1715_00001O O ORDINANCE NO.1715 ANORDINANCEAPPROVING ANDCONFIRMING THEASSESSMENTS ANDASSESS- MENTROLL OF ULID6 WHICH HASBEEN CREATED ANDESTABLISHED FOR THE PURPOSE OF PAYlNG THE COST OF IMPROVINGMONROE STREET BETWEEN NELSON ROAD AND SHARON AVENUEBY CONSTRUCTING AND INSTALLINGASANITARYSEWERSYSTEMINTHECITYOFMOSESLAKEASPROVIDEDBYORDI- NANCENO.1652 ANDLEVYlNGANDASSESSINGTHEAMOUNTTHEREOFAGAINST THE SEVERAL LOTS,TRACTS,PARCELS OF LAND,AND OTHER PROPERTYSHOWNONSAIDROLL6WHEREAS,theassessment rolllevyingthespecialassessments against properties located in UtilityLocalimprovementDistrictNo.6 in the Cityof Moses Lake,Washington,created under Ordinance No.1652 hasbeenfiledwiththeFinanceDirectoroftheCityofMosesLakeasprovidedbylaw;and WHEREAS,(1)notice of the time and place of hearing on theassessment mil and of making objectionsandproteststosaidrollwasdulypublishedinthemannerprovidedbylaw,and fixing the timeand placeofthehearingforULIDNo.6 at 7 p.m.on February 27,1996intheCouncilChambers in the Police/CourtFacility,Moses Lake,Washington,and (2)noticeof thehearing was dulymailed by theFinance Directortoeachpropertyownershownonsaidrollaccordingtolaw,and WHEREAS,at the timeand place fixedand designated in said notice the hearing was duly held and allprotestsmadeinwritingwerereadandsubmittedtotheCityCouncilandwereconsideredbytheCityCouncil, THE CITY COUNCIL OF THE CITY OF MOSESLAKE,WASHINGTON DOORDAIN AS FOLLOWS: Section 1.That the assessments and assessment roll of UtilityLocal improvement District No.6 which has been filed withtheFinance Director and considered by theCityCouncilwhich has been created andestablishedforthepurposeofpayingthecostofimprovingMonroeStreetbetweenNelsonRoadandSharonAvenuebyconstructingandinstallingasanitarysewersystemintheCityofMosesLakeasprovidedinOrdinanceNo.1652 as the same now stands,be and the same as hereby in all thingsand respects approved and confirmed. Section 2.That each of the lots,tracts,parcels of land and other property shown upon the said roll is0herebydeterminedanddeclaredtobespeciallybenefitedbysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameisinproportiontotheseveralassessmentsappearinguponsaidroll.There is hereby levied and assessed against each lot,tract,parceloflandandotherpropertyappearinguponsaidrolltheamountfinallychargedagainstthesamethereon. Section 3.That the assessment rollas approved and confirmedshall be filed with the Finance DirectoroftheCityofMosesLakeforcollectionandthatsaidFinanceDirectorisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollisinhishandsforcollectionandthatpaymentofanyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)days from the date ofthefirstpublication of said noticewithout penalty,interest,or cost,and thathereafterthesumremainingunpaidmaybepaidinequalannualinstallmentsinanumberasdeterminedbythebondissue,withinterest thereon fixedat therate of not greater than8.5%per annum,provided,however,thatifthenet effectiveinterest rate fixedon the local improvement bonds hereafter issued for Utility LocalImprovementDistrictNo.6 is greater than8.5%per annum,theinterest rate on the unpaid assessmentsshallberevisedtoarateof1/2 of 1%in excess ofthe net effectiveinterest rate on such bonds.The firstinstallmentofassessmentsonsaidassessmentrollshallbecomedueandpayableduringthe30-dayperiodsucceedingthedateoneyearafterthedateoffirstpublicationbytheFinanceDirectorofnoticethattheassessmentrollisinhishandsforcollectionandannuallythereaftereachsucceedinginstallmentshallbecomedueandpayableinlikemanner. If the whole or any portion oftheassessment remains unpaidafter the first 30-day period,interest uponthewholeunpaidsumshallbechargedatarateofnotgreaterthan8.5%per annum,providedhowever,thatifthenet effectiveinterest rate fixed on thelocal improvement bonds hereafter issued for UtilityLocalimprovementDistrictNo.6 is otherthan 8%per annum,the interest rate on theunpaid assessments shallberevisedtoarateof1/2 of 1%in excess of thenet effective interest rate on such bonds;and each yearOthereafteroneofsaidinstallments,togetherwith interest due on thewhole of the unpaid balance,shallbecollected.Anyinstallment not paid prior totheexpiration of thesaid 30-day periodduring whichsuchinstallmentisdueandpayableshallthereuponbecomedelinquent.All delinquent installments shall besubjecttoachargeforinterestattherateabovereferenced,and a penalty as set by Moses LakeMunicipalCode3.50.020.The collectionof such delinquent installments shall be enforced in the mannerprovidedbylaw. Section 4.This ordinance shall takeeffect and be inforcefive (5)days after its passage and publicationofitssummaryasprovidedbylaw.
