AN ORDINANCE AMENDINGCHAPTER 17.13 OF THE MOSES LAKE MUNICI-PAL CODEENTITLED"SHORT SUBDIVISIONS"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 17.13 of the Moses Lake Mµnicipal Code entitled"ShortSubdivisions"is amended asfollows:
17.13.030 Preliminary Plat Conditions and Requirements:
A.General Conditionsand Requirements:
1.The subdivision shall make adequate provision for roads,streets,curbs,gutters,sidewalks,street lighting circuits,alleys,extension of municipal utilities(sewerandwater),drainage ways,irrigation water right-of-ways,other public ways or anymunicipalimprovementsasdeemednecessaryinconformancewithcityCommunityStreetandUtilityStandardsandcityDesignStandardsineffectatthetimeofplatapproval.
2.The subdivisionshall front on a existingstreet.There shall be adequate access toallparcels.Streets shall be improved tocitystandards.Street lighting shall be provided.
3.The subdivisionshall comply withallzoning and health regulations,
4.The subdivisionshall be consistent with the city's Comprehensive Plan.
5.Environmental information shall be prepared and submitted in accordance with theguidelinesestablishedundertheStateEnvironmentalPolicyActof1971,as amended.Said information is a part ofand must accompany the preliminary plat application.
6.The subdivision shall provide for irrigation water right-of-ways pursuant to RCW58.17.310 as now enacted or hereafter amended.
O 7.A street lighting plan as may be required by the CityEngineermust be provided.TheplanmustbeapprovedbytheGrantCountyPUDandincludecertificationthatallstreetlightingfeeshavebeenpaidorthatarrangementsacceptabletothecityandthePUDhavebeenmadeforthepaymentofrequiredfees.
8.The subdivision shall not have been previously dividedin a short subdivisionwithinthelastfive(5)years and will not be furtherdivided in any manner unless such proposedresubdivisioncomplieswithallprovisionsrelatingtomajorsubdivisionsineffectatthetimethefurthersubdivisioniscommenced.
9.Unless an applicant for a preliminary plat approval requests otherwise,and the PlatAdministratoragrees,a preliminary plat shall be processed simultaneouslywith theapplicationforrezones,variances,planned unitdevelopments,site plan approvals,andsimilarquasi-judicialor administrativeactions to the extent thatprocedural require-ments applicable to thoseactions permitsimultaneous processing.
10.Everydecision or recommendationmade under thischapter bytheCouncilor PlanningCommissionshallbeinwritingandshallincludefindingsoffactandconclusionstosupportthedecisionorrecommendation.
11.Preliminary plats of any proposed short subdivisionshall be approved,disapproved,
or returned tothe applicant for modification withinthetimelimitations established byRCW58.17.140.
12.In theevent thatthe shortsubdivisiondoes not border upon adjacent property towhich
O municipal utilities have been extended or upon adjacent property fronting uponimprovedstreets,the property ownermay request a variance tothe short subdivisionprovisionsformunicipalimprovementsasdeemednecessary.Inlieuof thecomple-tionof the extension of municipalutilities(sewerand water)and the completion ofstreetimprovements,a covenant totheland titlemay be created.Said covenant shallpledgethepropertyownertoinstallmunicipalimprovementsasdeemednecessaryatsuchtimeastheadjacentpropertyisimprovedbytheinstallationofmunicipalutilitiesand/or at such timeas the improvement of streets upon which theadjacent propertyisfrontingoccursasanysucheventisdeemedtooccurinthesolediscretionofthePlatAdministrator.Said covenantshall also pledgethepropertyownerto participateinanyfuturelocalimpovementdistrictsforsuchimprovements.
13.Atthediscretion of thePlat Administrator,therequirementthata preliminaryshortplat
be submitted may be waived.Subject to the approval of the Plat Administrator,ashortplatwithoutimprovementsmaybesubmittedasafinalplatforreviewandapproval.
14.Aplat certificate from a titlecompany licensed todo business intheState ofWashing-
tondated within thirty(30)days of the date of filing of the final plat and application
with the Plat Administrator confirming that the titleof the lands as described and
shown on the plat is in the name of the owners signing the subdivision plat orinstrumentofdedication.
B.Specific Conditionsand Requirements:
1.Prior to submission of a short subdivision preliminaryapplicationand preliminaryplat,
the subdivider or the subdivider's representative shall schedule a pre-application
conference with the Plat Administrator and representatives of other affected city
departments.The subdivider shall present a conceptual idea of the plat.The Plat
Administrator and representatives ofaffected citydepartments willrespond informally
and address potential items of concern to aid the subdividerin preparing the short
subdivision preliminary application and preliminary plat.
2.The preliminary short subdivision application and plat shall be filed with the Plat
Administrator on forms prescribed by the Community Development Division of theMunicipalServicesDepartmentTheapplicationshallbeaccompaniedbytwelve(12)
copies of thepreliminaryplat.At the discretion of the Plat Administrator,the require-
ment that twelve(12)copies of the preliminaryplat be submitted may be waived.
Processing of thepreliminaryplat may require fewer thantwelve(12)copies oftheplat.
