AN ORDINANCE AMENDINGCHAPTER 13,12 OF THE MOSES LAKEMUNICl-PAL CODE ENTITLED "WATER AND SEWER RATES"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DOORDAINAS FOLLOWS:
Section 1.Chapter 13.12 of the Moses Lake Municipal Code entitled "Water and Sewer Rates"isamendedasfollows:
.13.12.010 Residential Water Rates:
A.The followingshall be themonthlyrate charge for water from the citywater system fromallresidentiallivingunitswithinthecorporatelimitsofthecityandoutsidethecorporatelimitsofthecity:

13.12.020 Commercial Water Rates:
A.The following shall be the monthlyrate charged for water from the city water system for
commercialusers and dwellings withthreeor more living unitsserved by one meterwithin
the corporate limits ofthe city and outside thecorporate limits of the city:

13.12.030 Residential Sewer Rates:The following shall be the monthlyrate charged customers resíding
within the corporate limits of the city and outside the corporate limits of the city for sewer
service from the city sewer system forsingle-family dwellings and each unitof a duplex with
separate meters:flat rate,$22.50 per month.
13.12.035 Duplex Sewer Rates:The followingshall bethe monthlyrate chargedcustomers residingwithin
the corporate limits of thecity and outside thecorporate limits of thecity forsewer service from
thecity sewer system forduplexes with onlyone meter serving twoliving unitsor for twoliving
units on a single lot served by one meter:flat rate,$45.00per month.
13.12.040 CommercialSewer Rates:
A.The following shall be the monthly rate charged customers residing within the corporate
limits of the city and outside the corporate limits of the city for all chargeable water
discharged into the city sewer system by commercial users and dwellingswith threeor
more living units served by one meter:

B.For purposes of calculating sewer charges,chargeable water shall be defined as follows:Chargeable water shall be measured by the water consumed on thepremises,whateverthesourceofsuchwater,and thesame will be metered either by a public utilitymeter oroneinstalledandmaintainedbytheownerofthepremisesathisownexpenseandapprovedandinspectedbythecity.As an option,if requested by the owner of thepremises,thecitywillinstall a water meter withthecost for themeter and installation beingpaidbytheownerofthepremisesinaccordancewiththechargesassessedinMLMC13.08.020 for water/sewer connections.Under such circumstances the water meterbecomesthepropertyoftheownerofthepremisesandallcostsofreplacementandrepairaretheresponsibilityoftheownerofthepremises.In all circumstances where thewaterismeteredbyaprivatelyownedwatermeterandisusedtodeterminesewercharges,thecityshallbeallowedaccesstothemeterînordertoreadsuchmeter.Where the use ofwaterissuchthataportionofallthewateruseddoesnotflowintothesewersystem,forwhateverreason,but is lost by evaporation,irrigatîon,sprinklingor is used in manufacturingorinamanufacturedproduct,or is lost for whatever reason,and the person in controlprovidesproofofthisfactandinstallsameterorothermeasuringdeviceapprovedbythecitytomeasuretheamountofwatersousedandsolost,or ifthecity is capable of deter-miningtheamount ofsewage entering the city's sewer system by some other mechanicalmeans,thiswater may be deducted from the actual water consumption used in calculatingthesewercharge.
The sewer charges fortriplexesand apartments,mobilehome parks,schools,hospitals andothercommercialestablishmentswithincreasedusageforirrigation,onlyiftheirlandscap-ing exceeds five thousandsquare feet,shall be computed on the average consumptionduringthepreviousnon-irrigationseason,unless the user elects to install,at his expense,an approved measuring device to measure water not entering the sewer system.When auserhasaswimmingpoolorcoolingunitsdischargingtothesanitarysewer,he mustinstallanapprovedmetertodeterminetheamountofwaterexemptfromsewerchargesduringtheirrigationseason.The irrigation season shall be defined as the period in whichstatementsaremailedfortheAprilthroughNovemberbillingcycles.
C.Sewer rates for commercial uses discharged into the sewer system maybe separatelydeterminedbytheCityCouncil,based upon both volume and chemicalcharacteristics ofthesewage.The CityCouncilreserves the privilege torequire pre-treatmentofany materialdischargedintotheseweragesystem,orto prohibitdischarge into thesystem of industrialOwastesthat,because of either volume or concentration,willoverload existing seweragefacilities.
D.AIIair-conditioningand refrigerationunits thatare installed,replaced orthathave capacityincreasedaftertheeffectivedateoftheordinancecodifiedinthischaptershallberequiredtoinstallrecirculatingunits.Disposal may not be accomplished by discharginginto thesanitarysewersystem.
Section 2.This ordinance shall takeeffect withbillingsafter June 1,1995.
