AN ORDINANCEAMENDING CHAPTER 12.12 OF THE MOSES LAKEMUNICI-PALCODEENTITLED "SIDEWALKCONSTRUCTION"
THE CITY COUNCILOF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 12.12 of theMoses Lake Municipal Code entitled "Sidewalk Construction"is amendedasfollows:
0 12.12.050 SidewalkSpecifications -Commercial Zones:AIIsidewalks inthe commercial zones ofthe cityshallbeconstructedofgrayconcreteunlesstheCouncilhaspreviouslyapprovedtheusageofalternatematerialsandinaccordancetospecificationsissuedbytheCityEngineerexcepttheCentralBusinessDistrictwhichisdefinedastheareaboundedbythesouthsideofPioneerWayfromFifthAvenuetoChestnutStreet;the northwest side of BroadwayAvenue from
Chestnut Street to Dogwood Street;the northeast side of Dogwood from Broadway to FifthAvenue;the southeast side of Fourth Avenue from Dogwoodto Balsam;thenortheast side ofBalsamfromFourthtoFifth;thesouthwest side ofAsh Street from Fourth Avenue extending
50'southeast,as shown on the attached map which is incorporated by reference and made
a part of this ordinance.AII sidewalks in all commercial zones shall be built to the fulldimensionbetweenthebackofthecurbandtheabuttingpropertyline.Sidewalks shall beconstructedsoastoavoidphysicalobstructionsunlesstheCouncilhaspreviouslyapprovedtheplacementofphysicalobstructionssuchas,but not limited to,light poles,fire hydrants,
planter boxes,trees,ortreewells in or on the area reserved for sidewalks.
The sidewalks in the Central Business District,except the driveways and alley approaches,shall be constructed of concrete brick pavers in the red Decor pattern manufactured byTrendsetorapavermanufacturedbyanothercompanywhichisequaltothespecificationsoftheTrendsetRedDecorpatternbrickpaverDrivewayandalleyapproachesshallbeconstruct-ed of concrete brick paver in theblack Decor pattern manufactured by Trendset or a pavermanufacturedbyanothercompanywhichisequaltothespecificationsoftheTrendsetBlackDecorpattembrickpaver.The sidewalkshallbe constructed according tothecity'sCommuni-tyStreet and UtilityStandards as adopted by reference by Moses LakeMunicipal Code 12.08.The sidewalk standards,as referenced by Moses Lake Municipal Code 12.08,shall include butnotbelimitedtospecificationsfortheinstallationofsidewalks,tree wells,trees,irrigationOsystem,electrical conduit for decorative and/or functional/pedestrian street lighting andsidewalkfurniture(benches,garbage cans,planters,etc.).
Section 2.This ordinanceshall takeeffectand be in forcefive(5)days after its passage and publicationofitssummaryasprovidedbylaw.
