1610_00001ORDINANCENO.1610 AN ORDINANCE AMENDINGCHAPTER 8.08 OF THE MOSES LAKEMUNICIPALCODEENTITLED"GARBAGECOLLECTION" THE CITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTONDO ORDAINASFOLLOWS: Section 1.Chapter 8.08 of the Moses Lake Municipal Code entitled"Garbage Collection"is amended asfollows: 8.08.055 Collection-Contract: A.The CityCouncil may authorize the entering into of a contract with a contractoror contrac- tors for the collection,removal,and disposal ofallgarbage,rubbish,refuse,solid waste,orotherwastematerial;provided,however,that the CityCouncilmay,at its option,authorizetheCityofMosesLaketohandlethecollection,removal,and disposal ofgarbage,rubbish,refuse,solid waste,and other waste material by the Cityof Moses Lake. B.The contractorshall be a person who,Inthe minds of the CityCouncil,is responsible andqualifiedtoperformthedutiesrequiredunderacontractforsolidwastecollection.Such contract shallbe made at least every five yearsor more frequently ifdesired.The contractor shall furnish a corporatesuretybond tothe cityina sum set under the contract,conditioned upon the faithful performance of his contractand in compliancewithall ordinancesofthecityandallrules,regulations,laws,and statutes relating to his business including theprovisionsofthischapterandinadditionprovideforpaymenttoalllaborers,mechanics,and subcontractorsand materialmen,and all persons who shall supply such contractorwith provisions and supplies for carrying on such work. C.As a breach ofthe service pmvided by this contract would cause serious and substantialdamagetothecityanditsresidents,and the nature of this contract wouldrender it impracti-cal or extremely difficultto fixthe actual damage sustained by the cityby such breach,itisagreedthatincaseofsuchbreachofservicethecitymayelecttocollectliquidateddamagesforeachsuchbreach,and the contractor will pay to the city as liquidated damages,and not as a penalty,the amount specifiedthereforin the contract such sumsbeingagreedastheamountwhichthecitywillbedamagedbythebreachofsuchservice. O An electionto seek such remedy shall not be construed as a walver ofany remediesthatthecitymayhaveastoanysubsequentbreachofserviceunderthecontract. D.Anycontract with the contractormay be terminatedbythe city at any timefor cause,or for failureto complywiththe terms ofthe contractwiththe city orthe provisionsofthis chapter and reasonable regulations imposed pursuantthereto. Section 2.This ordinance shalltake effect and be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
