AN ORDINANCE APPROVINGAND CONFIRMINGTHE ASSESSMENTSANDASSESSMENTROLLOFUTILITYLOCALIMPROVEMENTDISTRICTNO.5WHICHHASBEENCREATEDANDESTABLISHEDFORTHEPURPOSEOF
PAYINGTHE COST OF CONSTRUCTING AND INSTALLING A SANITARYSEWERSYSTEMANDCONNECTINGTHESANITARYSEWERSYSTEMTOEXISTINGSANITARYSEWERINTHEPAXSONDRIVEAREAASPROVIDEDBYORDINANCE1615ANDLEVYINGANDASSESSINGTHEAMOUNTTHEREOF
AGAINST THE SEVERAL LOTS,TRACTS,PARCELS OF LAND,AND OTHERPROPERTYSHOWNONSAIDROLL
WHEREAS,the assessment roll levying the special assessments against properties located in Utility LocalImprovementDistrictNo.5 in the Cityof Moses Lake,Washington,created under Ordinance No.1615 hasbeenfiledwiththeCityClerkoftheCityofMosesLakeasprovidedbylaw;and
WHEREAS,noticeofthetimeand place ofhearing thereofand of making objections and protests to said rollwasdulypublishedatandforthetimeandinthemannerprovidedbylaw,fixing thetimeand placeof hearinghereonforJanuary10,1995 at 7:30 p.m.in the CouncilChambers in thePolice/CourtFacility,Moses Lake,Washington,and further notice thereofwas duly mailed by the City Clerkto each propertyowner shown onsaidroll;and
WHEREAS,at the timeand place fixed and designated in said notice the hearing was duly held and allprotestsmadeinwritingwerereadandsubmittedtotheCityCouncilandwerebyitoverruled,
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DOORDAIN AS FOLLOWS:
Section 1.That the assessments and assessment rollof UtilityLocalImprovement District No.5 whichhasbeencreatedandestablishedforthepurposeofconstructingandinstallingasanitarysewersystem,sewersidelaterals,and appurtenances whichconnects toexisting sanitarysewer system andconnectingthesanitarysewersystemtoexistingsanitarysewerinthePaxsonDriveareaasprovidedbyOrdinance1615asthesamenowstands,be and thesame as hereby in allthingsand respects approved and confirmed.
Section 2.That each of the lots,tracts,parcels of land and other property shown upon thesaid rollis herebydeterminedanddeclaredtobespeciallybenefitedbysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameisinproportiontotheseveralassessmentsOappearinguponsaidroll.There is hereby levied and assessed against each lot,tract,parcel of land and otherpropertyappearinguponsaidrolltheamountfinallychargedagainstthesamethereon.
Section 3.That theassessment rollas approved and confirmedshall be filedwiththeTreasurer of the CityofMosesLakeforcollectionandthatsaidCityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollisinhishandsforcollectionandthatpaymentofanyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)days fromthe date ofthefirstpublicationofsaidnoticewithoutpenalty,interest,or cost,and that hereafter the sum remainingunpaidmaybepaidin10equalannualinstallmentswithinterestthereonfixedattherateof6.2%per annum.The first installment ofassessments on said assessment rollshall be come due and payableduring the30-dayperiodsucceedingthedateoneyearafterthedateoffirstpublicationbytheCityTreasurerofnoticethattheassessmentrollisinhishandsforcollectionandannuallythereaftereachsucceedinginstallmentshallbecomedueandpayableinlikemanner.
Ifthe whole or any portionof the assessment remains unpaid after thefirst 30-day period,interest upon thewholeunpaidsumshallbechargedatarateof6.2%per annum and each year thereafterone of saidinstallments,togetherwithinterest due on the wholeofthe unpaidbalance,shall be collected.Any installmentnotpaidpriortotheexpirationofthesaid30-day period during whichsuch installment is due and payable shallthereuponbecomedelinquent.Alldelinquentinstallments shall be subject to a charge for interest at the rateabovereferenced,and a penalty as set by Moses Lake Municipal Code 3.50.020.The collection of suchdelinquentinstallmentsshallbeenforcedinthemannerprovidedbylaw.
Section 4.This ordinance shall take effect and be in force five (5)days after its passage and publication asprovidedbylaw.
