OROINANCE NO.1712
AN ORDINANCEAMENDINGCHAPTER 18.16 OF THEMOSES LAKEMUNICl-PALCODE ENT1TLED"R-1,SINGLE FAMILYRESIDENTIAL ZONE"
THECITY COUNCILOF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 18.16 of the Moses Lake MunicipalCode entitled "R-1,Single Family ResidentialZone"is amendedas follows:
18.16.020 Permitted Uses:Hereafter intheSingleFamily Residential Zone,no building,structure,or landOshallbeusedandnobuildingorstructureshallbeerected,altered,enlarged,or relocatedthereinwhichisdesignedorintendedtobeusedforanyotherthanthefollowingoutrightpermittedusesorasaconditionaluse.Outright permitted uses or conditional uses in theSingleFamilyResidentialZoneshallbeincompliancewiththeconditions,the performancestandards,and bulk regulationsofthis chapter.
A.Outright Permitted Uses:
1.Singlefamily dwellingunits,including
a.Single familydetached dwelling units.
b.Single familydwellingunits sharing a common wall or attachment on twolots ofrecord,
c.Condominiums -single family attached dwelling unitsdeveloped as a horizontalregimeincompliancewithChapter18.67 of thistitleentitled "Planned Develop-ment District."
d.Factory builtstrutures not on a permanent chassis.
2.Subordinate Uses -Anyuse which is incidentaland subordinate to the principal useofthelandorbuilding;is located on the same lot with the principaluses;and is notothenkiseprohibited
3.Accessory buildings and/orstructures appurtenanttoany permitted uses incompliancewithSection18.16.040 of thischapter.
4.Factory-built housing constructed to the standards oftheUniform Building Code.
5.Keepingofhousehold pets (dogsand cats)not exceeding three (3)in number which
are four (4)monthsold or older.
6.Planned DevelopmentDistrictsin compliancewithChapter 18.67 of thistitle.
7.Homeoccupations in compliancewith Chapter 18.55 of this title.
8.Parks and non-commercialrecreational uses.
9.An accessory dwellingunit intended to accommodate a member(s)of the immediatefamilyrequiringdailycare,supervision,or guardianship in compliance with Section18.16.190 of this chapter entitledResidential Density.
10.Other unmentioned uses ruled by the Planning Commission to be similar to andcompatiblewiththespecifiedpermitteduses.
11.Familyday care homes as an accessory use to a private familyresidence providingcareduringpartofthetwenty-four(24)hour day tosix (6)or fewer children.FamilydaycarehomesshatibelicensedbytheStateofWashington,Departmentof SocialandHealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.A city business license shall be required.
B.ConditionalUses:The followinguses may be permitted by the PlanningCommissionasaconditionaluseincompliancewiththeprovisionsofthischapterandChapter18.51 ofthistitleentitled"Conditionaland Unmentioned Uses."
1.Cemeteries
2.Churches
3.Essential public services and utilitiesincluding buildings and structures.
4.Golfcourses
5.Other unmentioned uses ruledby the Planning Commissionto be a conditionaluseprovidedthattheuseshallbesimilartoandcompatiblewiththeexpressedpermittedandconditionaluses.

6.Rental of an apartment appurtenantto a singlefamily residence
7.Schools
8.MiniDay Care Facility and Day Care Center:
a.Mini Day Care Facility:A day care facility for the care offrom seven (7)through
twelve(12)childrenin thefamilyabode of the person holding the license issued
bytheState of Washington,Departmentof Social and Health Services.
b.Day Care Center:A day care facility that provides for the care of from thirteen
(13)through twenty(20)children in the familyabode of the person holding the
license issued by the State of Washington,Department of Social and Health
Services.
c.Requirements:Mini day care facilities and day care centers shall be in compli-
ance with the following requirements:
1)Outdoor play areas shall not be located in front yards.
2)One (1)on-site parking space is required for each employee in addition to
required resident parking.
3)An on-site,off-streetloading and unloading area shall be required.
