AN ORDINANCEAMENDINGCHAPTER18.19 OF THEMOSES LAKE MUNICl-
PAL CODE ENTITLED "R-2,SINGLE FAMILYANDTWO FAMILYRESIDENTIAL
ZONE"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTONDO ORDAIN AS FOLLOWS:
Section 1.Chapter 18.19 of the Moses Lake MunicipalCode entitled"R-2,Single Family and Two FamilyResidentialZone"is amended as follows:
18.19.020 Permitted Uses:Hereafter in theSingle Family and TwoFamilyResidential Zone,no building,structure,orland shallbe used and no building or structure shall be erected,altered,enlarged,
or relocated thereinwhich is designed or intended to be used for any other thanthefollowing
outrightpermitted uses or as a conditional use.Outright permitted uses or conditionalusesintheSingleFamilyandTwoFamilyResidentialZoneshallbeincompliancewiththeconditions,the pedormance standards,and the bulk regulations of thischapter.
A.OutrightPermitted uses:
1.Duplex -a structute on one lot of record containingtwo(2)dwelling units.
2.Singlefamilydwellingunits,including
a.Singlefamilydetached dwelling units.
b.Single family dwellingunits sharing a comrnon wall or attachment on twolots ofrecord.
c.Condominiums -single family attached dwelling units developed as a horizontal
regimein compliancewiththerequirements of this chapter or in compliancewithChapter18.67 of thistitleentitled"Planned DevelopmentDistrict."
3.Subordinate Uses -any use which is incidental and subordinate to the principal useofthelandorbuilding;is located on the same lot with the principaluse;and is notomeneeMd.
4.Accessory buildings and/orstructures appurtenant toanypermitteduses in compliancewithSection18.19.040 of thischapter.
5.Factory-built housing constructed tothestandards of the Uniform Building Code.
6.Manufactured homes
7.Keepingof household pets (dogsand cats)not exceeding three(3)in number which
are four (4)morths old or older,
8.Planned DevelopmentDistrictsin compliancewith Chapter 18.67 of thistitle,entitled"Planned DevelopmentDistrict."
9.Parks and non-commercial recreational uses.
10.Home occupations in compliance withChapter 18.55 of thistitle.
11.An accessory dweSing unit intended to accommodate a member(s)of the immediatefamilyrequiringdailycare,supervision,or guardianship in compliance with Section18.19.190 of this chapter entitled"Residential Density."
12.Other unmentioned uses ruled by the Planning Commission to be similar to andcompatiblewiththespecifiedpemiitteduses.
13.Family day care homes as an accessory use to a private family nasidence providingcareduringpartofthetwenty-four(24)hour day to six (6)or fewer children.FamilydaycarehomesshallbelicensedbytheStateofWashington,Department of SocialandHealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.A citybusiness license shall be required.
B.ConditionalUses:The followinguses may be permittedby the Planning Commission asaconditionaluseincornpliancewiththeprovisionsofthischapterandChapter18.51 ofthistitleentitled"Conditionaland Unmentioned Uses."

5.Cemeteries
6.Rental of an apartment appurtenant to a single familyresidence
7.Manufactured home parks in compliance with Chapter 18.63 of this code entitled
"Mobile (Manufactured)Home Parks."
8.Essential public services and utilities including buildings and structures.
9.Boarding houses for not morethan three(3)people
10.Mini Day Care Facility and Day Care Centers:
a.MiniDay Care Facility:A day care facility forthecare offrom seven (7)throughtwelve(12)childrenin thefamilyabode of the person holding thelicense issued
by the State of Washington,Department of Social and Health Services.
b.Day Care Center:A day care facility that provides for the care of from thirteen(13)through twenty (20)children in the family abode of the person holding the
license issued by the State of Washington,Department of Social and Health
Services,
c.Requirements:Miniday care facilities and day care centers shall be in compli-
ance withthe followingrequirements:
1)Outdoor play areas shall not be located infront yards.
2)One (1)on-site parking space is required for each employee in addition torequiredresidentparking.
3)An on-site,off-street loading and unloading area shall be required.
4)A city business license shall be required.
5)Signage shall not be permitted.
6)No structural or decorative alteration which would alter the character or be
incompatible withthesurroundingresidences shall be permitted.
7)The use and structures shall be in compliance with zoning regulations and
Uniform Building Code requirements.
8)Miniday care facilities and day care centers shall be licensed by the State of
Washington,Department of Social and Health Services and shall operate in
compliance with thelicensed capacity requirement as determined bythe State
of Washington,Department of Social and Health Services except that day
care centers shall operate in compliance with the capacity requirements asstipulatedinthissection.
9)The Planning Commissionmay impose conditionsto mitigate any potential
adverse impacts on the surroundingarea.
10)Notificationand agreement of adjacent property owners of an application for
a day care facility,
11.Other uses ruled by the Planning Commission to be a conditionaluse provided that
the use shall be similarto and compatiblewith the expressed permittedand condi-
tionaluses.
18.19.110 Signs and Billboards:Signs and billboards shall be in compliancewith Chapter 18.56 of this
title.

18.19.140 Parking:
A.Parking requirements shall be in compliancewith Chapter 18.54 of thistitle.
B.Alloff-streetparking shall be a hard surface.
C.Recreational equipment,including camping trucks,motorhomes,camping trailers,boats,
boat trailers,and similar equipment may be parked or stored on premises.Recreationalequipmentstoredorparkedwithinsideyardsetbacksshallbepermissibleprovidedtheoccupantsoftheadjoiningpropertyconsentthereto.
18.19.250 Performance Standards Residential Structures:Exclusive of manufactured homes located inmanufacturedhomeparkswhichshallbeincompliancewithChapter18.63 ofthiscode entitled"Mobile (Manufactured)Home Parks."
A.Residential stmetures shallhave a pitched roofor the pitchof the main roof shall be notlessthanthreeinches(3")ofrise for each twelveinches (12")of horizontalrun.
B.The minimumwidthof themain portion of a residential structure shall be not less thantwentyfeet(20')as measured across thenarrowest portion.
C.Roof construction shallbe of non-reflectivematerials.
D.Wheels and tongue of all manufacturedhomes not located in manufactured home parksshallberemoved.
E.All manufactured homes shall be new and previously untitledand shall bear theinsigniaofapprovalbytheStateofWashingtonortheU.S.Department of Housingand Urban
Development indicating compliancewiththeNational Manufactured Housing ConstructionSafetyStandardsActof1974(effectiveJune 15,1976).
F.Residential structures shall be constructedwitha perimetermasonry or concrete founda-tionthatis in accordance withthe Uniform BuildingCode.
G.Single level residentialstructures shall have a floor level not more thaneighteen inches(18")above averagefinished grade.
H.Residential structures shall have a hard surfaced route from the main entrance of theresidencetothestreet
I.Residential structures shall have a minimumof one (1)detached or attached coveredperkingspace.
16.19.260 Variances:A variance of the bulk regulations of this chapter may be obtained throughtheHearingExaminprincompliancewiththeprovisionsofChapter18.80 entitled HearingExaminer.
Section 2.This ordinance shall takeeffect and be in force five(5)days after its passage and publicationofitssummaryasprovidedbylaw.
