1652_00001ORDINANCE NO.1652 AN ORDINANCEORDERINGTHE IMPROVEMENTOF MONROE STREETBETWEENNELSONROADANDSHARONAVENUEBYCONSTRUCTINGANDINSTALLINGASANITARYSEWERSYSTEMANDCONNECTINGTHESANITARYSEWERSYSTEMTOTHEEXISTINGSANITARYSEWERINACCORDANCEWITHRESOLUTIONNO.1856 OF THE CITY COUNCIL OF THECITY OF MOSES LAKE,WASHINGTON AND ESTABLISHINGUTILITYLOCALIMPROVEMENTDISTRICTNO.6;PROVIDINGTHEMETHODOFAS-SESSMENT FOR IMPROVEMENTS MADE IN SAID DISTRICT;ASSESS-O MENTS UPON PROPERTY IN SAID DISTRICT;AND PROVIDING FOR PAYMENTOF SUCHASSESSMENTS INTO A BOND FUND TO PAY ANDSECURETHEPAYMENTOFWATERANDSEWERBONDSISSUEDFOR THECOSTS OF THE IMPROVEMENTS RECITALS: 1.Resolution No.1856 adopted October 11,1994 by the City Council of the City of Moses Lake, Washington,declared its intentiontoimprove a portionof MonroeStreet between Nelson RoadandSharonAvenuebyconstructingandinstallingasanitarysewersystemandconnectingthesanitary sewer system toexistingsanitary sewer and fixed November8,1994 at 7:00 p.m.in the CouncilChambersinthePolice/CourtFacility,Moses Lake,Washington,as thetimeand place forhearing allmatters relating tosaid improvements and allobjectionstheretoand for determiningthe methodofpaymentofsaidimprovements;and 2.The City Engineer's Officehas caused an estimate to be made of the costs and expense of theproposedimprovementsandhascertifiedsaidestimatetotheCityCouncil,togetherwith all papersandinformationinitspossessiontouchingtheproposedimprovements,a description of theboundariesoftheDistrict,a statement ofwhat portionof thecost and expense ofthe improvements should be bome by the propertywithinthe proposed District,a statement in detail of the localimprovementassessmentsoutstandingorunpaidagainstthepropertyintheproposedDistrictand a statement of the aggregate actual valuation of the real estate,including 25%of the actualvaluationoftheimprovementsintheproposedDistrict,according to thevaluationlast placed uponitforthepurposeofgeneraltaxation;and 0 3.Said estimate ip accompanied by a diagram of the proposed improvements showing thereon thelots,tracts,parcels of land,and other propertywhichwill be specificallybenefitted bythe proposedimprovements,and theestimated amount of thecost and expense thereof tobe borne by each lot,tract,and parcel of land or other property;and 4.Due notice of the hearing on Resolution No.1856 was given in the manner provided by law andsaidhearingwasheldbytheCityCouncilonNovember8,1994 and all written protests filed withtheCityCouncilonorbeforesaiddateweredulyconsidered;and 5.It has been further determined to be in the best interests of the city thatsaid improvements,ashereinafterdescribed,be carried out and that a utilitylocal improvement district be created inconnectiontherewith,NOW THEREFORE, THE CITY COUNCILOF THE CITY OF MOSES LAKE,WASHINGTON DOORDAIN AS FOLLOWS: Section 1.It is hereby ordered thatthefollowing improvementsin theCityof Moses Lake,Washington,and theconstruction,be carried out: The improvement of a portionof MonroeStreet between Nelson Road and Sharon Avenue byconstructingandinstallingasanitarysewersystemandconnectingthesanitarysewersystemtoexistingsanitarysewer. Allof theforegoing shall be in accordance with the plans and specificationstherefore prepared by the CityEngineer's Office. O Section 2.The estimated cost and expense comes to $75,050.AIIcosts and expenses of the improve-ment shall be bome by and assessed against theproperties specificallybenefited by such improvement Section 3.There is hereby created and established a local improvement district to be known as "UtilityLocalImprovementDistrictNo.6"(ULID #6)to include,as near as may be,all properties speciallybenefittedbytheimprovements,the territoryof whichis described as follows and includes the followingdescribedproperties: Tax #3803,Less Tax #'s in the NENW¼of Section 26,Township 19 North,Range 28 E.WMTax#9991,Less Tax #'s in the NENW¼of Section 26,Township 19 North,Range 28 E.WM Section 4.The nature of the improvements ordered by this ordinance to be made is such that the special benefits conferred upon the propertyin UtilityLocal Improvement District #6 are fairly reflected bythe useofaperlotmethodofassessment;and it is hereby providedand ordered thattheassessments shall be made against the property withinULID#6 in accordance withthe per lot method provided by statute. Section 5.AIIassessments leviedin ULID#6 shall be forthesole purpose of payment into a bond fund topay andsecure thepaymentof water and sewer bonds and local improvement district bonds issued for the cost of the improvements.All payments of such assessments,including all interest and penalties thereon,shall be paid directly into the construction fund or funds and applied to pay or secure the payment of debt service on water/sewer revenue bonds orlocal improvement districtbonds heretoforeor hereafter issued and payable from the construction fund orfunds withoutallocationtoany particularseries orissues of such bonds. Section 6.This ordinanceshall takeeffect and be in force five (5)days after its passage and publication as providedby law.
