1600_00001ORDINANCENO.1600 ANORDINANCEAMENDINGCHAPTER17.26 OF THEMOSESLAKEMUNICIPALCODEENTITLED"BINDINGSITE PLAN" THECITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTONDOORDAINAS FOLLOWS: Section 1.Chapter 17.26 of the Moses Lake Municipal Code entitled "BInding Site Plan"is amended asfollows: 17.26.010 Purpose:The proceduresregulating BindingSite Plans are establishedtoprovidean alternative O procedurefor the orderlyand efficientdivisionof platted land into parcels for the purpose ofleaseorsaleforindustrialorcommercialusesofthelanduponwhichnoresidentialstructureswillbeplacedwhenmorethanone(1)principalbuilding Isto be constructed on one (1)lot afrecord;to provide an alternativepmcedure for the orderlyand efficientdivision of platted landintoparcelsforthepurposeofleaseformobilehomesortraveltrailers;to promote the generalhealth,safety,and welfare;and to substantially comply with the provisionsof RCW Chapter58.17.The Binding SitePlan procedures specifiedherein are available as a complement to othermethodsforsubdividinglandforcommercialandIndustrialdevelopment.The Binding SitePlanshallbetherequiredmethodofdevelopmentformobilehomeparks.The Binding Site Planproceduresofthischaptershallhaveprincipalappilcationtocommercialandindustrialparksandmobilehomeparks. 17.26.020 Bindinq SitePlan Conditionsand Requirements: A.GeneralConditionsand Requirements: 1.Binding Site Plans shall be filed as a record of survey in the Grant County Auditor's Office. 2.A commercialor industrial Binding Site Plan authorizes a sale or transfer of a parcel.The Binding Site Plan and all of its requirements shall be legally enforceable on thepurchaserorotherpersonacquiringownershipoftheparcel.The sale or transfer ofsuchparcelinviolationoftheBindingSitePlan,or without obtaininga BindingSitePlanapproval,shallbe considereda violationof Chapter 58.17 RCWand shall be restrainedbyinjunctiveactionandbeIIIegalasprovidedinChapter58.17 RCW The sale or othertransferofownershipofaparcelofacommercialorindustrialBindingSitePlanshallbefiledasarecordofsurveyintheGrantCountyAuditor's office. 3.Moblie home parkand recreationalvehicle park Binding Site Plans shall not authorizethesaleortransferofownershipofaparceloftheBindingSitePlan. 4.Alteration of an approved Binding Site Plan shall be accomplished by submitting anamendedBindingSitePlantotheSeniorPlanner.The amended BindingSite Plan shallbeprocessedsubjecttoallthepmoeduresandrequirementsofthischapter. 5.Allimprovements (le:waterservices,firelines,buildingsewers,privateaccess streets,etc,)withinthe Binding Site Plan boundarles shallbe privately held and maintainedbythepropertyowner/s.TheBinding SitePlanshall make adequate provisionfor internalprivateaccessstreets,curbs,gutters,sidewalks,street lighting circuits,alleys,connec-tionto municipalutilities(sewerand water)in the existingdedicated street the BindingSitePlanadjoins,drainage ways,other public ways,or other municipal improvements as deemed necessary in conformancewith the City ofMoses 1.ake'sCommunity StreetandUtilityStandardsandtheCityofMoses1.aken Design Standards in effect at thetimeoftheBindingSitePlanapproval. 6.The BindingSite Plan shall front on an existing dedicated street.There shall beadequateaccesstoallparcels.Existingdedicated streets shallbe improved to the CityofMosesLake'sCommunityStreet and UtilityStandards.Private streets shall havedirectaccessontoadedicatedstreet. 7.The Binding Site Plan shall complywithall zoning and health regulations. 8.The Binding Site Plan shall be consistent with the Cityof Moses Laken ComprehensivePlan. 9.The Binding Site Plan shall provide for irrigation waterright-of-waysas now enacted orhereafteramended. 10.Environmentalinformationshall be prepared and submitted in accordance with theguidelinesestablishedundertheStateEnvironmentalPolicyActof1971,as amended.Said information is a part ofand mustaccompany the BindingSite Planapplication. 11.Unlessan applicantfor a BindingSite Plan requests otherwise and where the SeniorPlanneragrees,a Binding Site Plan shall be processed simultaneously with theapplicationforgggting,rezones,variances,planned unit developments,site plan approvals,and similarquasi-judicial or administrativeactions to the extent that proce- dural requirements applicableto these actions permit simultaneous processing. 