AN ORDINANCE AMENDINGCHAPTER 17.17 OF THE MOSES LAKE MUNICI-
PAL CODE ENTITLED "MAJOR SUBDIVISIONS"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 17.17 of the Moses Lake Municipal Code entitled "Major Subdivisions"is amended
as follows:
17.17.030 Preliminary Plat Conditionsand Requirements:
A.General Conditionsand Requirements:
1.The subdivision shall make adequate provisionfor roads,streets,curbs,gutters,
sidewalks,street lighting circuits,alleys,theextension of municipalutilities (sewerand
water),irrigation water right-of-ways,drainage ways,other publicways,public access,orany municipalimprovements as deemed necessary in conformancewith CommunityStreetandUtilityStandardsandcityDesignStandardsineffectatthetimeofplatapproval.
2.The subdivision shall fronton a existingstreet.There shall be adequate access to allparcels.Streets shall be improved tocity standards.Street lighting shall be provided.
3.The subdivision shall complywithall zoning and health regulations.
4.The subdivision shall be consistent with the city's Comprehensive Plan.
5.The subdivision shall provide for irrigation water right-of-ways pursuant to RCW58.17.310 as now enacted or hereafter amended.
6.A street lighting plan as may be requiredby the City Engineer must be provided.TheplanmustbeapprovedbytheGrantCountyPUDandincludecertificationthatallstreetlightingfeeshavebeenpaidorthatarrangementsacceptabletothecityandthePUDhavebeenmadeforthepaymentoftherequiredfees.
7.Environmentalinformation shall be prepared and submitted in accordance with theguidelinesestablishedundertheStateEnvironmentalPolicyActof1971,as amended.Said informationis a part of and mustaccompany the preliminaryplat application.
8.Unless an applicant for a preliminary plat approval requests otherwise,and the Plat
Administrator agrees,a preliminaryplat shall be processed simultaneously with theapplicationforrezones,variances,planned unit developments,site plan approvals,andsimilarquasi-judicial or administrativeactions to the extent that procedural require-
ments applicable totheseactions permitsimultaneous processing.
9.Every decision orrecommendationmade under thischapter bytheCouncil or PlanningCommissionshallbeinwritingandshallincludefindingsoffactandconclusionstosupportthedecisionorrecommendation.
10.Preliminaryplats of any proposed subdivision and dedication shall be approved,disapproved,or returned totheapplicant for modification within ninety(90)days fromthedateoffilingunlesstheapplicantconsentstoanextensionofsuchtimeperiod;Provided,thatif an EnvironmentalImpact Statement is requiredas provided in RCW43.21C.030,theninety(90)day period shallnot include thetimespent preparingandcirculatingtheEnvironmentalImpactStatementbythelocalgovernmentalagency.
11.Aplat certificate froma titlecompanylicensed todo business intheState of Washing-tondated within thirty(30)days of the date of filingof the final plat and applicationwiththePlatAdministratorconfirmingthatthetitleofthelandsasdescribedandOshownontheplatisinthenameoftheownerssigningthesubdivisionplatorinstrumentofdedication.
B.Specific Conditions and Requirements:
1.Prior tosubmissionofa majorsubdivision preliminary application and preliminary plat,the subdivider or the subdivider's representative shall schedule a pre-applicationconferencewiththePlatAdministratorandrepresentativesofotheraffectedcitydepartments.The subdivider shall present a conceptual idea of the plat.The PlatAdministratorandrepresentativesofaffectedcitydepartmentswillrespondinformallyandaddresspotentialitemsofconcernorclarificationtoaidthesubdividerinprepar-ingthe majorsubdivisionpreliminaryapplicationand preliminaryplat.

2.The preliminary major subdivisionapplication and plat shall be filed with the Plat
Administrator on forms prescribed by the Community Development Division of theMunicipalServicesDepartment.Said application shall be accompanied by twelve(12)copies of the preliminary plat.
3.The preliminaryplat shall be a neat and accurate drawing,stamped and signed by aregisteredprofessionallandsurveyorlicensedbytheStateofWashingtononrepro-duciblematerialat a decimal scale.The platmap shall measure eighteen inches (18")by twenty-fourinches (24").The preliminary plat shall be drawn in black permanentinkontwo(2)or more sheets ifthe scale necessary toaccommodate themap on one(1)sheet wouldundulycongest the drawing.
