1639_00001ORDINANCE NO.1639 ANORDINANCEAMENDINGCHAPTER 17.17 OFTHEMOSESLAKEMUNICIPALCODEENTITLED"MAJORSUBDIVISIONS" THECITYCOUNCILOFTHECITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: Section 1.Chapter 17.17 ofthe Moses Lake Municipal Code entitled"Major Subdivisions"is amendedasfollows: 17.17.040 Referrai to Other Departments,Agencles,and Offices: A.Upon receipt af a complete and satisfactorypreliminaryplat application,the Plat Administra- tor shalldistribute copies of the preliminaryplat to each of the following offices,depart- ments,or agencies withintwo (2)working days from receipt; 1.Public UtilityDistrict 2.Gas Company 3.Telephone Company 4.Engineering Division of the Municipal ServicesDepartment (threecopies) 5.Fire Department 6.Building and CommunityDevelopment Divisionsofthe Municipal ServicesDepartment 7.Grant County HealthDistrict 8.Any irrigationdistrictwithjurlsdiction 9.Grant CountyAssessor 10.CommunicationsCompany B.The Plat Administrator shall further notifythe Police Department,Park and RecreationDepartment,and GityManagerthat a preliminaryplat has been received. C.Noticeof the filing of a preliminaryplat of a proposed subdivisionlocated in the city and adjoiningthe municipalboundaries thereof shall be given to the Grant County PlanningDepartment. D.Notice of the filing of a preliminaryplatof a proposed subdivision located adjacent to theright-of-way of a state highway shall be givento the State Department of Highways. E.Each office,department,or agency shallfilewrittenrecommendations with the Plat Admini- strator within fifteen (15)calendar days from the date of filing of the preliminary plat andapplicationwiththePlatAdministrator.Ifanysuch office,department,oragency failstofile a writtenrecommendationwithinthe time limitation,itmay be presumed that such office,department,or agency has no recommendation. F.If the preliminaryplat is found to be unacceptable,a certifiedlettershall be mailedto thesubdividerwithinthetimelimitationsestablishedbyRCW58.17.140. G.The Plat Administrator may determine that a meeting shallbe held to resolve major issuesidentifiedasaresultoftherecommendationsofotheroffices,departments,or agencies.Such meeting shallbe attended by those offices,departments,or agencies responsible fortherecommendationsandmustincludetheapplicantandthePlatAdministrator.The pro-ceedings and results of the meetingshall be documented by minutes. 17.17.060 Planninq Commission Public Hearing:When the Plat Administratordetermines that thecompletedsubdivisionapplicationandpreliminaryplatisacceptable,the Plat Administrator shallsetadateforapublichearingbeforethePlanningCommission. 17.17.130 Final Major SubdivisionPlat Application: A.General Requirements: 1.The final major subdivisionapplicationand plat willbe filed withthe Plat AdministratoronformsprovidedbytheCommunityDevelopmentDIvlsionoftheMunicipalServicesDepartment. 2.Allrequired street and utilityimprovements mustbe constructed by the applicant andmustbeacceptedbythecityorasubdMaionbondorotherapprovedsecurityshallbesubmittedinanamountsufficienttocoveronehundredandfiftypercent(150%)ofthe ORD.1639/Page 2 estimated cost of completing all required utilityextensions and street improvements asdeterminedbytheMunicipalServicesDepartment.Upon completion of the required improvements and priorto acceptance by the Council,the subdivider/developer mustsubmitamaintenancebondoralternativesecurityapprovedbytheCityAitomeyinanamountdeterminedbytheCityEngineerandapprovedbytheMunicipalServices Director.The maintenancebond amount shall be one hundred percent (100%)ofthe actual cost of construction.An alternative security shall be in an amount not less than ten percent (10%)nor more than one hundred percent (100%)of the actual cost of construction.The amount shallbe determinedon a case by case basis based upontheGityEngineer's estimated cost of repair or maintenance should repair or maintenance be required.The subdivider/developer shall submit documentation of the cost of constructionto the CityEngineerforhisreviewand approvaland use in determiningthe requiredbond or alternativesecurityamount.Said bond shall be in effectfor one (1) year from the date of acceptance. 