1619_00001ORDINANCENO.1619 AN ORDINANCE CREATINGCHAPTER 5.07 OF THE MOSESLAKE MUNICIPALCODEENTITLED"ITINERANTMERCHANTSANDVENDORS" THE CITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: Section 1.Chapter 5.07 of the Moses Lake MunicipalCode entitled"Itinerant Merchants and Vendors"iscreatedasfollows: 5.07.010 License Required:It shall be unlawfulfor an itinerant vendor to engage in business within theOCityofMosesLakeexceptwhenlicensedasanoritinerantvendorasdefinedinthischapter.A separate license shallbe requiredfor each location of anyitinerant vendor. 5.07.020 Definitions:The following terms and definitîons shall be used in the administration of thischapter. A."Itinerant Vendor"shall mean any person,firm,or corporation,whether as owner,agent,consignee,or employee,whethera resident of the cityor not,who engages in a businessofsellinganddeliveringgoods,wares,food,or merchandise ofany kind or description andwhomayconductbusinessfromavehicleorotherconveyanceuponprivatelyorpubliclyownedpropertybutnotonapublicstreet,sidewalk,alley,or public way of the city.Aperson,firm,or corporation so engaged shall not be relieved from complying with theprovisionsofthischaptermerelybyreasonofassociatingtemporarilywithanylocaldealer,trader,merchant,or auctioneer,or by conductingsuch temporarybusiness in connectionwith,as part of,or in the name of any local dealer,trader,men:hant,or auctioneer. B."Food"shall have its usual andordinarymeaning,and shall include all Items designed forhumanconsumption,including,but not limited to,candy,gum,popcorn,hot dogs,sandwiches,peanuts,soft drinks,and dairy products. 5.07.030 Exemptions:The provisions of this chapter shallnot be construed to apply to the following: A.Persons sellingonlyfruits,vegetables,berries,eggs,orany farm produce. B.Persons sellingonlytrees used for the celebrationofthe Christmasseason. C.Persons selling fireworks D.Non-profit organizationswith local affillations 5.07.040 Application:Any person,firm,or corporationdesiringto secure a license as an itinerant vendorshallmakeapplicationtothecity,on forms to be providedby the city Such applicationshallprovide: A.The name or names and address of the applicant,vehicle license numbers of allvehiclesfromwhichtheapplicantproposestoconductbusiness;descriptionofthe generaltype ofgoods,wares,merchandise or food proposed to be sold by the applicant;the place orplaceswheretheapplicantproposestoengageinbusiness. B.Eachapplicationshallbe accompanied with the license fee as provided for in this chaptet C.Each license applicationfor an itinerant vendor shall be accompanied with the followinginformationtoestabilshcompliancewiththischapterandotherapplicablecodes: 1.A written authorizationfromthe propertyowner to conduct the applicant'sbusiness attheplacesonotedontheapplication. 2.A statement explainingthe method of trash and litter disposal being proposed by thevendor. 3.A drawing to a scale not greater than fiftyfeet (50)'per inch and not less than ten feet(10')per inch,which shall depict the following information: a.The portion ofthe propertyto be occupied by the business. b.The portion of the propertyto be used for automobileparkingand the number ofautomobilesaccommodatedinsaidarea. c.The location of drivewayspmviding ingress and egress to the property shall beapprovedbytheCityEngineer. d.The location of existingbuildingsand structures located on the property noting theuseofeachbuildingorstructuresoidentified. 4.Must havea Washington State Tax Number. ORD.1619/Page 2 5,07.050 Investigationand Determination:Upon receipt of such application,the Senior Planner shall cause such investigationof such person or persons'business responsibilityto be made as isdeemednecessaryfortheprotectionofthepublicgoodandshallrefertheapplicationtotheCommunityDevelopmentDivisionforitsdeterminationastocompliancewithstandardsandrequirementsofthischapter.An applicationshallbe denied bythe Senior Planner uponwriitenfindingsthattheapplicanthbusinessresponsibilityisunsatisfactoryorthatthepoposedbusinessactivitywillviolateanyapplicablelaw,rule,or regulation.Any license issued underthischaptershallcontainthenumberonthelicense,the date same was issued,the nature ofthebusinessauthorizedtobecarrledon,the amount of license fee pald,the expirationdate ofsaidlicense,the place wheresaid business maybe carried on under such license and the name ornamesofthepersonorpersonsauthorizedtocarryonthesame.The CommunityDevelopmentODivisionshallkeeparecordofalllicensesissuedunderthischapterandshallpromptlyprovidetheWashingtonStateDepartmentofRevenueacopyofanylicenseissuedunderthischaptet 5,07,060 _Feeg: A.An initialapplicationfee of one hundred dollars ($100)shall be submitted withall applica-tions.Following approvalof the application,a license fee of fiftydollars ($50)per monthshallbepaidforeachvehicleorconveyancetobeIIcensedunderthischapter. B.Any license issued under theprovisions of thischapter shallexpire thirty(30)days afterthedateofissuancethereofunlessapriordateisfixedtherein. C.In the event a vendor desires to change location,notice shall be given to the CommunityDevelopmentDivisionatleastthree(3)business days prior to the relocation and a fee ofseventy-five dollars ($75)shallbe levied per request. 