AN ORDINANCECREATINGCHAPTER 18.49 OF THE MOSESLAKEMUNICIPAL
CODE ENTITLED"SITE PLANS"
THE CITYCOUNCILOF THE CITYOF MOSES LAKE,WASHINGTONDOORDAINASFOLLOWS:
Section 1.Chapter 18.49 of the Moses LakeMunicipalCode entitled"SitePlans"is created as follows:
18.49.010 Int_eint:Thischapter is intended to provideproceduresforthe reviewof site plan applications.
O Siteplan reviewis intended to Insurethat new development projectscarriedout in givenzoningdistrictsareexecutedinamannerconsistentwithexistingordinancesconcerningpublicutilities,
traffic,facilities,and services and provideunifiedsite design,access,landscaping,screening,buildingplacement,and parkinglot layout.The site plan review process is not intended totaviewanddeterminetheappropriatenessofagivenuseonagivensite.It is intended to insurethatdevelopmentofasitewillprovidethefeaturesnecessarytoprotectthehealth,safety,andgeneralwelfareofthecitizensofthecity.
18.49.020 Applicabilitv:
A.Site plan reviewand approvalshallbe requiredpriorto issuance of a buildingpermitwhenprovidedunderthischapter.
B.Site plan review and approvalshallbe requiredfor all newnon-residentialuses.
18.49.030 Site Plans and Review:Any use that is subject to the requirements for a site plan reviewprior
to issuance of building permits shall be processed in accordance with the following procedums:
A.Application:Anapplication for site plan approval may be filed bythe propertyowner,lessee
of the property with more than a month-to-month tenancy,or authorized agent of thepropertyownetTheseshallbesubmittedtotheSeniorPlannerfortmnsmittaltothePlanningCommissionwithanalysisandrecommendation.
B.Planning CommissionReview:The Senior Planner shall assign a date no earlierthan two(2)weeks afterthe date ofapplicationfor a publichearing beforethe PlanningCommission.The site plans will be forwarded to the Planning Commissionwhich shall consider theapprovalofthesiteplanswithspecificattentiontothefollowing:
1.Compatibilitywiththe cityt comprehensive plan.
2.Compatibilitywith the surroundingbuildings'occupancy and use factors.
3.Allrelevant statutorycodes,regulations,ordinances,and compliancewiththe same.
C.The review and decision of the Planning Commission shall be in accordance with theprovisionsofChapter18.49 of the Moses LakeMunicipalCode.
18.49.040 Preliminarv SitePlan Conference:Prior to applyingfor site plan review,a developer may presenttocitystaffapreliminarysiteplan,which shall contain in a rough and appraximatemanner alloftheinformationrequiredonthesiteplanapplication.The purpose of the conference is toenablethedevelopertoobtaintheadviceofcitystaffastotheIntent,standards,and provisionsofthischapterwithmgattitotheproposedplan.Information presentedfor preliminary site plandiscussionshallbeconsideredconfidential.
18.49.050 Contents of Application:Each application for site plan reviewshall contain the followinginformation:
A.An EnvironmentalChecklistwhen required.
B.The title and location ofthe proposed development,together with the names,addresses,and telephone numbers of the recorded awners of the land and the applicant,and ifapplicable,the name,address,and telephone number of any architect,planner,designer,
or engineer responsible for the preparationof the plan,and ofanyauthorized representativeoftheapplicant.
C.A writtendescription addressing the scope of the project,the natureand size in gross floor
area ofeach use,and the totalamount of square feet to be covered by impervlous surfaces.
D.A vicinity map showing site boundaries and existing roads and accesses within andboundingthesite.
E.A topographic map delineating contours,existingand proposed,at five foot (5')intervals
and which locates existingstreams,marshes,and other natural features.
R Site plans drawn to a scale no smallerthan one inch (1")equals thirtyfeet (30')showinglocationandsizeofuses,buffer areas,yards,open spaces,and landscaped areas and anyexistingstructures,easements,and utilities.
G.A circulationplandrawn toa scale acceptable to the Municipal ServicesDirector illustrating
all access pointsfor the site,the size and location ofalldrivanays,streets and roads withproposedwidthandoutsidetumingradius,the location,size and design of parkingandloadingareas,and existingand proposed pedestriancirculationsystem.
H.A drainageand stormwaterrunoffplan.
I.A utilityplan.
J.Aplot planofallproposed landscaping including the treatment and materials used for open
spaces,and the types of plantsand screening to be used.
K.Typical buildingelevation and architecturalstyle.
L.Any other information deemed pertinent by the city stail.
18.49.060 Application Open for Public Inspection:From the time of the filing of the application until thetimeoffinalactionbythecity,the applicationtogether withall plans and data submitted shall
be availablefor publicInspection at the Planning and Building Division.
18.49.070 Duration of Approval:Construction on the project must commence within twenty-four (24)months from the date of final Commission action;otherwlse,the approval of the project
becomes null and void.
18.49.080 Amendments to a SitePlan:
A.Minoradjustments maybe made and approvedwhena buildingpermitis issued.Anysuch
alteration must be approved by both the SeniorPlanner and the Municipal ServicesDirectot
Minor adjustmentsare those which may affectthe precise dimensionsor sitingof bulldings(i.e.,lot coverage,height,setbacks)butwhich do not affectthe basic character or arrange-mentand numberofbulldingsapprovedinthe plan,nor the density of the developmentortheamountandqualityofopenspaceandlandscaping.Such dimensionaladjustments
shall not vary more than ten percent (10%)from the original,but shall not exceed the
standards of the applicable district.
B.Major amendments are those which substantiallychange the character,basic design,
density,open space or other requirements and conditions of the site plan.When a change
constitutes a major amendment,no building or other permit shall be issued without prior
review and recommendation bythe Planning Commission and approvalby the City Council
of such amendment.
Section2.This ordinance shall take effectand be in force five (5)days after its passage and publication
of its summary as providedby law.