3.Required dedication of all streets,right-of-ways,parks,playgrounds,easements,reservations,Irrigation water right-of-ways,and any area to be dedicated to public use, togetherwith any restrictions or limitations thereon shall be submittedas a part of the final plat. 4.The application shall be accompanied by the following: a.A plat certificatefrom a title company licensed to do business in the State ofWashingtondatedwithinthirty(30)days of the date of filingof the final plat and appilcationwith the Plat Administrator confirmingthat the title of the lands asdescribedandshownontheplatisinthenameoftheownerssigningthesubdivi- sion plator instrument ofdedication. b.A certificate from the GrantCountyTreasurer Indicating that alltaxesand assess-ments on the property included in the final plat,subdivision,or dedication have been paid according to the provisionsof RCW 58.08.030 and RCW 58.10.040 as now enacted or hereafter amended. c.A certificatefrom the cityFinance Director indicating that there are no delinquent special assessments or lienson the propertyIncluded inthe final plat,subdivision, or dedication. d.Acheck payable to the city in the amount of one hundred fiftydollars ($150)to cover the cost of checking the finalplat. e.Allcovenants proposed to run with the land. 5.The final majorplat (twelvesets ofprints plusthe originaltracing and a reproducible mylar copy)shall include allitems in Section17.17.130 Band any additional information and modifications requested in the prelimînaryapproval.The final plat shall be prepared ina neat and legible manner in black permanent drawing Ink on high grade tracing clothor draftingfilm.Alldocuments,maps,and survey notes shallcontainthe name of the subdivision,the name(s)of the subdivider(s),the name ofthe registered land surveyor responsibleto the subdivider(s).The trimmedsize of the final platshall be eighteen inches (18")by twenty-fourinches (24")with a one and a halfInch(11/2") margin on the top or left margin and a one half Inch (1/2")border on the remaining three (3)margins.The final plat shall be recorded on two (2)or more sheets if the scale necessary to accommodatethe map on one (1)sheet would undulycongest the drawing. 6.The final major subdivisionplat shall be approved or disapproved within the time limitations as established by ROW58.17.140. 7.No final major subdivision plat may be approved unless the citymakes a writtenfinding of fact that the proposed subdivisionis in conformance with any applicable zoning ordinances,or other land use controls which may exist. 8.No finalmajor platshall be approved for any subdivisionwhlchlies in whole or In part inan irrigationdistrictorganized pursuant to ChapterRCW 87.03 unlessthere has been provided an irrigation water rightof-way pursuant to RCW 58.17.310 as now enacted or hereafter amended. B.SpecificRequirements: 1.The final plat shall clearlyshow the following information: a.The lines and names of allstreets or other publicways,parks,playgroundsand easements Intended to be dedicated for public use,or granted for use of inhabit- ants of the subdivision. ORD.1639/Page 3 b.The linesand names of allexistingor platted streets or other publicways,parks,playgroundsand easements adjacentto the finalplat,subdivision,or dedication,includingmunicipalboundaries,townshiplines,and section lines, c.The lengths and bearingsof allstraightlines,curve radii,arcs,and seml-tangentsofallcurves. d.Alldimensionsalongthe lines ofeach lot,withthe true bearings and also any other data necessary for the location ofany lot linesin thefield. e.Sultableprimarycontrolpoints,approvedby the CityEngineer or descriptionsandOtiestosuchcontrolpoints,to whichalldimensions,angles,bearings,and similardatagivenontheplatshallbereferred. f.The location ofall permanent monuments. g.The names ofall subdivisionsimmediatelyadjacent thereto. h.The date,true north point,scale,datum plane,and date of survey. i.The boundary ofthe tract,the courses and distances marked thereon,as deter-mined by a field survey made by a registered and qualifiedland surveyorof thestateandtoclosewithanallowableerrornottoexceedonefoot(1')in fivethousandfeet(5,000')and not toexceed one foot (1')intenthousandfeet (10,000')Inthe CentralBusiness District. j.The elevationsofall permanent monuments based on a datum plainapproved bytheCityEngineer. k.Avicinity sketch map of not more than fourhundred feet (400')to the inch.ExceptthattheCityEngineer,subject to a request prior to platsubmittal,may approve analternativevicinitymapscaleexceedingfourhundredfeet(400')to the Inch. I.Street names. m.Certificationby registeredland surveyorof accuracy of platand survey. n.Statementbyownerdedicatingstreets,right-of-ways,and anysites for publicuse. o.Locationand dimensionsofall irrigation water right-of-ways. p.Provide legal description of the plat boundaries. q.Provide blockand lot locations including dimensions and numberdesignations. 2.AIIlinear dimensions shallbe giveninfeet and decimals of a foot to the nearest hun-dredth. 