12.Binding Site Plans shall be approved,disapproved,or mturned to the applicant for modification within ninety (90)days from the date offiling unless the applicant consents to an extension of such time period.Provided,that if an Environmental Impact Statement is required as providedin RCW43.210.030,the ninety (90)day period shall not include the time spent preparingand circulating the Environmental Impact State- mentby the local governmental agency B.SpecificConditionsand Requirements: 1.Priorto submission of a Binding Site Plan application and map,the subdivideror the subdividerbrepresentative shallschedule a pre-application conference withthe Senior Planner and representatives of other affected Cityof Moses Lake departments.The subdividershall present a conceptual idea of the Binding SitePlan.The Senior Planner and representativesof affected Cityof Moses Lake departments willrespond informally and address potentialitems of concem to aid the subdivider in preparing the Binding Site Plan. 2.The Binding Site Plan applicationand map shall be filed with the Senior Planneron forms prescribed bythe CommunityDevelopmentDivisionof the Municipal Services Department.Said appilcation shall be accompanled by twelve(12)copies of theBindingSitePlanandmap. 3.The Binding Site Plan [twelve(12)sets of prints plusthe original tracing and a repm-ducible mylar copy)shall be a neat and accurate drawing in black permanent ink prepared,stamped,and signed by a registered professionalland surveyor licensed by the State of Washington,The trimmed size of the Binding Site Plan shall measureeighteeninches(18")by twenty-fourInches (24")witha one and a half Inch (11/2") marginon the top or left marginand a half inch (1|2")border on the remaining thme (3)margins.The Binding Site Plan shall be drawn on two(2)or more sheets ifthe scale necessary to accommodate the map on one (1)sheet wouldundulycongest the drawing. 4.TheBinding Site Plan shallbear all inscriptions or attachments settingforth appropriate limitations and conditions for the use ofthe land. 5.The Binding Site Plan shall contain provisionsmakingall developmentsconform with the Binding SitePlan. 6.Reviewfees per Moses Lake Municipal Code Chapter3.54. 7.AIIpublic dedications shownon the plat being overlayedshallalso be shown on the BindingSite Plan. 8.The Binding Site Plan shall be accompanied by thefollowing: a.A plat certificatefrom a title company licensed to do business in the State of Washington and dated withinthirty(30)days ofthe date offiling of the Binding Site Plan and applicationwiththe Senior Planner confirming that thetitleofthe land as described and shown on the Binding Site Plan is inthe name of the ownerssigning the Binding Site Plan or instrument of dedication. b.A certificate from the Gent County Treasurer indicating that alltaxes and assess- ments on the property included in the Binding Site Plan or dedication have been paid according to the provisionsof RCW58.08.030 and RCW 58.10.040 as now enacted or hereafter amended. c.AIIcovenantsproposed to run with the land. 9.The Binding SitePlan shallcontainthe following: a.AIIdocuments,maps,and survey notes shall clearly showthe name ofthe Binding Site Plan,the name(s)of the subdivider(s)and the name of the registered land surveyor responsibleto the subdivider(s). b.The titleshall include the type of Binding SitePlan (commercial,industrial,mobile home parkor recreational vehicle park)and read as follows; (TYPEOF)BINDINGSITE PLAN of(NAMEOF THE PLAT/SHORT PLAT) ARecord of Survey ORD.1600/Page 3 c.The lines and names of all existing or platted streets or other public ways,parks,playgrounds,and easements adjacent to the Binding Site Plan,or dedication,including municl¾boundaries,townshipIInes,and section lines. d.Parcel locations including dimensionsand number or letter designations. e.The lengths and bearings of allstraightlines,curve radii,arcs,and semi-tangentsofallcurves. f.AIIdimensionsalong the IInes of each parcel withthe true bearings and also anyotherdatanecessaryforthelocationofanyparcellineinthefield. g.Suitableprimary control points,approved by the CityEngineer or descriptions andtiestosuchcontrolpoints,to which all dimensions,angles,bearings,and similardatagivenontheplanshallbereferred. h.The location ofall permanent monuments,propertycomers,and parcel comers. i.The names of allsubdivisionsImmediatelyadjacent thereto. j.The date,true north point,scale,datum plane,and date of survey k.The boundaryofthe Binding Site Plan,the courses and distances markedthereon, as determined by a field survey made by a registered and qualifiedland surveyorofthestate,and with an allowableerrornot to exceed one foot (1')Infivethousandfeet(5,000')and one foot (1')Inten thousand feet (10,000')in the CentralBusinessDistrict. I.The elevationsof allpermanent monumentsbased on a datum planeapprovedbytheCityEngineer. m.Certificationbya registeredlandsurveyorof accuracy of the BindingSite Plan mapandsurvey. n.Locationand dimensions of all irrigation