4.A non-refundablefee of one hundred thirtydollars ($130)shallaccompany each and
every application for a preliminary major subdivision.
5.The subdividershall submit a list of the names and addresses ofall owners of record
of property within three hundred feet (300')of the external boundaries of the proposed
subdivision.In addition,the subdivider shall submit a list ofthenames and addresses
ofallowners ofrecordofreal property withinthreehundred feet (300')of real property
which lies adjacent to the external boundaries of the proposed subdivision and is
owned by the subdivider.
6.The preliminary plat shall contain the following:
a.Name of proposed subdivision.
b.Boundaries of proposed subdivisionestablished by thepreliminary survey.
c.Location and dimension ofall existingand proposed streets,alleys,utilities,and
right-of-waysand/or easements on and adjacent tothe proposed subdivision.
d.Location and dimensions ofallexistingand proposed irrigationwater right-of-ways
on and adjacent to the proposed subdivision.
e.Legal description of land within the proposed subdivision.
f.Any proposed land dedications.
g.Name,address,and seal of the registered land surveyor who made the prelimi-
nary survey.
h.The date ofthe preliminarysurvey.
i.Horizontal scale of the proposed plat shall be no more than one hundred feet
(100')totheinch.ExceptthattheCity Engineer,subject toa request prior toplat
submittal,may approve an alternativeplat map scale not to exceed one hundred
feet (100')tothe inch.
j.Monuments found and established during thepreliminary survey.
k.Date map is prepared,scale,and north pointof the map.Approximate proposed
lot lines with theirdimensions,including lot numbers and block numbers.
l.Ifany of the parcels can be further divided or if onlya portionof a tractis being
divided,location of future streets,alleys,and lot lines shall be shown by dotted
lines.
m.A vicinitymap at a scale of not more thanfour hundred feet (400')to the inch.
Except that the CityEngineer,subject to a request prior to plat submittal,mayapproveanalternativevicinitymapscaleexceedingfourhundredfeet(400')tothe
inch.The vicinity map shall show all adjacent parcels.It shall show how the
streets and alleys in the proposed subdivisionmay connect with existing and
proposed streets and alleys in neighboringsubdivisions or unplatted property to
produce an advantageous development of the entire neighborhood.
n.Provide recommended street names for approval.
o.United States Bureau of Reclamation horizontal and verticaldata including bench
marks.
p.A site plan on a separate sheet showingthefollowing information:

I.If any of the parcels can be further divided or if only a portionof a tractis beingdivided,location of future streets,alleys,and lot lines shall be shown by dottedlines.
m.A vîcinity map at a scale of not more thanfour hundred feet (400')to the inch.Except thatthe City Engineer,subject to a request prior to plat submittal,mayapproveanalternativevicinitymapscaleexceedingfourhundredfeet(400')totheinch.The vicinity map shall show all adjacent parcels.It shall show how thestreetsandalleysintheproposedsubdivisionmayconnectwithexistingandproposedstreetsandalleysinneighboringsubdivisionsorunplattedpropertytoproduceanadvantageousdevelopmentoftheentireneighborhood.
n.Provide recommendedstreet names for approval.
o.United States Bureau ofReclamation horizontal and verticaldata includingbenchmarks.
p.A site plan on a separate sheet showing thefollowing information:
1)Locationand sizingof existingand proposed utilitiesincluding water,sewer,stormdrains,electricity,gas,street lighting,curbs and sidewalks,telephone,and cablevision lines.Minimumsize and scale shall be the same as thepreliminaryplatmap.
2)Existing and proposed structuresand natural features and all proposedimprovementswithinandadjoiningtheproposedsubdivision.
3)Topography of thearea with a maximumoftwo foot (2')intervals of contoursasrequiredbytheCityEngineer.
4)Present zoningclassification on and adjacent to property.
5)Any proposed dedications for park land subject to theapproval of the Plan-ning Commission.
O 6)Any deed restrictionsor covenants existingor proposed shall be drawn on thesiteplanandpreliminaryplatmap.