3.The preliminaly plat shall be a neat and accurate drawing,stamped and signed by aregisteredprofessionallandsurveyorlicensedbytheStateofWashingtononrepro-ducible materialat a decimal scale.The plat map shall measure eighteen inches (18")by twenty-fourinches (24").The preliminaryplat shall be drawn in black permanent
ink on two(2)or more sheets if thescale necessary toaccommodatethemapon one(1)sheet would unduly congest the drawing.
4.A non-refundablefee offiftydollars($50)shallaccompany each and every application
for a preliminary short subdivisionwithout improvements.A non-refundable fee of
seventy dollars ($70)shalf accompany each and every application for a preliminary
short subdivisionwith improvements.
5.The preliminary plat shall contain the following:
a.Name of proposed subdivision.
b.Boundaries of proposed subdivision established by the preliminarysurvey,
c.Location and dimension of all existing and proposed streets,alleys,utilities and
right-of-ways and/or easements on and adjacent tothe proposed subdivision.
d.Location and dimensionsof all existing and proposed irrigation waterright-of-ways
on and adjacent to the proposed subdivision,
e.Legal description of land within the proposed subdivision.
f.Any proposed land dedications.
g.Name,address,and seal of the registered land surveyor who made theprelimi-
nary survey.
h.The date of the preliminary survey.Oi.Horizontal scale of the proposed plat shall be not more than one hundred feet
(100')tothe inch.Except thattheCity Engineer,subjectto a request priorto plat
submittal,mayapprove an alternative plat map scale nottoexceed one hundred
feet (100')tothe inch.
j.Monuments found and established during the preliminary survey.
k.Date map is prepared,scale,and noith pointof the map.Approximate proposed
lotlines with theirdimensions,including lot numbers and block numbers.

1)Locationand sizingofexistingand proposed utilitiesincludingwater,sewer,storm drains,electricity,street lighting,and gas,telephone,cablevisionlines,and curb and sidewalk.Minimum size and scale shall be the same as thepreliminaryplatmap.
2)Existing and proposed structures and natural features and all proposedimprovementswithinandadjoiningtheproposedsubdivision.
3)Topography ofthe area with a maximum oftwofoot(2')intervals of contours
as required by theCity Engineer.
4)Present zoning classificationon and adjacent to property.
5)Any proposed dedications for park land subject to the approval of the Plan-ningCommission.
6)Name(s)of owner(s)of the proposed subdivision.
q.Any deed restrictionsor covenants existingorproposed shall be drawn on thesiteplanandpreliminaryplatmap.
17.17.120 Improvements:
A.Following approval of the preliminary plat by the Council,the applicantshall file withthePlatAdministrator,three(3)complete sets ofpreliminaryconstructionplans and specifica-tionsprepared by a professional engineer licensed by the State of Washington showingallstreetandutilityimprovementsasrequiredbytheCouncilingrantingapprovalofthepreliminaryplat.The construction plans and specifications shall be accompanied by aminimumplancheckfeeaspertheratescheduleestablishedbytheCityEngineer.AIIconstructionplansandspecificationsshallbeinconformancewithcityDesignStandardsandtheCommunityStreetandUtilityStandards.Sheet size shall be twenty-fourinches(24")by thirty-sixinches (36")and shall have a border of one inch (1")on the left marginandonehalfinch(1/2")on the remaining three margins.The scale shall be five feet (5')vertically and fortyfeet (40')horizontally.
O B.The preliminary construction plans and specifications shall be forwarded to the CityEngineerwithintwo(2)working days of receipt by the Plat Administrator.Within twenty(20)days of filing ofthe plans withthe Plat AdministratortheCityEngineer shall approve,conditionally approve,or disapprove theplans.The subdividershallsubmitone (1)set ofpermanentreproduciblemylarandthree(3)sets of specifications which have beenapprovedfortheCityEngineer's signature,records,and use.
C.After the City Engineer has approved the construction plans and specifications,thesubdividershallcompleteandinstallallstreetandutilityimprovementsrequiredbytheCouncilingrantingpreliminaryplatapprovalpriortofilingofthefinalplat.A one (1)yearmaintenancebondshallberequiredintheamountofonehundredpercent(100%)of theconstructioncost.
D.The EngineeringDivisionofthe Municipal Services Departmentor a licensed professionalengineerorengineeringfirmhiredbythecityshallberesponsiblefortheinspectionofallsubdivisionimprovementstoinsureconformancewiththeapprovedplansandspecifica-tions.The subdivider shall deposit an inspection fee in the amount of two and a halfpercent(21/2%)oftheestimated construction cost.The inspection fee shall be based ontheactualcostoflabor,materials,and equipment plus fifteenpercent (15%)foroverhead.If thefinal cost is less thantheamount deposited,the difference will be refunded.
