AN ORDINANCEAMENDINGCHAPTER 13.12 OF THE MOSESLAKEMUNICIPALCODEENTITLED"WATERANDSEWER RATES"
THECITYCOUNCILOFTHE CITYOFMOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 13.12 ofthe Moses LakeMunicipal Code entitled"Waterand SewerRates"is amendedasfollows:
13.12.010 ResidentialWater Rates:
A.The following shallbe the monthly rate charge for water from the city water systemfrom allresidentialIMngunitswithinthecorporatelimitsofthecityandoutsidethecorporatelimitsofthecity:

13.12.030 Residential Sewer Rates:The following shallbe the monthlyrate charged customers residing
withinthe corporate limitsofthe cityand outside the corporate Ilmitsofthe cityforsewer service
from the citysewer system for single-family dwellings and each unit of a duplex with separate
meters:flat rate,$18.20per month,
13.12.035 Duplex SewerRates:The following shallbe the monthlyrate charged customers residing within
the corporate limitsofthe cityand outside the corporate limits of the city for sewerservicefrom
the city sewer system for duplexes with only one meter servingtwo Ilving units or for two living
units on a singlelot served by one meter:flat rate,$36.30per month.
13.12.040 CommercialSewer Rates:
A.The following shall bethe monthlyratecharged customers residing withinthe corporate Ilmits
of the cityand outsidethe corporate limitsofthe city for allchargeable water discharged into
the city sewer system by commercial users and dwellingswith three or more living units
served by one meter:

B.For purposes of calculating sewer charges,chargeable water shall be defined as follows:Chargeablewater shall be measured by the waterconsumed on the premises,whateverthesourceofsuchwater,and the same will be metered either by a publicutility meter or oneinstalledandmaintainedbytheownerofthepremisesathisownexpenseandapprovedandinspectedbythecity.As an option,ifrequested by the ownerof the premises,the citywillinstallawatermeterwiththecostforthemeterandinstallationbeingpaidbytheownerofthepremisesinaccordancewiththechargesassessedinMLMC13.08.020 for water/sewerconnections.Undersuch circumstancesthe watermeter becomes the propertyofthe ownerofthepremisesandallcostsofreplacementandrepairaretheresponsibilityoftheownerofthepremises.InallcIroumstanceswherethe water is metered bya privatelyowned watermeterandisusedtodeterminesewercharges,the cityshall be allowedaccess to the meterinordertoreadsuchmeter.Where the use of water is such that a portionof allthe wateruseddoesnotflowintothesewersystem,for whateverreason,but is lost by evaporation,irrigation,sprinklingor is used inmanufacturingor ina manufacturedproduct,or Is lost forwhateverreason,and the person in controlprovides proof of this fact and installs a meterorothermeasuringdeviceapprovedbythecitytomeasuretheamountofwatersousedand
so lost,orifthe cityIscapable ofdeterminingtheamount of sewageenteringthe city'ssewersystembysomeothermechanicalmeans,thiswater maybe deducted from the actualwaterconsumptionusedIncalculatingthesewercharge.
The sewercharges fortriplexesand apartments,mobilehome parks,schools,hospitals andothercommercialestablishmentswithincreasedusageforIrrigation,onlyiftheirlandscapingexceedsfivethousandsquarefeet,shall be computed on the average consumptionduringthepreviousnon-irrigation season,unless the user elects to install,at his expense,anapprovedmeasuringdevicetomeasurewaternotenteringthesewersystem.When a userhasaswimmingpoolorcoolingunitsdischargingtothesanitarysewer,he must install anapprovedmetertodeterminetheamountofwaterexemptfromsewerchargesduringtheirrigationseason.The irrigation season shall be defined as the period in which statementsaremailedfortheAprlithroughNovemberbilIîngcycles.
C.Sewer rates for commercial uses discharged into the sewer system may be separatelydeterminedbytheCityCouncil,based uponbothvolume and chemicalcharacteristicsofthesewage.The CityCouncilreserves the privilege to require pre-treatment of any materialdischargedintotheseweragesystem,or to prohlbitdischarge into the system of industrial
wastes that,because of either volume or concentration,will overload existing seweragefacilities.
D.AIIair-conditioning and refrigeration unitsthat are installed,replaced or that have capacityincreasedaftertheeffectivedateoftheordinancecodifiedinthischaptershallberequired
to install recirculating units.Disposal may not be accomplished by discharging into thesanitarysewersystem.
Section 2.This ordinance shalltake effectwithbillingsafterAugust1,1994.