water right-of-ways. o.Alllinear dimensions shall be given in feet and decimals of a foot to the nearesthundredth. p.The scale of the BindingSite Plan shall be not more than one hundredfeet (100')to the Inch.Exceptthatthe CityEngineer,subjectto a request priorto Binding SitePlansubmittal,may approvean alternative Binding Site Plan map scale not toexceedonehundredfeet(100')to the inch. q.Ifthe Binding Site Plan is a redMslon or amendment to an existing Binding Site Plan,the parcels,of the preceeding Binding Site Plan shall be shown by dottedlinesintheirproperpositionsinrelationtothenewarrangementoftheBindingSitePlan,the Binding Site Plan being so clearly shown In solid lines as to avoid ambiguity. r.The subdividerkland surveyorshallset all required monuments and shallstake allparcelcomersasshownontheBindingSitePlanbeforetheBindingSitePlanissubmittedforapproval. s.A vicinitymap at a scale of not more than four hundred feet (400')to the Inch.Exceptthat the City Engineer,subject to a request prior to plat submittal,mayapproveanaltemativevicinitymapscaleexceedingfourhundredfeet(400')to theinch.The vicinity map shall show all adjacent parcels.It shall show how thestreetsandaisysintheproposedsubdMaionmayconnectwithexistingandproposedstreetsandalleysInneighboringsubdivisionsorunplattedpropertytoproduceanadvantageousdevelopmentoftheentireneighborhood. t.The street address for the BindingSite Plan willbe assigned to the majoraccesstothededicatedstreettheBindingSitePlanfrontsupon. u.UnitedStates Bureauof Reclamationhorizontaland vertical data includingbenchmarks. 12.Any deed restrictionsor covenants existing or proposed shall be drawn on the BindingSitePlan. 13.Submit all parcel and boundaryclosures to the CityEngineer. 14.The Binding Site Plan shall contain the legal description of the subdivision and thefollowingdeclaration,acknowledgment,and endorsementstatements shallappear inthefollowingsequenceinblackpermanentinkeitherbyhandormechanicaldevice: Legal Description: Declaration: The ownerin fee simple of the land hereindescribed is .The owner does hereby establish a Binding Site Plan for the purpose of lease ofportions thereof,pursuantto RCWChapter 5817, and Title 17 ofthe Moses Lake Municipal Code and that the undersigneddeclares that developmentofthe property herein described shall conform to all inscriptionscontained hereon. Grant CountyAuditor by Deputy Auditor 17.26.025 Preliminary Non-Bindinq Advisory Review: A.The subdivider may request a preliminarynon-bindingadvisory review of the proposed BindingSitePlan by the Municipal Services Departmentpriorto preparation and submittal of a conclusiveBinding Site Plan.Upon a request for a preliminarynon-binding advisory revlew,the proposed Binding Site Plan must be submittedto the CommunityDevelopment Division of the Municipal Services Department in substantial compliance with Section 17.26.020 of this chapter entitledGeneralConditions and Requirementsas appmved bythe City Engineer. B.The Binding Site Plan willbe referred to other departments,agencies,and officesincompil- ance withSection 17.26.030 of this chapter. ORD.1600/Page 5 17.26.030 Referralto OtherDepartments.Agencies,and Offices: A.Uponreceipt of a complete and satisfactory conclusive Binding Site Plan application,theSeniorPlannershalldistributecopiesoftheSindingSitePlantoeachofthefollowingoffices,departments,or agencies withintwo(2)workingdays from receipt: 1.Public UtilityDistrict 2.Gas Company 3.Telephone Company 4.Engineering Division of the Municipal Services Department (threecopies) 5.Fire Department 6.Building and CommunityDevelopment Divisions of the Municipal Services Depaitment 7.GrantCounty Health District 8.Any irrigation district withjurisdiction 9.GrantCountyAssessor 10.CommunicationsCompany B.The SeniorPlanner shallfurthernotify the Police Department,Park and Recreation Depart- ment,and CityManagerthat a Binding Site Plan has been received. C.Notice of the filing of a Binding Site Plan located in the Cityof Moses Lake and adjoiningthemunicipalboundariesthereofshallbegiventotheGrantCountyPlanningDepartment. D.Notice of the filing of a BindingSite Plan located adjacent to the right-of-wayof a statehighwayshallbegiventotheStateDepartmentofHighways. E.Each office,department,or agency shall file written recommendations with the SeniorPlannerwithinfifteen(15)calendar days from the date offiling of the Binding SitePlan withOtheSeniorPlanner.Ifany such office,department,or agency fails to file a written recom-mendation within the time limitatlon,it maybe presumed thatsuch office,department,or agency has no recommendation. 