B.SpecificConditionsand Reguirements: 1.Prior to submissionof a short subdMsionpreliminaryapplicationand preliminaryplat, the subdivider or the subdivider's representative shall schedule a pre-application conference with the Plat Administrator and representatives of other affected city departments.The subdividershall present a conceptual Idea of the plat.The Plat Administrator and representatives of affected city departments will respond informally and address potentlaiItems of concem to aid the subdMder in preparing the short subdivision preliminaryapplicationand preliminaryplat. 2.The prellmlnaryshort subdivisionapplication and plat shall be filed with the Plat Administrator on forms prescribed by the CommunityDevelopment Division of the Municipal Services Department.The applicationshall be accompanied by twelve(12)copies of the preliminaryplat.At the discretionofthe Plat Administrator,the require- ment that twelve (12)copies of the preliminaryplat be submitted may be waived. I.If any ofthe parcels can be further divided or if onlya portionof a tract is being divided,location of future streets,alleys,and lot lines shall be shown by dotted lines. m.Avicinity map at a scale of not more than four hundred feet (400')to the inch. Except that the CityEngineer,subject to a request prior to plat submittal,may approve an altemative vicinity map scale exceedingfour hundred feet (400')to the ORD.1638/Page 3 inch.The vicinity map shall show all adjacent parcels.It shall show how thestreetsandalleysintheproposedsubdMsionmayconneetwithexistingandproposedstreetsandalleysinneighboringsubdMalonsorunplattedpropertytoproduceanadvantageousdevelopmentoftheentireneighborhood. n.Provide recommended street names for approval, o.UnitedStates BureauofReclamationhorizontal and verticaldata includingbenchmarks. p.A site plan on a separate sheet showingthefollowing Information: 1)Location and sizing of existingand proposed utilitiesincluding water,sewer,storm drains,electricity,gas,street lighting,curbs and sidewalks,telephone,and cablevisionlines.Minimum size and scale shall be the same as thepreliminaryplatmap. 2)Existing and proposed structures and natural features and all proposedimprovementswithinandadjoiningtheproposedsubdMslon. 3)Topography ofthearea witha maximumof two foot (2')intervals ofcontoursasrequiredbytheCityEngineer. 4)Presentzoning classificationon and adjacent to property. 5)Anyproposed dedicationsfor park land subjectto the approvalofthe PlanningCommission. 6)Anydeed restrictions orcovenants existingor proposed shall be drawnon thesiteplanandpreliminaryplatmap. 17.13.070 Preliminary Short SubdivisionApplication Review Procedures: A.Upon receipt of the short plat application,the Plat Administrator shall,within the timelimitationsestablishedbyRCW58.17.140,respond to the applicant in one of the following manners: 1.Preliminary approval is granted as submitted. 2.Preliminary approvalis granted with modificationsrequested. 3.The proposed subdMsion is denied and reasons stated. 4.PreliminaryapprovaliswithhelduntilPlanning Commissionand/orCouncilapprovalofdedicationsorvariancerequests. B.The short subdMaion preliminary application shall require approval ofthePlat AdministratorandtheCityEngineerindicatedbytheirdatedsignaturesthereontobevalid. C.The decisionofthe Plat Administrator shall be final,unlessan appeal byany aggrieved partyismadetothePlanningCommissionwithinten(10)calendardays of the date of decisionofthePlatAdministrator.Said appeal shallbe inwriting to the Planning CommissionandsubmittedthroughtheCommunityDevelopmentDivision.The CommunityDevelopmentDMslonshallrecordanddatethereceiptofthatappeal.The PlanningCommissionshallactonthatappealwithinforty(40)days unless an extensionis agreed to in writingby theapplicant.The decision ofthe Planning Commissionshall be final and conclusive unless,withinten (10)days,any aggrieved partyfileswiththe CityClerka written appeal.TheCouncilshallhearthatappealwithintwenty(20)calendardays of the date of appeal. D.Approval of the preliminary plat shall constitute approval for the applicant/subdivider todevelopconstructionplansandspecificationsforallfacilitiesandimprovementsandtopreparethefinalplat. 17.13.110 FinalShort Subdivision Plat Application: A.GeneralRequirements: 1.The finalshort subdMaionapplicationand platwillbe filed withthe Plat Administrator on forms provided by the CommunityDevelopnient Division of the Municipal ServicesDepartment. 