17.13.100 Improvements:
A.Following approvalofthepreliminary plat by the Plat Administrator,theapplicant shall filewiththePlatAdministrator,three(3)complete sets of preliminary constructionplans andspecificationspreparedbyaprofessionalengineerlicensedbytheStateofWashingtonshowingallstreetandutilityimprovementsasrequiredbythePlatAdministratoringrantingapprovalofthepreliminaryplat.The construction plans and specifications shall beaccompaniedbyaminimumplancheckfeeaspertheratescheduleestablishedbytheCityEngineer.Allconstruction plans andspecificationsshall be inconformancewithcityDesignStandardsandtheCommunityStreetandUtilityStandards.Sheet size shall betwenty-fourinches (24")x thirty-sixinches (36")and shall have a border of one inch (1")ontheleft marginand one halfinch (1/2")on theremaining threemargins.The scale shallbefivefeet(6')vertically unless grades exceed ten percent (10%)and forty feet (40')horizontally.
B.The preliminary construction plans and specifications shall be forwarded to the CityEngineerwithintwo(2)working days of receipt by the Plat Administrator.Within twenty(20)calendar days offilingofthe plans withthe Plat Administrator the CityEngineershallapprove,conditionallyapprove,or disapprove the plans.The subdivider shall submitone(1)set of permanent reproduciblemylarand three(3)sets of specificationswhich havebeenapprovedfortheCityEngineer's signature,records,and use.
C.After the City Engineer has approved the construction plans and specifications,thesubdividershallcompleteandinstallallstreetandutilityimprovementsrequiredbythePlatAdministratoringrantingpreliminaryplatapprovalpriortofilingofthefinalplat.A one (1)year maintenance bond shall be required in the amount of one hundred percent (100%)of theconstructioncost
D.The Engineering Division of theMunicipalServices Departmentor a licensed professionalengineerorengineeringfirmhiredbythecityshallberesponsiblefortheinspectionofallsubdivisionimprovementstoinsureconformancewiththeapprovedplansandspecifica-tions.The subdivider shall deposit an inspection fee in the amount of twoand a halfpercent(21/2%)oftheestimated constructioncost The inspectionfee shall be based ontheactualcostoflabor,materials,and equipment plus fifteenpercent (15%)for overhead.Ifthe finalcost is less thantheamount deposited,thedifference willbe refunded.

E.In lieu ofcompleting and installing all requiredstreet and utilityimprovements priorto filing
of thefinalplat with the Plat Administrator,the subdividermaypost a subdivisionbond or
other approved security in a form satisfactoryto the City Attorney.The subdivisionbond
or approved security shall be in an amount equal to one hundred fifty percent (150%)of
the estimated cost as determined by the Municipal Services Director,of such improve-
ments requiredbythe Plat Administrator in grantingapproval of the preliminaryplat.Inthe
event that all street and utility improvements are not completed within the time limit
specifiedin the subdivisionbond or approved security,the bond or security may be for-
feited and the citymayundertake the installationand completion of all required street and
utilityimprovements.
1.All street and utilityimprovements listed in the subdivisionbond must be installed,
completed,and accepted by the city within one (1)year of approval ofthe final plat
by the Plat Administrator.
2.The Plat Administrator may grant one (1)extension of the subdivision bond for a
period not to exceed one (1)year provided thatsaid request for an extension is filed
with thePlat Administrator at least sixty(60)calendar days prior totheexpiration date
of the bond.
3.In the event that a time extension is granted,a new subdivision bond or other
approvedsecurity shall be submitted inan amount sufficientto cover one hundred and
fifty percent (150%)of the cost of completing utility extensions and street improve-
ments.The bond willbe updated with new estimates of cost on all uncompleted
improvements and all increased cost estimates shall be passed onto the bond.If
these increased costs are not accepted by thesurety,then the cityshall foreclose on
the bond and the platwillbe held in abeyance.Departments issuing recommenda-
tionsfor new subdivision bonds or other approved securityshall notmodifythe terms
and requirements of the bond or security other than to pass on affincreased cost
estimates as determined by theMunicipalServices Director to thebond or securityto
cover the cost of completing utility extensions and street improvements without the
writtenconsent of theapplicant.
