ANORDINANCE AMENDINGCHAPTER17.13OP THEMOSESLAKEMUNICIPAL
CODE ENTITLED"SHORT SUBDIVISIONS"
THE CITYCOUNCILOF THECITYOFMOSESLAKE,WASHINGTONDOORDAINASFOLLOWS:
Section 1.Chapter 17.13 of the Moses Lake MunicipalCode entitled"ShortSubdivisions"is amended asfollows:
17.13.030 PreliminarvPlat Conditionsand Requirements:
A.GeneralConditions and Requirements:
1.The subdivision shall make adequate provisionfor roads,streets,curbs,gutters,
sidewalks,street lighting circuits,alleys,extension of municipal utilities(sewerand
water),drainage ways,irrigation water right-of-ways,otherpublicways or any municipal
improvements as deemed necessary in conformance withcity CommunityStreetand
UtilityStandards and city Design Standards in effectat the timeof plat approval.
2.The subdivision shallfront on a existingstreet.There shall be adequate access to all
parcels.Streets shall be Improvedto city standards.Street lighting shall be provided.
3.The subdivisionshallcomplywithallzoningand health regulations.
4.Thesubdivisionshall be consistentwiththe cityhComprehensivePlan.
5.Environmental information shall be prepared and submitted in accordance with the
guidelines established under the State Environmental Polley Act of 1971,as amended.Said information is a part of and must accompanythe preliminaryplatapplication.
6.The subdivision shall provide for Irrigationwater right-of-ways purauant to RCW
58.17.310 as now enacted or hereafter amended.
7.A street lighting plan as may be requiredbythe CityEngineer must be prov1ded.The
O plan must be approved bythe Grant CountyPUD and include certification that allstreetlightingfeeshavebeenpaidorthatarrangementsacceptabletothecityandthePUD
have been made for the payment of requiredfees.
8.The subdMslonshallnot have been previously divided in a short subdivisionwithinthe
last five(5)years and willnot be furtherdîvidedin any manner unless such proposedresubdivisioncomplieswithallpmvisionsrelatingtomajorsubdivisionsineffectatthetimethefurthersubdivisionIscommenced.
9.Unless an applicant for a preliminaryplat approval requests otherwise,and the PlatAdministratoragrees,a preliminaryplat shall be processed simultaneouslywiththeapplicationforrezones,variances,planned unitdevelopments,siteplanapprovals,andsimilarquasi-judicial oradministrativeactions to the extent that procedural requirements
applicableto those actions permit simultaneousprocessing.
10.Every decisionor recommendationmade under thischapter bythe Councilor Planning
Commissionshall be in writingand shall include findings of fact and conclusions to
support the decision or recommendation.
11.Preliminaryplats of anyproposed short subdMsionshall be approved,disapproved,orreturnedtotheapplicantformodificationwithinten(10)calendar days offiling of theshortplatandapplicationwiththePlatMministrator.
12.Inthe eventthatthe short subdivision does not border uponadjacent property to whichmunicipalutilitieshavebeenextendedoruponadjacentpropertyfrontinguponOimprovedstreets,the pmperty owner may request a variance to the short subdMaion
provisions for municipal impovements as deemed necessary in lieu of the completionoftheextensionofmunicipalutilities(sewerand water)and the completionof streetimprovements,a covenantto the land title maybe created.Saidcovenant shallpledgethepmpertyownertoinstallmunicipalimprovementsasdeemednecessaryatsuch
timeas the adjacent propertyisimprovedbythe installation ofmunicipalutilitiesand/oratsuchtimeastheimprovementofstreetsuponwhichtheadjacentpropertyisfronting
occura as any such eventisdeemed to occut in the sole disomtionof the Plat Mminis-trator,Said covenant shallalso pledge the propertyowner to participate in any futurelocalimprovementdistrictsforsuchImprovements.

13.Atthe discretionof the Plat Administrator,the requirement that a preliminary short plat
be submitted may be waived.Subject to the approvalof the Plat Administrator,a short
platwithout improvements may be submittedas a final platfor review and approval.
14.A plat certificatefrom a title company licensed to do business inthe State of Washing-
ton dated withinthirty(30)days ofthe date offiling ofthe final platand applicationwith
the Plat Administrator confirmingthatthetitleofthe lands as described and shownontheplatisInthenameoftheownerssigningthesubdivisionplatorinstrumentofdedication.
15.A certificate of occupancy shall not be issued until the final short plat has been
recorded with the Grant CountyAuditor.
