beauticians,professional serviceproviders,dressmakers,photographers,home canners,watch repairers,and other similaruses. O J.The following shall not be deemed permissible uses or home occupations:nursinghomes,massage parlors,woodworking and cabinet shops,household appliance,fumiture andelectronicequipmentrepairshops,fumigation services shops,upholsteringshops,carrepairshops,smallengine repair shops,and other uses deemed as "similar"by the SeniorPlanner or other similarpositionor a designee. K.A home occupation issued to one person shall not be transferableto any other person norshallahomeoccupationpermitbevalidatanyaddressotherthantheoneappearingonthepermit. L Any person engaging in a home occupation shallregisteras a business under Chapter 3.16ofthiscode. Section 2.This ordinance shalltake effectand be in force five (5)days after its passage and publication of its summaryas providedby law.