F.A certificateof occupancy for permittedconstructionshall notbe issued priorto complying
withthe following requirements:
1.Street and utilityimprovements have been constructed to Community Standards and
accepted by the CityCouncil.
2.The final short plat has been recorded with the Grant County Auditor.
3.Upon finalinspection thatthe building or structure complieswith the provisions of the
Uniform Building Code.
17.13.120 Final Plat Review Procedure:
A.Uponreceipt of thefinalsubdivisionapplicationand plat,the Plat Administrator shall,within
two (2)workingdays of receipt,distribute copies to all offices,departments,and agencies
receiving the preliminaryplat Each office,department,or agency shall file written
recommendations with the Plat Administratorwithin fifteen (15)calendar days from the
date of filing of thefinal plat with the PlatAdministrator.Ifany such office,department,or
agency fails tofile a written recommendationwithinthetimelimitation,it maybe presumed
that such office,department,or agency has no recommendation.
AIIoffices,departments,and agencies issuing recommendations for final plat approval
shall not modifythe terms ofpreliminaryplat recommendations without the written consent
of the subdivider.
B.Withinfifteen (15)days of filingof thefinalplattheCityEngineershall review thefinal plat
and submit to the Plat Administrator a written report withrespect tothe following condi-
tions:O1.That the proposed final plat bears the requiredcertificatesand statements of approval.
2.That a titlereport furnished by the subdivider confirmsthe title of the land and the
proposed subdivisionis vested in the name of theownerwhose signature appears on
the plat certificate.
3.That thefacilities and improvements required to be provided by the subdivider have
been completed or alternativelythat thesubdividerhas submittedwith the proposed
final plat a performancebond orothersecurity in conformancewith Section 17.13.100
of thischapter.

4.That theplat is technicallycorrect as certifiedby the land surveyor responsible for theplat.
C.Withinfifteen (15)days of filing of the final plat,theGrant County Health District orother
agency fumishing sewage disposal and supplyingwater shall reviewthe final plat andsubmittothePlatAdministratorawrittenreportrecommendingapprovalordisapprovalofthefinalplatastotheadequacyoftheproposedmeansofsewagedisposalandwatersupply.
D.Withinfifteen (15)days offilingof thefinal platthe appropriateirrigationdistrict seNing orOfromwhichtherealpropertyisentitledtobeservedwithirrigationwatershallreviewthefinalplatandsubmittothePlatAdministratorawrittenreportrecommendingapprovalordisapprovalofthefinalplatastotheadequacyoftheproposedmeansofthedeliveryofirrigationdistrictentitlementwaterandastotheadequacyoftheproposedmeansofremovalofirrigationwastewater.
E.Final Plat Approval:
1.The Plat Administratorshall approve or disapprove the final plat within the timelimitationsestablishedbyRCW58.17.140,unless the subdivider consents to anextensionofthattimeperiodinwriting.
2.If the Plat Administrator finds thatthe subdivision proposed for final plat approvalconformstoalltermsofthepreliminaryplatapproval,the requirements of RCWChapter58.17,other applicablestate laws,and any other requirements,the PlatAdministratorshallapprovethefinalplat.
3.The decision of the Plat Administrator shall be final,unless an appeal by any ag-grieved party is made tothe Planning Commission within ten (10)days of thedate ofdecisionofthePlatAdministrator.Said appeal shall be in writing to the PlanningCommissionandsubmittedthroughtheCommunityDevelopmentDivision.The Com-munityDevelopment Divisionshall date and record the receipt of said appeal.ThePlanningCommissionshallactonthatappealwithinforty(40)calendar days unless
an extension is agreed to in writingby the applicant.The decision of the PlanningCommissionshallbefinalandconclusiveunless,withinten (10)days,any aggrieved
O party files with the City Clerk a written appeal.The Council shall hear thatappealwithintwenty(20)days of thedate of appeal.
4.A certificate of occupancy shall not be issued untilthe final short plat has beenrecordedwiththeGrantCountyAuditor.
Section 2.Thisordinanceshall takeeffect and be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
