ASSESSMENTSINTOABOND FUND TOPAYANDSECURE THE PAYMENTOFLIDBONDSISSUEDFORTHECOSTOFTHEIMPROVEMENTS
RECITALS:
1.Resolution No.1881 adopted March 28,1995 by the City Councilof the City of Moses Lake,Washington,declared its intention to improvethe Central Drivearea between Grape Drive andValleyRoad,Grape Drivebetween Central Driveand Highway 17,CentralPlace,and EvelynDrivebetweenCrestDriveandCentralDriveareabyconstructingandinstallingfullwidthstreetimprovementsincludingpaving,curbs,gutters,storm drainage,sidewalks,landscaping,streetlighting,electrical transmissionanddistribution alterationsand trafficsignalizationand fixed April25,1995 at 7:00 p.m.in theCouncilChambers inthe Police/Court Facility,Moses Lake,Washing-ton,as the timeand place for hearing all matters relating to said improvements and all objectionstheretoandfordeterminingthemethodofpaymentofsaidimprovements;and
2.The City Engineer's Officehas caused an estimate to be made of thecosts and expense of eachcontinuousunitoftheproposedimprovementsandhasceltifiedsaidestimatetotheCityCouncil,together withall papers and information in its possession touchingthe proposed impovements,adescriptionoftheboundariesoftheDistricts,a statement of what portionof the cost and expenseoftheimprovementsshouldbebornebythepropertywithintheproposedDistricts,a statement indetailofthelocalimprovementassessmentsoutstandingorunpaidagainstthepropertyintheproposedDistrictsandastatementoftheaggregateactualvaluationoftherealestate,includingO25%of the actual valuation of the improvements in the proposed Districts,according to thevaluationlastplaceduponitforthepurposeofgeneraltaxation;and
3.Said estimate is accompanied by a diagram of the proposed improvements showingthereonthelots,tracts,parcels of land,and other property which will be specifically benefitted by eachcontinuousunitoftheproposedimprovements,and theestimated amountofthecost and expensethereoftobebomebyeachlot,tract,and parcel of land or other property;and
4.Due notice of the hearing on Resolution No.1881 was given in the manner providedby law andsaidhearingwasheldbytheCityCouncilonApril25,1995 and all writtenprotests filed with theCityCouncilonorbeforesaiddateweredulyconsidered;and
5.It has been further determined to be in the best interests of thecity thatsaid improvements,ashereinafterdescribed,be carried out and that a utilitylocal improvement district and a localimprovementdistrictbecreatedinconnectiontherewith,NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF MOSESLAKE,WASHINGTON DOORDAIN AS FOLLOWS:
Section 1.It is hereby ordered thatthe following improvements in theCityof Moses Lake,Washington,and the construction,be carried out iffinancing can be obtained throughthe sale and issuance of LIDbonds:
The improvement of the Central Drive area between Grape Drive and Valley Road,Grape DrivebetweenCentralDriveandHighway17,CentralPlace,and EvelynDrivebetween Crest Drive andCentralDriveareabyconstructingandinstallingfullwidthstreetimprovementsincludingpaving,O curbs,gutters,storm drainage,sidewalks,landscaping,street lighting,electrical transmissionanddistributionalterations,and trafficsignalization
Allof theforegoing shall be in accordance withtheplans and specificationsthereforeprepared by theCityEngineer's Office.
Section 2.The estimated cost and expense comes to $2,737,249.The entire cost and expense of theimprovementsshallbebornebyandassessedagainstthepropertyspeciallybenefittedbysuchimprovements.

Section 3.There is hereby created and established a local improvement district to be known as "Local
Improvement District No.#58"(LID#58),to include,as near as may be,all propertiesspecially benefitted
by the improvements,the territoryofwhich is described as follows and includes the following described
properties:

Section 4.The nature of the improvements ordered by thisordinance to be made is such thatthe special
benefits conferredupon the property in Local Improvement District #58 are fairly reflected bythe use of
thefrontfootage method ofassessment;and it is hereby provided and ordered thattheassessments shall
be made against the property within LID #58 in accordance with the front footage method provided by
statute.
Section 5.AIIassessments levied inLID#58 shall be for the sole purpose of payment into a bond fund
to pay and secure the payment of the local improvement district bonds issued for the cost of the
improvements.AIIpayments of such assessments,including all interest and penalties thereon,shall be
paid directly into the appropriate fund or funds and appliedto pay or secure the payment ofdebt service
on thelocal improvement district bonds heretofore or hereafter issued and payable from the appropriate
fund or funds without allocation toany particular series or issues of such bonds.
Section 6.This ordinance shalltakeeffect and be in force five (5)days after its passage and publication
of its summary as providedby law.
