AN ORDINANCE APPROVING AND CONFIRMING THE ASSESSMENTS ANDASSESSMENTROLLOFLOCALIMPROVEMENTDISTRICTNO.57 WHICH HASBEENCREATEDANDESTABLISHEDFORTHEPURPOSEOFPAYINGTHECOSTOFUNDERGROUNDINGELECTRICALUTILITIESALONGCRESTVIEWDRIVEASPROVIDEDBYORDINANCE1615ANDLEVYlNGANDASSESSINGTHEAMOUNTTHEREOFAGAINSTTHESEVERALLOTS,TRACTS,PARCELS
OF LAND,ANDOTHER PROPERTY SHOWN ONSAID ROLL
WHEREAS,the assessment roll levying the special assessments against properties located in LocalimprovementDistrictNo.57 in theCity of Moses Lake,Washington,created under Ordinance No.1615 hasbeenfiledwiththeCityClerkoftheCityofMosesLakeasprovidedbylaw;and
WHEREAS,notice of the timeand place of hearing thereofand of makingobjections and protests tosaid rollwasdulypublishedatandforthetimeandinthemannerprovidedbylaw,fixing thetimeand place of hearinghereonforJanuary10,1995 at 7:30 p.m.in the Council Chambers in the Police/Court Facility,Moses Lake,Washington,and further notice thereofwas duly mailed by the City Clerk to each propertyownershown onsaidroll;and
WHEREAS,at the time and place fixed and designated in said notice the hearing was duly held and allprotestsmadeinwritingwerereadandsubmittedtotheCityCouncilandwerebyitoverruled.
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.That the assessments and assessment roll of Local improvement District No.57 which has beencreatedandestablishedforthepurposeofundergroundingelectricalutilitiesalongCrestviewDriveasprovidedbyOrdinance1615asthesamenowstands,be and the same as hereby in all thingsand respects approvedandconfirmed.
Section 2.That each ofthe lots,tracts,parcels of land and other property shown upon thesaid roll is herebydeterminedanddeclaredtobespeciallybenefitedbysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameisinproportiontotheseveralassessmentsappearinguponsaidroll.There is hereby levied and assessed against each lot,tract,parcelof land and otherpropertyappearinguponsaidrolltheamountfinallychargedagainstthesamethereon.
Section 3.That the assessment roll as approved and confirmedshall be filed withthe Treasurer of the CityofMosesLakeforcollectionandthatsaidCityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollisinhishandsforcollectionandthatpaymentofanyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)days from the date ofthefirstpublicationofsaidnoticewithoutpenalty,interest,or cost,and that hereafter the sum remainingunpaidmaybepaidin10equalannualinstallmentswithinterestthereonfixedattherateof6.9%per annum.The first installment of assessments on said assessment rollshall be comedue and payableduring the30-dayperiodsucceedingthedateoneyearafterthedateoffirstpublicationbytheCityTreasurerofnoticethattheassessmentrollisinhishandsforcollectionandannuallythereaftereachsucceedinginstallmentshallbecomedueandpayableinlikemanner,
ifthewhole or any portionof theassessment remains unpaidafterthefirst 30-day period,interest upon thewholeunpaidsumshallbechargedatarateof6.9%per annum and each year thereafterone of saidinstallments,togetherwith interest due on thewhole oftheunpaid balance,shall be collected.Any installmentnotpaidpriortotheexpirationofthesaid30-day period during which such installment is due and payableshallthereuponbecomedelinquentAlldelinquentinstallmentsshallbesubjecttoachargeforinterestattherateabovereferenced,and a penalty as set by Moses Lake Municipal Code 3.50.020.The collectionof suchdelinquentinstallmentsshallbeenforcedinthemannerprovidedbylaw.
Section 4.This ordinance shall takeeffectand be in force five (5)days after its passage and publication asprovidedbylaw.