2.Allrequired street and utilityimprovements must be constructed bytheappilcantandmustbeacceptedbytheCityofMosesLakeorasubdMsionbondorotherapprovedsecurityshallbesubmittedinanamountsufficienttocoveronehundredandfiftypercent(150%)of the estimated cost of completingallrequired utilityextensions andstreetimprovementsasdeterminedbytheMunicipalServicesDirector.Uponcomple- ORD.1638/Page 4 tion of the requiredpublicimprovements and prior to acceptance by the Council,the subdivider/developermust submita maintenance bond oraltemativesecurityapproved by the CityAttomey in an amount determinedby the CityEngineer and approved by the Municipal Services Director.The maintenancebond amount shallbe one hundred percent (100%)ofthe actual cost of construction.Analternative security shallbe inanamountnotlessthantenpercent(10%)nor more than one hundred percent (100%)of the actual cost of construction.The amount shall be determined on a case by casebasisbasedupontheCityEngineer's estimated cost of repair or maintenance should repair or maintenance be required.Thesubdivider/developershallsubmitdocumenta- tionofthecost ofconstructiontotheCityEngineer for his review and approvaland useindeterminingtherequiredbondoralternativesecurityamount.Said bond shallbe in effect for one (1)year from the date of acceptance. 3.The instrument ofdedicationofallstreets,right-of-ways,parks,playgrounds,easements,reservations,Irrigationwater right-of-ways,and anyarea to be dedicated to publicuse,together withany restrictionsor limitations thereon shallbe submitted as a part of thefinalplat. 4.The application shall be accompanied by the following: a.A plat certificatefrom a title company licensed to do business in the State of Washington dated within thirty (30)days of the date of filing of the final plat and application with the Plat Administrator confirmingthat the title of the lands asdescribedandshownontheplatisInthenameoftheownerssigningthesubdivi-sion plat or instrument of dedication. b.A certificatefrom the GrantCountyTreasurer indicating that alltaxes and assess- ments on the property included in the final plat,subdivision,or dedication have been paid according to the provisions of RCW58,08.030 and RCW 58.10.040 as now enacted or hereafter amended. c.A certificatefrom the cityFinance Directorindicatingthat there are no delinquent special assessments or liens on the property included in the final plat,subdivision, or dedication. d.A check payable to the cityin the amount of one hundred thirty dollars ($130)to cover the cost of checking the final short plat without Improvements.A check payable tothe cityin the amount of fiftydollars ($50)to coverthe cost ofchecking the finalshort plat withImprovements. e.Allcovenants proposed to runwiththe land. 5.The finalshort plat [twelve(12)sets of printsplusthe originaltracing and a reproduclble mylar copy]shall include all items in Section 17.13.030 (B 4)and any additional information and modificationsrequested in the preliminaryapproval.At the discretion of the Plat Administrator,the requirement that twelve (12)copies of the final plat be submitted may be waived.Processing ofthe final plat may require fewer than twelve (12)copies. The final plat shall be prepared in a neat and legible manner in black permanent drawingink on mylardrafting film.Alldocuments,maps,and surveynotes shallcontain the name of the subdivision,the name(s)ofthe subdivider(s),the name of the regis- tered land surveyorresponsible to the subdivider(s).Thetrimmedsize of the finalplat shallbe eighteen inches (18")bytwenty-four inches (24")with a one and a half inch (11/2")margin on the top or left margin and a one half inch (1/2")border on the remaining three (3)margins.The finalplatshallbe recorded on two (2)or more sheets ifthe scale necessary to accommodate the map on one (1)sheet would undulycongestthedrawing. 6.The final short subdivision plat shall be approved or disapproved withinthe time limitations established byROW58.17.140 from the date offiling ofthe final plat with the Plat Administrator.This time periodshall be bindingunless the applicant consents to an extension oftime in writing. 7.No final short subdivision platmay be approved unless the citymakes a writtenfinding of fact that the proposed subdivision is In conformance withany applicable zoning ordinances,or other land use controls whichmay exist. 8.No final short subdivisionplat shall be approved for any subdivisionwhichlies in whole or in part inanirrigation district organizedpursuant to ChapterROW87.03 unlessthere has been providedan irrigationwater right-of-way pursuant to RCW58.17.310 as nowenactedorhereafteramended.
