1733_00001ORDINANCENO.1733 ANORDINANCE CREATING CHAPTER 16.13OF THE MOSES LAKEMUNICIPAL CODE ENTITLED "CERTIFICATEOF OCCUPANCY" THE CITY COUNCIL OF THECITY OF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.Chapter 16.13 oftheMoses Lake Municipal Code entitled"Certificateof Occupancy"is created as follows: 16.13.010 Issuance/Appeal A.The Building Official has the authorityto issue a certificate of occupancy. B.The Hearing Examiner shall hear and rule upon all appeals from rulingsof the BuildingOfficial. 16.13.020 Required for all Occuoancies:No person,firm,or corporationshall occupy any residence,office,or buildingwithout first having secured a proper certificate of occupancy.This appliestoallnewstructures,substantial remodels,and changes inexistingoccupancy classifications.A substantial remodel is classified as a remodel with a totalcost in excess of sixtypercent(60%)of the assessed value ofthe original structure. 16.13.030 Certificate Issued:The Building Officialshall issue a certificate of occupancyonlyafterall therequirementsoftheUBC,UPC,UMC,UFC,city ordinances,and state laws are met. 16.13.040 Temporary Certificate:A temporarycertificateof accupancy may be issued for the use orstockingofaportionorportionsofabuildingorstructurepriortothecertificateofoccupancybeingissuedfortheentirebuildingorstructureiftheBuildingOfficialfindsthatnosubstantialhazardwillresultfromthetemporaryoccupancyofsuchbuildingorportionthereof. 16.13.050 Revocation:The Building Officialmay,in writing,suspend or revoke a certificate of occupancyissuedundertheprovisionsofthischapterwheneverthecertificateisissuedinerror,or on thebasisofincorrectinformationsupplied,or when it is determined thatthe building or structure or portion thereofis in violationof any ordinance or regulation. 16.13.060 Notice to Cease Violation:Any person,firm,orcorporation found violating any provision ofthischaptershallbeservedbytheBuildingOfficialwithwrittennoticestatingthenatureoftheviolationandprovidingtwenty-four(24)hours to correct the violationor cease occupancyimmediately.No furtherviolation shall be permittedat the location. 16.13.070 Penalty for Continued Violation:Any person,firm,or corporation who continues any violationbeyondthetimelimitprovidedforinSection16.13.060 orwhopermits any additionalviolationaftercorrectionoftheviolationnotedunderSection16.13.060 is deemed to have committed a civil infraction,and upon conviction thereofshall be subject toa C-1 penalty and punishable as defined in Chapter 1 08 of the Moses Lake Municipal Code.Failure or refusal to complyshallconstitutegroundstoterminatewaterand/or sewer service to the building or structurebeingoccupiedinviolationofthischapter.Any person feeling aggrieved may appeal asprovidedinMosesLakeMunicipalCode13.12.052.Failure or refusal to comply shall alsoconstitutegroundsforrevokingtheviolator'scity business license. Section 2,This ordinance shall takeeffectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
