1671_00001ORDINANCE NO.1671 AN ORDINANCEAMENDING CHAPTER18.69OF THE MOSESLAKEMUNICI-PAL CODE ENTITLED "NON-CONFORMING USES" THE CITY COUNCIL OF THECITY OF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.Chapter 18.69 oftheMoses Lake Municipal Code entitled "Non-ConformingUses"is amended as follows: 18.69.015 Non-ConformingUses.Conditions Uoon ContinuedExistence.When,Procedure: A.Those non-conforming uses allowed to continue to exist pursuant to Section 18.69.010, as nowenacted oras hereafter amended,may be conditionedas provided in thissection. B.The Senior Planner,upon receipt of anyclaim,complaint,report,or information thata non-conforminguse exists withinthe city shall investigate such claim,complaint,report,orinformationandmakeadeterminationassetforthbelow. C.At theconclusion of his investigation,the Senior Planner shall determine if the use is anon-conforming use. D.Iftheuse is found to be a non-conforminguse,theSenior Planner shall determinewhether or notthe use is allowedtocontinue pursuantto Section 18.69.010.Iftheuse is not foundtobeauseallowedtocontinuepursuanttoSection18.69.010,the Senior Planner shallproceedasprovidedinthischaptertoterminatetheuse. E.Ifthe use is found to be a non-conforminguse allowed to continue pursuant to Section18.69.010,theBuilding Official,Fire Chief,and Senior Planner shall make written summaryoftheirfindingsandsubmitthem,togetherwithany conditionsthat,intheiropinion,shouldbeattachedtotheuse,to the Planning Commission. F.Uponcompletionof thedocumentationdescribed in subsection B,theSenior Planner shallproceedtosetadateforapublichearingwithinsixty(60)days of the receipt of theinformation,unless waived by the subject propertyowner,before the Planning Commis-O sion,The purpose of thathearing shall be to determinewhat conditions,if any,shall beattachedtothecontinuingnon-conforming use pursuant to 18.69.010.Notice of thehearingshallbepublishedatleastoncepriortothehearinginanewspaperofgeneralcirculationinthecity.Additionally,the Senior Planner shall cause notice of the publichearingtobedeliveredtotheadjacentlandOwnersandoccupantsbymailing,posting,orpersonalnotification,whichever the Senior Planner determines is likely to give actualnoticeofthehearingtothosepersons. G.At the conclusion of thepublichearing,the PlanningCommission shall make a finding onwhetherornotconditionsneedtobeimposedpursuanttoSection18.69.010.If thePlanningCommissionfindsconditionsarenecessary,it shall make findings as to whatconditionsandthereasonstherefore. H.Any non-conforminguse found tobe requiredtobe conditioned,will be allowedto continueaslongastheperson,firm,partnership,orcorporationresponsible forthatnon-conforminguseagreestoabidebyandbegovernedbytheconditionsimposedbythePlanningCommissionwithinthetimelimitsetbythePlanningCommission.The conditions imposedbythePlanningCommissionmaybeforaperiodofupto24months.The PlanningCommissionmayrequiremorefrequentreviewoftheconditionsimposedontheuseasitmaydirectattheinitialpublichearingoranysubsequentreview. I.Additionally,the Planning Commissionmay bring a set of conditions on for reviewbeforethedateprovidedatthetimetheconditionswereset,upon a complaintbeing brought toitsattentionbytheSeniorPlanneroranycitizen.The Planning Commission shalldeterminefromareviewofthecomplaintwhetherornottheallegationissufficienttoOwarrantafurtherhearingonthequestion.Ifa furtherhearing is deemed appropriate,thePlanningCommissionshallcausetobesenttotheperson,firm,partnership,orcorporationresponsibleforthenon-conforminguse a notice ofa hearing before thePlanning Commis-sion setting thedate,time,and place ofthe hearing.The noticeshall provide,in allcapitalletters,in a conspicuous place thereon:"THISHEARINGCOULD DETERMINEWHETH-ER OR NOTYOUR NON-CONFORMING USE ISALLOWEDTO CONTINUE."Said noticeshallbedeliveredinthesamemanneraspersonalserviceofsummonstotheresponsibleperson,or posted uponthe real property in question,or sent by UnitedStates mailservice,postage prepaid,to the address of the responsible person,Said notice shall allow theresponsiblepartyfive(5)days time beforethe hearing withinwhichto prepare,unless thePlanningCommissionfindingsatthetimeitconsiderstheallegationofnon-compliancethatthepublichealth,safety,and morals require a hearing before thattime. J.Either priortoorat least at thetimeofthehearing toconsider theallegationsofcomplaint concerning non-compliance with conditions,the Planning Commissionshall inform the person,firm,partnership,or corporation responsible for the non-conforminguse of the notice oftheallegedviolation.The Senior Planner shall present theevidence ofthefailure to comply.The responsible person shall then be allowed to respond if that person sodesires.The Planning Commissionshall then make its findings.It shall findwhether ornottheconditionshavebeenviolated;whether or not any violation has occurred ofsuch magnitude to require additional conditions,more frequent reviews of conditions,ortermination.If terminationof the privilege to continue the non-conforming use is deter- mined by thePlanning Commission as theonly method thatcan protect thepublichealth, safety,and morals toan acceptable degree,the Planning Commission shall determinethedateandtimeoftermination.Once the privilege is terminated for failure to observe conditions,the Planning Commission shall proceed todirect the Senior Planner to enforce the provisions of this chapter to terminatethe use. K.Any person aggrieved by thedecision of thePlanning Commission may appeal to the City Council as provided in Chapter 18.75. 18.69.060 Rebuildinq Duplexes in R-1 Zones:In areas currently zoned R-1 or areas subsequentlyzoned R-1either througha rezoningor upon territorybeing annexed into the corporate limits of the City of Moses Lake if a duplex exists as a non-conforminguse and is destroyed,it may be replaced,rebuilt,or added toby theowner/purchaserlvendee of the duplex without reference to the provisions of Section 18.69.050.In thecase of such aforesaid replacement,rebuilding, or addition,the duplexmay be replaced,rebuilt,or added toupon obtaining a building permit as is required for all construction intheCityof Moses Lake under Moses Lake Municipal Code 16.12.040,provided,thatthe replacement,rebuilding,or additionotherwisecomplies withall other currentor subsequently enacted ordinances of the City of Moses Lake including but not limited to ordinances referencing the Uniform Building Code,Moses Lake Municipal Code 16.04.010 and 16.04.030 and ordinances referencing the R-1 Single Family Residential Zone Moses Lake Municipal Code 18.16.010 through18.16.140 inclusive. If an exclusion from any of the above referenced ordinances is desired,application must be made totheCityCouncilwho may allow the sought after exclusionifthe City Council finds that strictadherence totheordinanceswould workan injustice against theowner/purchaser/vendee of the duplex and further would not be detrimental to the health,safety,or welfare of the surrounding area. Section 2.This ordinance shall takeeffect and be in force five (5)days after its passage and publication of its summaryas providedby law.