4)A city business license shall be required.
5)Signage shall not be permitted.
6)No structural or decorative alterationwhich would alter the character or be
incompatible with the surroundingresidences shall be permitted.
7)The use and structures shall be in compliance with zoning regulations and
Uniform Building Code requirements.
8)Miniday care facilities and day care centers shall be licensed by the State of
Washington,Department of Social and Health Services and shall operate in
compliance withthelicensed capacityrequirement as determined by theState
of Washington,Department of Social and Health Services except that day
care centers shall operate in compliancewith the capacity requirements asstipulatedinthissection.
9)The Planning Commissionmay impose conditions to mitigate any potential
adverse impacts on the surroundingarea.
10)Notification and agreement of adjacent property owners of an application for
a day care facility.(Ord.1562,1993;Ord.1202,1986;Ord.1121,1983)
18.16.030 Prohibited Uses:Any use not expressly permittedoutrightor as a conditional use in theR-1
Zone shall be prohibited,including but not limited to the following examples:
A.Abandoned sheds or buildings in a state of disrepair
B.Commercial uses except as providedin Section 18.16.020 (B).
C.Two family or multi-familydwelling unit structures except as provided for in Section
18.16.020 A.1.c.
D.Keeping of livestock,poultry,rabbits or bees
E.Industrial uses
F.Occupancy of trailers or recreational vehicles
G.Public nuisances
H.Removal of soil or other natural materials for the purpose of sale or use as fill material
except thatexcavationfor thepurpose of constructionor landscaping is permitted.
1.Outside storage,collection,or dumping of dismantled,partly dismantled,or wrecked
vehicles,trailers,machinery,or theirparts.
J.Outside storageor collection of any junk,scrap,garbage,unsightly material,litter,or
debris.
K.Manufactured homes

L Factory-builthousingconstructed on a chassis.
M.Locating any sea orocean-goingcontainers whichcan be detached from a trailer,chassis,
orframe and whichwere formerlyused for transportingsea or ocean-goingcargo,railroadcarsandcabooses,semi-trailerswhen intended to be used as storage facilities,or anyotherunitwhichdetachesfromatrailer,chassis,or frame including car,truck,or vanbodiesorpartsofbodieswhenintendedtobeusedasstoragefacilitiesorthelike.
N.Manufactured Home Subdivisions
18.16.110 Signs and Billboards:Signs and billboardsshall be in compliancewithChapter 18.56 of thistitle.
18.16.140 Parking:
A.Parking requirements shall be in compliancewithChapter 18.54 ofthistitle.
B.Alloff-street parkingshall be a hard surface.
C.Recreational equipment,including campingtrucks,motorhomes,camping trailers,boats,boat trailers,and sim11arequipment may be parked or stored on premises.Recreationalequipmentstoredorparkedwithinsideyardsetbacksshallbepermissibleprovidedtheoccupantsoftheadjoiningpropertyconsentthereto.
18.16.250 Performance Standards Residential Structures:
A.Residentialstructures shall have a pitched roof or the pitch of the main roof shall be notlessthanthreeinches(3")of rise for each twelveinches (12")of horizontal run.
B.The minimumwidthofthe main portion of the structureshall be not less thantwentyfeet(20')as measured across the narrowestportion.
C.Roof construction shallbe of non-reflective materials.
D.Residential structures shallbe constructed with a perimeter masonryor concrete founda-tionthat is in accordance tothe.UniformBuilding Code.
E.Single levelresidential structures shall have a floorlevel not more thaneighteen inches(18")above average finished grade.
F.Residential structures shall have a hard surfaced route from the main entrance of theresidencetothestreet.
G.Residential structures shall have a minimumof one (1)detached or attached coveredparkingspace.
18.16.260 Variances:A variance of the bulk regulations of thischapter maybe obtained throughtheHearingExaminerincompliancewiththeprovisionsofChapter18.80 entitled HearingExaminer.
Section 2.This ordinance shall takeeffectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
