AN ORDINANCEAMENDINGCHAPTER 18.28 OF THE MOSESLAKEMUNICIPALCODEENTITLED"C-1,CENTRALBUSINESSDISTRICTZONE"
THE CITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS:
Section 1.Chapter 18.28 ofthe Moses I.akeMunicipal Code entitled"C-1,CentralBusinessDistrict Zone*
is amended as follows:
18.28.040 ConditionalUses:Thefollowingspecific and generallydescribed uses shall be permittedintheC-1 Zone only as a conditionaluse subject to the approval of the Planning CommissionincompliancewiththeprovisionsofthischapterandChapter18.51 ofthis titleentitled "Condition-
al and Unmentioned Uses."
A.Churches
B.Schools
C.Hospitals
D.Gasolinestations
E.Any permitteddevelopmentovertwo (2)acres in size
F.Open sale lots
G.Keeping of livestock,poultry,rabbits,or bees
H.Bulkstorage of hazattious,combustible,or explosivesubstances
I.Any commercial use not on city sanitary sewer.
J.Other unmentioneduses ruled bythe PlanningCommissionto be a conditionaluse or usespermittedbyspecificprovisionofthischapterasaconditionaluse.
K.Residential Uses
L.On-sitehazardouswaste treatmentand storagefacilities in compliance withtheperformance
standards of the State ofWashington sitingcriteria for on-site hazardous waste treatmentandstoragefacilitiesandtherequirementsofthischapter;providedthat,on-site hazardous
waste treatment and storage facilitiesare accessory to and subordinateto a primaryusewhichisageneratorofhazardouswaste.
18.28.140 Outdoor Uses The following outdoor uses are specificallypermitted in compliance with therequirementsofthischapter.
A.ServiceStation Pumps -gas pumps shall be set back twenty-fivefeet (25')from propertylines
B.Parks and playgrounds
C.Outdoor recreational,entertainment,or amusement faellities
D.Essential publicservicesand utilltlesincludingbuildingsand structures
E.Sidewalksales
F.Festivals or other outdoor celebrations
O G.Other unmentioneduses ruled by the Planning Commissionto be similar to and compatiblewiththespecifiedpermIttedoutdooractivitiesoruses.
H.The listed outdoortemporary/seasonal usesare permitted outright not to exceed thirty(30)days in duration.Temporary structures associated with the listed uses are permitted andshallbeexemptfromtherequirementforcompliancewiththeUniformBuildingCode.ThesitingoftemporarystructuresshallbeapprovedbytheBuildingOfficial.

3.Non-profit organizationsales or activitiesassociated with a seasonal event
18.28.270 Signs and Billboards:Signs and billboards shall be in compliance with Chapter 18.56 of this
title.
18.28.300 Variances:A variance of the bulk regulationsand performancestandards of this chapter maybeobtainedthroughtheHearingExaminerincompliancewiththeprovisionsofChapter18.80
of this title entitled"Hearing Examiner".
18.28.340 Issuance ofa Business License or a Certificate ofOccupancy:No certificateofoccupancy orbusinesslicensemaybeissuedbythecityuntilthepremisesinquestionhavebeeninspected
and found by the Building Officialto be in compliancewiththe provisionsand requirementsofthischapter.
Section2.This ordinance shall take effect and be in force five (5)days afterits passage and publication
of its summaryas provided by law.