B.SpecificConditionsand Requirements:
1.Prior to submissionofa short subdivisionpreliminaryapplicationand preliminaryplat,
the subdivider or the subdividerk representative shall schedule a pre-appilcation
conference with the Plat Administratorand representatives of other affected city
departments.The subdividershall present a conceptual Idea of the plat.The Plat
Administrator and representatives of affected city departments willrespond informally
and address potentialitems of concem to aid the subdMder In preparingthe short
subdivisionpreliminaryapplicationand preliminaryplat.
2.The preliminary short subdivisionapplication and plat shall be filed with the Plat
Administrator on forms prescribed by the Community Development DIvlslon of the
Municipal Services Department.The application shall be accompanied by twelve(12)copies of the preliminaryplat.At the discretionof the Plat Administrator,the require-
ment that twelve(12)copies of the preliminary plat be submitted may be walved.
Processing ofthe preliminaryplat mayrequire fewer than twelve(12)copies of the plat.
3.The preliminaryplat shall be a neat and accurate drawing,stamped and signed by aregisteredprofessionallandsurveyorlicensedbytheStateofWashingtononreproduc-
ible material at a decimalscale.The plat map shall measure eighteen inches (18")by
twenty-fourinches (24").The preliminaryplat shallbe drawnin black permanent inkon
two (2)or more sheets ifthe scale necessary to accommodate the map on one (1)sheet would undulycongest the drawing.
4.A non-refundablefee of fiftydollars ($50)shall accompany each and every application
for a preliminary short subdivisionwithout improvements.A non-refundable fee of
seventy dollars ($70)shall accompany each and every applicationfor a preliminary
short subdivisionwith Impmvements.
5.The preliminaryplat shall containthe following:
a.Name of proposed subdivision.
b.Boundarles of proposed subdivisionestablished by the preliminary survey.
c.Location and dimension of all existingand proposed streets,alleys,utilities and
right-of-vuaysand/or easements on and adjacent to the proposed subdivision.
d.Location and dimensionsof allexistingand proposed irrigation waterright-of-ways
on and adjacent to the proposed subdivision.
e.Legal descriptionof land withinthe proposed subdivision.
f.Any proposed land dedications.
g.Name,address,and seal ofthe registeredland surveyorwho made the preliminary
survey.
h.The date ofthe preliminary survey.
i.Horizontal scale of the proposed plat shall be not more than one hundred feet
(100')to the inch.Except that the CityEngineer,subject to a request prior to plat
submittal,may approve an alternative plat map scale not to exceed one hundred
feet (100')to the inch.
j.Monuments found and established duringthe preliminary survey
k.Date map is prepared,scale,and north pointof the map.Appraximate proposed
lot lines with their dimensions,including lot numbers and block numbers.

I.Ifany of the parcela can be furtherdividedor if only a portionof a tract is beingdivided,location of future streets,alleys,and lot lines shall be shown by dottedlines.
m.A vicinitymap at a scale of not morethan four hundred feet (400')to the inch.Except that the City Engineer,subject to a request prior to plat submittal,mayapproveanalternativevicinitymapscaleexceedingfourhundredfeet(400')to theinch.The vicinitymap shall show all adjacent parcels.It shall show how thestreetsandalleysintheproposedsubdivisionmayconnectwithexistingandproposedstreetsandalleysinneighboringsubdivisionsorunplattedpropertytoproduceanadvantageousdevelopmentoftheentimneighborhood,
n.Provide recommended street names for approval.
o.United States Bureauof Reclamationhorizontal and vertical data including benchmarks.
p.A site plan on a separate sheet showingthe following information:
1)Locationand sizing of existing and proposed utilitiesincludingwater,sewer,storm drains,electricity,gas,street lighting,curbs and sidewalks,telephone,and cablevisionlines.Minimumsize and scale shall be the same as thepreliminaryplatmap.
2)Existing and proposed structures and natural features and all proposedimprovementswithinandadjoiningtheproposedsubdMsion.
3)Topography of the area witha maximumof two foot (2')Intervalsof contoursasrequiredbytheCityEngineet
4)Present zoning classificationonand adjacent to property.
5)Any proposeddedications for parkland subjectto the approvalofthe PlanningCommission.
O 6)Anydeed restrictionsor covenantsexistingor proposed shallbe drawnon thesiteplanandpreliminaryplatmap.
Section2.This ordinance shalltake effectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
