AN ORDINANCE AMENDINGCHAPTER 16.12 OF THE MOSES LAKEMUNICI-PAL CODEENTITLED "BUILDINGPERMITS"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 16.12 of theMoses Lake MunicipalCode entitled "Building Permits"is amended asfollows:
16.12.010 Issuance -Appeal:
A.The Building Officialhas authorityto issue building permits.
B.The Planning Commissionshallhear and rule upon all complaints and appeals from rulingsoftheBuildingOfficialandthePlanningCommissionmayprescribesuitablerulesandregulationsforthepresentmentoftheappeals;provided,however,the Planning Com-mission may delegate the hearing of complaintsand appeals to a board of review andadjustmentconsistingofmembersofthePlanningCommission.
16.12.020 Unplatted Areas:Building permits shall be issued in unplatted areas,only in the followingcases:
A.The building permitapplied for shall involve onlythefollowing:
1.Remodeling of an existing,conformingbuilding;
2.Construction of a temporarystructure.
3.Construction of a fence
B.When a new subdivisionis planned,thedeveloper may acquire building permits for anyproposedbuildingsonthesubdivisionaftercomplyingwiththefollowingrequirements;
1.The preliminaryplat of the proposed subdivision has been approvedby the CityCouncil.
2.The developer has submitted a complete set of utility construction drawings whichmustbeapprovedbytheCityEngineer.
3.The developer files withthe Finance Director a performance bond or other securedmethodapprovedbytheCityAttomeyandinanamountapprovedbytheCityEngineersufficienttocoverthecostofcompletingthefinalplatincludingallminimumutilityrequirements.
16.12.040 Required for all Construction:No person,firm,or corporationshall start any constructionwithoutfirsthavingsecuredaproperbuildingpermitConstructionforthepurposeofthissectionincludesbutnotbywayofexclusionallsignsattachedtostructures,and all freestandingsignsofmorethanonehundredforty-four (144)square inches in area,fences of sixfeet(6')or more,billboards,and antennae.
Section 2.This ordinance shall takeeffectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
