1714_00001O O ORDINANCE NO.1714 ANORDINANCEAMENDINGCHAPTER 18.22 OF THE MOSES LAKEMUNICI-PAL CODEENTITLED"R-3,MULTI-FAMILYRESIDENTIALZONE" THE CITY COUNCIL OF THE CITY OF MOSESLAKE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.Chapter 18.22 of the Moses Lake MunicipalCode entitled "R-3,Multi-family Residential"isamendedasfollows: 18.22.020 Permitted Uses:Hereafter in the Multi-family Residential Zone,no building,structure,or landOshallbeusedandnobuildingorstructureshallbeerected,altered,or relocated herein whichisdesignedorintendedtobeusedforanyotherthanthefollowingoutrightpermittedusesorasaconditionaluse.Outright perml#ed uses or conditionaluses inthe Multi-family Residential Zone shall be in compliance with the conditions,the performance standards,and bulk regulationsof thischapter. A.OutrightPermitted Uses: 1.Multi-familydwellingunitstructure-a structurecontaining morethantwodwelling units on a single lot. 2.Duplex -a structure on one lot of record containingtwo(2)dwelling units. 3.Single family dwelling units,including a.Single family detached dwellingunits, b.Single family dwellingunits sharing a common wallor attachment on twolots ofrecord. c.Condominiums -single family attached dwellingunits developed as a horizontal regime in compliancewiththe requirements of this chapter or in compliancewith Chapter 18.67 of this titleentitled "Planned Development District " 4.Subordinate Uses -any use which is incidental and subordinateto the principal use 0 of the land or building;is located on the same lot withthe principal use;and is nototherwiseprohibited. 5.Accessory buildingsand/orstructures appurtenanttoany permitteduses incompliancewithSection18.22.040 of this chapter. 6.Factory-built housing constructed tothe standards ofthe Uniform Building Code. 7.Manufacturedhomes 8.Keeping of household pets (dogsand cats)not toexceed three(3)in number whicharefour(4)months old or older. 9.Planned Development Districts in compliancewith Chapter 18.67 of thistitle,entitled"Planned DevelopmentDistricts." 10.Parks and nonommercial recreational uses. 11.Home occupations in compliancewith Chapter 18.55 of thistitle. 12.An accessory dwelling unitintended toaccommodate a member(s)of the immediatefamilyrequiringdailycare,supervision,or guardianship in compliance with Section18.22.210 of this chapter entitled "Residential Density." 13.Other unmentioned uses ruled by the Planning Commission to be similar to andcompatiblewiththespecifiedpermitteduses.0 14.Family day care homes as an accessory use to a private family residence providing care during part of the twenty-four(24)hour day to six(6)or fewer children.FamilydaycarehomesshallbelicensedbytheStateofWashington,Department of SocialandHealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.A citybusiness license shall be required. B.Conditional Uses:The following uses maybe permitted by thePlanning Commission asaconditionetuseincompliancewiththeprovisionsofthischapterandChapter18.51 ofthistitleentitled"Conditionaland Unmentioned Uses." 1.GolfCourses 2.Cemeteries ORD.1714/Page 2 3.Manufactured home parks in compliance with Chapter 18.63 of this code entitled"Mobile (Manufactured)Home Parks." 4.Clubs,lodges,and assembly halls 5.Athletic clubs 6.Boarding houses 7.Group homes for the developmentally disabled 8.Schools 9.Churches 10.Clinics 11.Professional offices 12.Rental of an apartment appurtenant toa singlefamily residence 13.Essential public services and utilitiesincluding buildings and structures. 14.Hospitals 15.Hotels 16.Motels 17.Marinas located along thelake shore 18.Mini Day Care Facilities and Day Care Centers: a.Mini Day Care Facility: 1)A day care center for the care of twelve(12)or fewer children in a facility other thanthe family abode oftheperson or persons underwhose directcare and supervisionthe child is placed;or 02)For the care of from seven (7)throughtwelve (12)children in the family abode ofsuch person or persons. b.Day Care Center:A day care facility thatprovides forthecare of thirteen(13)or more children provided thatthe capacity of day care centers located in private family residences in residentialzones shall not exceed twenty(20)children at anygiventimeandthepermittedcapacityofdaycarecenterslocatedinresidential zones in other than private family residences shall be set by the Planning Commission on a case by case basis. c.Requirements:Miniday care facilities and day care centers shall be in compli- ance with the following requirements: 1)Outdoor play areas shall not be located in front yards. 2)One (1)on-site parking space is required for each employee in addition torequiredresidentparking. 3)An on-site,off-streetloading and unloading area shall be required. 4)A citybusiness license shall be required. 5)Signage shall not be permitted. 6)No structural or decorative alteration which wouldalter the character or be incompatible with the surrounding residences shall be permitted. 7)The use and structures shall be in compliancewith zoning regulations and Uniform Building Code requirements. 8)Mini day care facilities and day care centers shall be licensed by the State of Washington,Department of Social and Health Services and shall operate in compliancewith thelicensed capacity requirement as determined by theState of Washington,Department of Social and Health Services except that day care centers shall operatein compliancewiththe capacity requirements asstipulatedinthissection. ORD.1714/Page 3 9)The Plannirig Commission may impose conditionsto mitigateany potentialadverseimpactsonthesurroundingarea. 10)Notification and agreement ofadjacent propertyowners of an application for a day care facility, 19.Other uses ruled by the Planning Commissionto be a conditionaluse provided thattheuseshaubesimilartoandcompatiblewiththeexpressedpermittedandcondition- al uses or other uses permittedby specific provisionof thischapter as a conditional use. O 18.22.120 Signs and Billboards Signs and billboardsshall be in compliance withChapter 18.56 ofthistitle. 18.22.160 Parking: A.Parking requirements shall be in compliancewithChapter 18.54 of this title. B.All required of-street parking shall be a hard surface. C.Recreational equipment,including camping trucks,motor homes,campingtrailers,boats,boat trailers,and similarequipment may be parked or stored on premises.Recreational equipment stored or parked withinside yard setbacks shall be permissible providedtheoccupantsoftheadjoiningpropertyconsentthereto. 18.22.270 Performance Standards Residential Structures:Exclusiveof manufacturedhomes located inmanufacturedhomeparkswhichshallbeincompliancewithChapter18.63 ofthiscode entitled"Mobile (Manufactured)Home Parks." A.Residential structures shall have a pitched roof or thepitchof the main roofshall be notlessthanthreeinches(3")of rise for each twelveinches (12")of horizontal run. B.The minimumwidth of the main portionof a residentialstructure shall be not less thantwentyfeet(20')as measured across the narrowest portion. C.Roof constructionshall be of non-reflectivematerials. D.Wheels and tongueof all manufactured homes not located in manufactured home parksshallberemoved. E.All manufactured homes shan be new and previously untitled and shan bear the insignia of approval by the State of Washington or the U.8.Department of Housing and Urban Development indicating compliance with the National Housing Construction SafetyStandardsActof1974(effectiveJune 15,1976). F.Residential structuresshall be constructed witha perimeter masonry or concrete founda-tionthatis in accordance with the UniformBuilding Code. G.Single level residential structures shan have a floor level not more thaneighteen inches(18")above average finished grade. H.Residential structures shall have a hard surface route from the main entrance of theresidencetothestreet. 18.22.280 Variances:A variance of the bulk regulations of thischapter may be obtained through theHearingExaminerincompliancewiththeprovisionsofChapter18.80 entitled HearingExaminer. Section 2.This ordinance shall takeeffect and be in force five(5)days afterits passage and publicationofitssummaryasprovidedbylaw.