1.Withinfifteen (15)calendardays of filingof the Binding SitePlan the CityEngineer shallreviewtheBindingSitePlanandsubmittotheSeniorPlannerawrittenmportwith respect to the following conditions: a.Thatthe proposed Binding Site Planbears the requiredcertificatesand statementsofapproval. b.That a titlereport fumished bythesubdividerconfirmsthe titleofthe landand theproposedBindingSitePlanisvestedinthenameoftheownerwhosesignature appears on the Binding Site Plan. c.That the Binding Site Plan is technicallycorrect as certified by the land surveyorresponsiblefortheBindingSitePlan. 2.Within fifteen(15)days offiling of the Binding Site Plan the appropriateirrigation districtservingorfromwhichtherealpropertyisentitledtobeservedwithirrigationwatershallreviewtheBindingSitePlanandsubmittotheSeniorPlannerawrittenreportrecom-mendingappitNal or disapproval of the Binding Site Plan as to the adequacy of theproposedmeansofthedeliveryofirrigationdistrictentitlementwaterandastotheadequacyoftheproposedmeansofremovalofIrrigationwastewater. O F.Ifthe Binding Site Plan is found to be unacceptable,a certifledletter shall be mailed to thesubdividerwithintwenty(20)days of receipt of the applicatlon. G.The Senior Planner may determine that a meeting shall be held to resolve major issuesidentifiedasaresultoftherecommendationsofotheroffices,departments,or agencies.Such meetingshall be attended by those offices,departments,or agencies responsiblefortherecommendationsandmustincludetheapplicantandtheSeniorPlanner.The pro-ceedings and results of the meeting shall be documented by minutes. 17.26.040 Final FillnqFees:Upon approvalofthe Binding Site Plan by the CityManager and withinfifteen(15)days themafter,the applicant shall remitthe following fees priorto the Binding Site PlanbeingofficiallysignedandrecordedwiththeGrantCountyAuditor: A.A check payable to the Grant CountyAuditor sufficient to coverthe recordingfees. B.When applicable,voluntary payment in lieu of a dedication of land or to mitigatea direct impact that has been Identified as a consequence of a proposed Binding Site Plan asallowedbyandpursuanttoRCW82.02.020. C.When applicable,a certificate from the GrantCountyAuditor certifying that covenants to the propertytitle have been recorded and filed shall accompany the Binding Site Plan. 17.26.050 Final Filing: A.Upon receipt of all required final fees the Binding Site Plan shall be signed by the City Manager. B.The Senior Planner shall transmit the originalmylar to the County Auditor for final filing. One mproducible copy shall be forwarded wlththe originalto be confirmedand isturned to the City Engineer for the his records.One paper copy shall be filed with the County Assessor. C.Any record of surveyfiled as a Binding Site Plan whichdoes not bear the approval of the CityManager is not a validBindingSItePlan and shall not conferany rights or privileges upon the property or itsowners. 17.26.060 Certificateof Segregation-Building Permit: A.Prior tothe issuance ofany buildingpermitfor construction within an approved Binding Site Plan,that portion of the Binding Site Plan for which the building permit is requested must be legally described and receive a certificateof segregation from the CommunityDevelop- ment Division of the Municipal Services Department.Said certificate shall insure the segregationof construction complements of the approvedBinding Site Plan. B.Approval ofthe BlndingSitePlan shallconstituteapprovalfor the Binding SitePlan applicant to developconstruction plans and specificationsfor all on-slte street and utilityimprove- ments. 17.26.070 Vested Rights:A Binding Site Plan shall be governedbythe terms of approvalof the Binding SitePlan,and the statutes,ordinances,and regulations in effect at the time ofapprovaland for a period of five (5)years after Binding SitePlan approvalunless the Council finds that a change in conditions creates a serious threat to the public health or safety.Parcels in a Binding Site Plan filed for recordshall be a valid land use notwithstanding any change In zoning laws for aperiodoffive(5)yearsfromthe date offiling. 17.26.080 Apoeals:Any decision approvingor disapprovingany BindingSite Plan shallbe nivlewable asprovidedbylawbywritofreviewbeforetheSuperiorCourtofGrantCounty.Said application for a writ of reviewshall be made to the court withinthirty(30)days from any decision to be reviewed.The cost of transcriptionsofall records ordered certifiedbythecourtfor such review shall be borne by the party seeking revlewin the Superior Court and no transcripts shall be prepared or provided prior to recelptof paymentfor them. Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publication of its summaryas provided by law.