E.In lieu ofcompleting and installing all required street and utilityimprovements prior tofilingofthefinalplatwiththePlatAdministrator,the subdivider may post a subdivisionbond orotherapprovedsecurityinaformsatisfactorytotheCityAttorney.The subdivisionbondorapprovedsecurityshallbeinanamountequaltoonehundredfiftypercent(150%)oftheestimatedcostasdeterminedbytheMunicipalServicesDirector,of such improve-ments required by the Councilin granting approval of the preliminary plat.In the eventthatallstreetandutilityimprovementsarenotcompletedwithinthetimelimitspecifiedinthesubdivisionbondorapprovedsecurity,the bond or security may be forfeited and thecitymayundertaketheinstallationandcompletionofallrequiredstreetandutilityimprove-ments.
1.All street and utilityimprovements listed in the subdivisionbond must be installed,completed,and accepted by the citywithin two(2)years of Councilapproval of thefinalplat.

2.The Councilmay grant one (1)extension of the subdivision bond or security for aperiodnottoexceedtwo(2)years providedthatthe request foran extension is filedwiththePlatAdministratoratleastsixty(60)days prior to the expiration date of thebondorsecurity.
3.In the event that a time extension is granted,a new subdivision bond or other
approved securityshall be submittedin an amountsufficienttocover one hundred andfiftypercent(150%)of the cost of completing utility extensions and street improve-
ments.The bond willbe updated with new estimates of cost on all uncompleted
improvements and all increased cost estimates shall be passed onto the bond.If
these increased costs are not accepted by thesurety,thenthe city shall forecloseonthebondandtheplatwillbeheldinabeyance.Departments issuing recommenda-
tionsfor new subdivisionbonds or other approved securityshall notmodifythe termsandrequirementsofthebondorsecurityotherthantopassonallincreasedcostestimatesasdeterminedbytheMunicipalServicesDirectortothebondorsecurityto
cover the cost of completing utility extensions and street improvements withoutthewrittenconsentoftheapplicant.
F.A certificateof occupancy for permitted construction shall not be issued priortocomplyingwiththefollowingrequirements:
1.Street and utilityimprovements have been constructed to Community Standards and
accepted by theCityCouncil,
2.The final major plat has been recorded with theGrant County Auditor.
3.Upon finalinspection thatthebuilding or structure complieswith theprovisions of theUniformBuildingCode.
17.17.140 Final Plat Review Procedure:
A.Upon receipt ofthefinal subdivision applicationand plat,thePlat Administrator shall,within
two(2)working days of receipt,distributecopies to all offices,departments,and agencies
receiving the preliminary plat Each office,department,or agency shall file written
recommendationswiththe Plat Administrator withinfifteen (15)days fromthedate offiling
ofthefinal plat withthePlat Administrator.Ifany such office,department,or agency fails
to filea writtenrecommendationwithin thetimelimitation,it may be presumed thatsuch
office,department,or agency has no recommendation.All offices,departments,and
agencies issuing recommendations for final plat approval shall not modify the termsof
preliminary plat recommendationswithoutthe written consent of the subdivider.
B.Within fifteen (15)days offilingof the final plat the City Engineer shall review thefinal plat
and submit to the Plat Administrator a written report with respect to the following condi-
tions:
1.That theproposed final plat bears therequired certificatesand statements ofapproval.
2.That a titlereport furnished by the subdivider confirms the titleof the land and the
proposed subdivisionis vested in thename of the owner whose signature appears ontheplatcertificate.
3.That the facilities and improvements required to be provided by the subdivider have
been completed or altemativelythatthe subdividerhas submittedwith the proposed
final plat a performance bond or other security in conformance with Section 17.17.090
of thischapter,
4.That theplat is technicallycorrect as certified by the land surveyorresponsible for the
plat.
C.Within fifteen(15)days of filing of the final plat,theGrant County Health Districtor other
agency furnishing sewage disposal and supplying water shall review the final plat and
submittothe Plat Administrator a written report recommendingapprovalor disapprovalof
the final plat as to the adequacy of the proposed means of sewage disposal and water
supply.
D.Within fifteen (15)days of filing of the final plat the appropriateirrigation district serving or
from whichthe real propertyis entitled to be served withirrigation watershall review the
final plat and submit to the Plat Administrator a written report recommending approvalordisapprovalofthefinalplatastotheadequacyoftheproposedmeansofthedeliveryof
irrigation district entitlement water and as to the adequacy of the proposed means of
removalof irrigation waste water.

E.The Planning Commission shall reviewthe finalplatwithin the time limitations establishedbyRCW58.17.140 for compliance with all terms of the preliminaryapproval of theproposedplatsubdivisionordedicationandshallrecommendtotheCityCouncilthatsaidplatbeapprovedordisapproved.
F.CouncilAction:
1.The Councilshall,within thirty(30)days from thedate of filing of thefinalsubdivisionapplicationandplat,approve or disapprove the final plat unless the subdividerconsentstoanextensionofsuchtimeperiodinwriting.
2.Ifthe Council finds thatthesubdivision proposed for final plat approval conforms toalltermsofthepreliminaryplatapproval,the requirements of RCWChapter 58.17,other applicable state laws,and any other requirements whichwere in effect at thetimeofpreliminaryplatapproval,it shall approve the final plat and by such actiondirecttheCityManagertosigntheplat
G.A certificateof occupancy shall not be issued untilthe final major plat has been recordedwiththeGrantCountyAuditor.
Section 2.This ordinance shall takeeffectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