5.07.070 Exhibitingof License/Transfer: A.Any license issued under this chapter shall be posted conspicuously at the place of business authorized therein. B.Any license issued under this chapter shall not be transferredto any other person,firm,corporation,or location. 5.07.080 Health Requiations:AIIfood vendorsshallcomplywith all laws,rules,and regulations regarding O food handling,and allvehicles used for the sale offood shallcomplywith allthe laws,rules,andregulationsrespectingsuchvehiclesasestablishedbytheGrantCountyHealthDepartmentand as set forth in the Mosestake Municipal Code. 5.07.090 Itinerant Vendor Standards:AIIitinerant vendors IIcensed underthis chapter shall conform tothefollowingstandards: A.No itinerant vendor shallbe licensed for a location in a residential zone as defined in Title18oftheMosesLakeMunicipalCode. B.No itinerant vendor shall locate his or her vehicle,other conveyance,temporarystand,ormerchandisewithintwentyfeet(20')of any publicright-of-way or withintwentyfeet (20')oftheintersectionofanypublicright-of-wayand private driveway C.No signs or signage shall be permitted other than that which can be contained on thevehicleorconveyanceutilizedorasotherwiseallowed. D.No vehicle,other conveyanceor temporarystand shall be located closer than twenty feet(20')from any buildingor structure on the licensed propertyor adjoining property. E.No vehicle,other conveyanceortemporarystand shall locate closer than fiftyfeet (50')fmmflammablecombustibleliquidorgasstorageanddispensingstructures, F.AIIitinerant vendors shall place at least one (1)thirty (30)gallon garbage receptacle uponthesiteofbusinessforcustomeruse. G.Licensed itinerant vendor sites shallbe cleaned of all debris,trash,and litter at the conclu-sion ofdaily business activities. H.AIIvehicles,other conveyances,ortemporarystands shall be equippedwith at least one 2A-40 BCfire extinguishet I.No itinerant vendorshall sell or vend from his or her vehicle or conveyance: 1.Withinfour hundred feet (400')ofany public or private school grounds during the houisofregularschoolsession,classes,or school related events in said public or privateschool,except when authorizedby said school. 2.Withinthree hundred feet (300')ofthe entrance to any business establishmentoffering as a mainfeatured item or items similar products for sale which is open for business. ORD.1619/Page 3 3.Withinthree hundredfeet (300')ofany publicpark ofthe citywhere any city authorizedconcessionstandIslocatedduringtimesotherthanduringthecourseofapubliccelebrationexceptasapprovedbytheParksandRecreationDepartmentofthecity 4.Withinthree hundred feet (300')of any public parkofthe city where any cityauthorizedconcessionstandislocatedduringthecourseofapubliccelebrationwhennon-profit organizations are permittedto engage in the sale of merchandise and food in suchpark. J.No itinerant vendorshall conduct business so as to violate the trafficand sidewalkordinanc- es of the city as now in effect or hereafteramended. K.No itinerant vendor shall obstruct or cause to be obstructed the passage of any sidewalk,street,avenue,alleyor anyother publicplace,bycausing people to congregate at or neartheplacewheregoods,wares,food,or merchandise ofany kind is being sold or offered for sale. L.Allvendors shall operate from a locatlon with a hard paved surface. 5.07.100 Revocation of License:Any license pursuantto this chapter may be revoked,in writing,bytheSeniorPlannerforanyofthefollowingcauses: A.Any fraud,misrepresentation,orfalse statement contained in the applicationfor license. B.Any fraud,misrepresentation,or false statement made in connection with the selling ofproducts. C.Any violation of this chapter. D.Convictionofthe Ilcensee of anyfelony or of a misdemeanor involving moral turpitude. E.Conductingthe business licensed under this chapter in an unlawful manner or in such amannerastoconstituteabreachofthepeaceortoconstituteamenacetothehealth,safety,or generalwelfare ofthe public. 5.07.110 Anneal:Any personaggrievedbythe denialofan applicationfor a license or bythe revocationofalicenseasprovidedforinthischapter,shall have the right to appeal to the CityCouncil.Such appeal shallbe taken byfilingwith the Finance Directorwithin fourteen (14)calendar daysafterthenoticeofdecisionhasbeenmailed,bycertified mail,to the applicantaor licenseek lastknownaddress,a writtenstatement setting forth the grounds for the appeal.The Council shallsetthetimeandplaceforhearingonsuchappealandnoticeofsuchhearingshallbegivenbycertifiedmalltotheappellantatleastfive(5)calendar days priorto the date fixed for suchhearing. 5.07.120 Penaltv:Failure to complywithany ofthe provisionsof this chapter shall subject the violator to a C-6penaltyas defined in Chapter 1.08 ofthis code.