3.The scale of the finalplatshall be notmore than one hundred feet (100')to the inch.Except that the CityEngineer,subject to a request priorto platsubmittal,mayapproveanalternativeplatmapscalenottoexceedonehundredfeet(100')to the inch. 4.Ifthe plat constitutes a replat,the lots,blocks,streets,etc.,ofthe originalplatshallbeshownbydottedlinesintheirproperpositionsinrelationtothenewarrangementoftheplat,the new plat beingso clearly shown in solidlines as to avoidambigulty, 5.The final platshall be accompanied by improvementplans and specificationsincludingutilities,streets,grades,and appurtenances as provided for in Section 17.17.120,Improvements. 6.The subdivider'sland surveyorshallset allrequired monumentsand shallstake all lot corners as shown on thefinalplatbefore the plat is submitted for finalapproval. 7.The final plat shall contain the legaldescription of the subdivision and the followingdedication,acknowledgment,and endorsementstatements shallappear inthe followingsequenceinblackpermanentinkeitherbyhandormechanicaldevice: Dedication Theownerofthe land described hereininfee simpleis andTheownerdeclaresthisplatanddedicatestothepublicforever,all streets,roads,alleys,easements orwhateverpublicpropertythereIsshownthereonforanyandallpublicpurposesnotinconsistentwiththeusesshownonthisplat. GrantCountyAuditor by Deputy Auditor 8.Submit all lot,block,and boundary closures to the CityEngineer with the final plat submittal. 17.17.140 FinalPlatReview Procedure: A.Upon receiptofthe final subdivision applicationand plat,the Plat Administrator shall,within two (2)working days of receipt,distribute copies to all offices,departments,and agencies receiving the preliminary plat.Each office,department,or agency shall file written recommendations withthe Plat Administrator within fifteen (15)days from the date of filing ORD.1639/Page 5 of the finalplatwiththe Plat Administrator.Ifany such office,department,or agencyfailstofileawrittenrecommendationwithinthetimelimitation,It may be presumed that suchoffice,department,or agency has no recommendation.AII offices,departments,andagenciesissulngrecommendationsforfinalplatapprovalshallnotmodifythetermsofpreliminaryplatrecommendationswithoutthewrittenconsentofthesubdivider. B.Within fifteen (15)days offilingofthe final plat the CityEngineer shall review the final platandsubmittothePlatAdministratorawrittenreportwithrespecttothefollowingconditions: 1.That the proposed finalplatbears the required certificatesand statements of approval. O 2.That a title report furnished by the subdividerconfirmsthe title of the land and theproposedsubdMslonisvestedinthenameoftheownerwhosesignatureappearsontheplatcertificate. 3.That the facilitiesand improvements requiredto be providedby the subdividerhavebeencompletedoralternativelythatthesubdividerhassubmittedwiththeproposedfinalplataperformancebondorothersecurityinconformancewithSection17.17.090 of this chapter. 4.That the platistechnicallycorrect as certifiedby the land surveyorresponsible for theplat. C.Withinfifteen(15)days of filln0of the final plat,the Grant County Health Districtor other agency furnishing sewage disposaland supplyingwatershallreviewthefinal platand submittothePlatAdministratorawrlttenreportrecommendingapprovalordisapprovalofthefinalplatastotheadequacyoftheproposedmeansofsewagedisposalandwatersupply. D.Withinfifteen (15)days of filingofthe final platthe appropriate Irrigation district servingorfromwhichtherealpropertyisentitledtobeservedwithirrigationwatershallreviewthefinalplatandsubmittothePlatAdministratorawrittenreportrecommendingapprovalordisapprovalofthefinalplatastotheadequacyoftheproposedmeansofthedeliveryofirrigationdistrictentitlementwaterandastotheadequacyoftheproposedmeansofremovalofirrigationwastewater. E.The Planning Commissionshall review the finalplat withinthe timelimitations establishedbyRCW58.17.140 forcompliancewithalltermsofthe preliminaryapprovalofthe proposedplatsubdivisionordedicationandshallrecommendtotheCityCouncilthatsaidplatbeapprovedordisapproved. F.CouncilAction: 1.The Councilshall,within thirty(30)days from the date of filing ofthe final subdivisionapplicationandplat,approveordisapprove thefinal plat unless the subdivider consentstoanextensionofsuchtimeperiodinwriting. 2.Ifthe Councilfindsthatthe subdMaionproposed forfinalplatapprovalconforms to alltermsofthepreliminaryplatapproval,the requirementsof ROWChapter 58.17,otherapplicablestatelaws,and anyother requirementswhichwere in effectat the time ofpreliminaryplatapproval,it shallapprove thefinalplat and by such action direct theCityManagertosigntheplat.
