AN ORDINANCEAMENDINGCHAPTER 13.04 OF THE MOSESLAKEMUNICIPALCODEENTITLED"SEWER REGULATIONS"
THECITYCOUNCIL OF THECITYOFMOSESLAKE,WASHINGTON DOORDAINASFOLLOWS:
Section 1.Chapter 13.04 ofthe Moses Lake Municipal Code entitled"SewerRegulations"is amended asfollows:
O 13.04.150 Installation and Connection to Toilet Facilities With Sewer:The owner of allhouses,buildings,
or propertles used for human occupancy,employment,recreation,or other purpose,situated
withinthe cityand abutting onany street or alleyin which thereis constructed and now located
or withintwo hundred feet (200')of any street or alley in whichthere is constructed and nowlocatedapublicsanitaryorcombinedsewerofthecity,is required at his expense to installsuitabletoiletfacilitiesthereinandtoconnectsuchfacilitiesdirectlywiththepropertypubilosewerinaccordancewiththeprovisionsofthischapterandaspermittedbyRCW35.24.290(4)
as nowineffector hereinafter amended,withinsix (6)months after the date of officlalnoticetodoso.Provided that the connectionshall not be required ifthe cost of making the connection,including the price of obtaininga private way of necessity as authorized byRCW8.24,exceedsfourthousanddollars($4,000).Determination of the cost of makingthe connection shall bemadebytheEngineeringDivisionoftheMunicipalServicesDepartmentoritssuccessorordesignee.Ifthe person required to make the connection disagrees with the finding of theEngineeringDivisionoftheMunicipalServicesDepartmentoritssuccessorordesignee,thepersoncanappealthedecisiontotheCouncilwithinten(10)days of the decision of theEngineeringDivisionoftheMunicipalServicesDepartmentoritssuccessorordesignee.ThedecisionoftheMosesLakeCityCouncilshallbefinal.Furthermore,ifa person is not requiredtomakeaconnectionbecauseofcost,at such time as the septic system falls,eitherthe tank
or thedrain field,the connection to the sewer system shall be requiredandmade.
Section 2.Thisordinance shalltake effectand be in force five (5)days afterits passage and publicationofitssummaryasprovidedbylaw.
