AN ORDINANCEAMENDINGCHAPTER 18.32 OF THEMOSESLAKEMUNICIPAL
CODE ENTITLED"C-2,GENERALCOMMERCIALAND BUSINESSZONE"
THE CITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTON DOORDAINASFOLLOWS:
Section 1.Chapter 18.32 of the Moses Lake Municipal Code entitled "C-2,General CommercialandBusinessZone"is amended as follows:
18.32.040 ConditionalUses:The following specificand generallydescribed uses shallbe permitted intheOC-2 2one only as a conditional use subject to the approval of the Planning Commissionin
compliancewith the provisions ofthis chapter andChapter 18.51 ofthistitleentitled"Conditional
and Unmentioned Uses."
A.Churches
B.Schools
C.Hospitals
D.Bulk storageofhazardous,combustibleor explosivesubstances
E.Manufactured home parks
F.Airports,landing strips,heliports,and air transportationfacilities
G.Recreational vehicleparks
H.Keeping of livestock,poultry,rabbits,or bees for commercialor privatepurposes
I.Any commercial use not on citysanitarysewer.
J.Locating steel sea or ocean-going containersmarked with the American Bureau ofShipping'sEmblem or meetingthe InternationalStandard Organization'sstandards which
can be detached from a trailer,chassis,or frame and,which were formerly used for
transporting sea or ocean-going cargo when intended to be used as storage facilities withthefollowingconditionsbeingrequiredasaminimum:
1.Se used as an appurtenance totheprimary use;such primaryuse being situated Inanenclosedadjoiningbuilding.
2.Be placed on concrete,asphalt,or level,compacted,hard surface at all times.
3.Be painted so as to blend Inwiththe building to which Itis associated.
4.Not be visible to the motoring public or from residential neighborhoods immediatelyadjacenttothepropertywhereitislocatedunlessothermeasuresareemployedtomitigatethevisualimpactsofthecontainersformerlyusedfortransportingseaoroceangoingcargo,which measures shallbe approved by the Planning Commission,provided,that the Planning Commissiondoes not need to requiremitigation measures if it is feltthatthemotoringpublicoradjacentresidentialneighborhoodsarenotimpacted.
5.Have a maximumallowablesquare footage of container storage area notto exceedthreepercent(3%)ofthegross floor area ofthe building with whichthe container(s)isassociated.In no event shallthe numberof containers allowedas appurtenant storagefacilitiesexceedthree(3)in number.
8.Be located on premises as an appurtenant storage facility.
7.Not be stacked.
8.Abide by allset back requirements applicableto the zone in which it is located.
9.The recipient ofthe conditionaluse permit is the only party allowedtouse the contain-
er.
K.Otherunmentioneduses ruled by thePlanning Commissionto be a conditional use orusespermittedbyspecificprovisionofthischapterasaconditionaluse.
L.Site builtand factory built,detached housing units,whetheroccupied bythe owner,rented,leased,or occupied by a resident watchman,custodian,or attendant,when set backaccordingtoMosesLakeMunicipalCode18.32.220.
M.On-sitehazardous waste treatmentand storage facilities in compliancewith the performancestandardsoftheStateofWashingtonsitingcriteriaforon-site hazardous waste treatment

and storage facilltles and the requirements ofthis chapter;,provided that,on-site hazardous
waste treatment and storage facilities are accessory to and subordinate to a primary usewhichisageneratorofhazardouswaste.
N.Manufactured detached housing unitswhether occupied by the owner,rented,leased,oroccupiedbyaresidentwatchman,custodlan,or attendantwhen set back one hundred and
fiftyfeet (150')from any arterialstreet.
O.Residential uses as an accessory use to a commercialstructure,whetheroccupied by the
owner,rented,leased,or occupied by a resident manager,watchperson,custodian,orattendant.Accessory use shall be defined as a use of a portion of a building which is
incidental and subordinate to the principal use of the building.
P.Multi-familyresidential uses (apartments)
18.32.150 Outdoor Uses:The followingoutdoor uses are specificallypermittedin compliance withthe
requirements of this chapter:
A.ServiceStation Pumps -gas pumps shall be set back twenty-fivefeet (25')from property
lines
B.Parks and playgrounds
C.Outdoor recreational,entertainment,or amusementfacilities
D.Essential publicsentices and utilities including buildingsand structures
E.Sidewalksales
F.Festivals or otheroutdoor celebrations
G.Otherunmentioneduses ruledby thePlanningCommissionto be similarto and compatible
withthe specifiedpermittedoutdooractivitiesor uses.
H.The listed outdoor temporary/seasonal uses are permitted outrightnot to exceed thirty(30)days in duration.Temporary structures associated withthe listed uses are permittedand
shall be exemptfrom the requirement for compliance with the Uniform Bullding Code.The
sitingoftemporary structures shallbe approved by the Building Official.
1.Christmastree sales
2.Fireworks sales as approved by the Fire Chief
3.Non-profit organizationsales or activities associated with a seasonal event
18.32.280 Signs and Billboards:Signs and billboards shall be in compliancewithChapter 18.56 of this
title.
18.32.310 Variances:A variance of the bulk regulatlonsand performance standards of this chapter may
be obtained through the Hearing Examiner in compliancewiththe provisions ofChapter 18.80
of thistitleentitled "Hearing Examiner"
18.32.350 Issuance of a Business License or a Certificateof Occupancy:No certificateof occupancy or
business IIcense may be issued by the cityuntilthe premises in question have been inspected
and found by the Building Officialto be in compilancewith the provisions and requirements of
this chapter.
Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publication
of its summary as provided by law.
