AN ORDINANCECREATINGCHAPTER 13.07 OF THE MOSES LAKEMUNICIPALCODEENTITLED"CROSSCONNECTIONCONTROL"
THE CITYCOUNCILOFTHE CITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS:
Section 1.Chapter 13.07 ofthe Moses Lake Municipal Code entitled "Cross Connection Control"is createdasfollows:
13.07.010 Purpose:The purpose of this ordinance in conjunctionwith the current editionsofChapter10oftheUniformPlumbingCode,theStateof Washington Administrative Code246-290 andtheAcceptedProcedureandPracticeinCrossConnectionControl-PacificNorthwestSection-American Water WorksAssociation,is to protect the health ofthe water consumerandthepotabilityofthewaterinthecitydistributionsystem.Inspectionand regulationofallactualorpotentialcrossconnectionsbetweenpotableandnon-potable systems isrequiredinordertominimizethedangerofcontaminationorpollutionofthepublicpotablewatersupply,Controllingand preventing cross connections is accompIlshed by eitherremovingthecrossconnectionorinstallinganapprovedbackflowpreventionassemblytoprotectthepublicpotablewatersupply.
13.07.020 Definitions:Paint of Delivery:The terminalend of a service connection from the publicpotablewatersystem,that is,where the water purveyor loses jurledictionand sanitarycontroloverthewateratitspointofdeliverytothecustomer's water system.Ifa meter isInstalledattheendoftheserviceconnection,thenthe point of deliveryshall mean thedownstreamendofthemeter.There shall be no unprotected takeoffsfrom the servicelineaheadofanymeterorbackflowpreventionassemblylocatedatthepointofdeliverytothecustomer's water system.Pointof deliveryshallalso include water servloeconnectionsfromfirehydrantsandallothertemporaryoremergencywaterserviceconnectionsfromthepublicpotablewatersystem.
13.07.030 Responsibility:
A.In accordance withWAC246-290,Chapter 10 of the UniformPlumbing Code and theCrossConnectionControlManual,the City of Moses Lakeis requiredto eliminate orOcontrolallcrossconnectionsthroughoutitsseivicearea.Therefore,anyone usingwaterfromtheCityofMosesLakeisrequiredtocomplywiththeseregulations.The
owner of the property in which a cross connection occurs is fully responsible for alldamagesincurred.
B.The Administrative Authority willenforoethe provisionsof this chapter.When provisionsofthischapterareincludedinmorethanonecodeorregulation,the most stringentwillapply.
C.If,in the judgment of the Administrative Authority,an approved backflowpreventionassemblyisrequired(atthe point of delivery,or withinthe customer's private watersystem)for the safety ofthe city water system,the Administrative Authority shall givenoticeinwritingtosaidcustomertoinstallsuchanapprovedbackflowpreventionassembly(s)at specific location(s)on the customer's premises.
13.07.040 Compliance:AIIcosts associated with purchase,installation,inspections,testing (byWashingtonStatecerdfiedtester),replacement,maintenance,parts,and repairs of thebackflowassemblyarethefinancialresponsibilityofthepropertyowner.
13.07.050 Notice to Cease Violation:Any person,firm,or corporation found to be violating anyprovisionofthischaptershallbeservedbytheAdministrativeAuthoritywithwrittennoticestatingthenatureoftheviolationandprovidingareasonabletimelimitforthesatisfactorycorrectionthereof.The offender shall,within the period of time stated in such notice,permanentlycease all violations.
O 13.07.060 Penalty for Continued Violation:Any person,firm,or corporation who continues anyviolationbeyondthetimeEmitprovidedforinSection13.07.050 is deemed to havecommittedacivilinfraction,and upon convictionthereof,shall be subject to a C-2penaltyandpunishableasdefinedinChapter1.08 of the Moses Lake MunicipalCode.Failureorrefusaltocomplyshaltalsoconstitutegroundsfordiscontinuingwaterservicetothepremisesuntilsuchrequirementshavebeensatisfactorilymet.
Section 2.Thisordinance shall take effectand be in force five (5)days after its passage and pubilcationofitssummaryasprovidedbylaw.
