1734_00001scosisess SEUURTTY TTTLE GUARARRECORDEDGRANTCOUNTYORDINANCENO.1734 AN ORDINANCE VACATING A PORTION OF REAUGH ADDITION THE CITY COUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.The portionofthe Reaugh Addition described below and underlined shall be vacated and thatthetitleofsaidpropertyshallvestwiththeCityofMosesLake: A tractofland in theNorth 1/2 of the SE 1/4 ofSection 22,Township 19 North,Range 28 Eastdescribedbymetesandboundsasfollows: Beginning at the intersection of the centerlines of "A"Street and Rose Avenue,streets in Guffin-Eccles Addition #3 toMoses Lake,Grant County,Washington;thence373.09 feet South 2E00"ytest alonalitesenterline antLoentedio extended-otaaldRose Avenne to theeasterly -line of Lakeside Drive,a street in said Guffin-Eccles Addition;thence 314.26 feet South23°29'20"West alongtheeasterly line of said Lakeside Driveto thesouth line of the NW 1/4oftheNW1/4 of the SE 1/4 of said Section 22;thence140.00 feet,more or less,South89°52'22"East to the high water line of Moses Lake;thence 1,490.00 feet,more or less,northeasterlyalong said high water line to the north line of the NE 1/4 of theSE 1/4 of saidSection22;thence 680.00 feet,moreor less,North89°55'35"West along the northline of theSE1/4 of said Section 22 toan intersection with thecenterlineof said Rose Avenue extended;thence667.00 feet South 0°27'00"West along the centerline of said Rose Avenue extendedtothepointofbeginning. Restrictive Covenant:Nodwelling costing less than$4,000.00shall be constructed on anyportionofthelandincludedinthisplatnorshallanyportionofthelandincludedinthisplatbesoldtopersonsotherthanmembersofthecaucasianrace.This restrictive covenant shall beappurtenanttoandrunwithsaidlanduntilJanuary1,1955.It shall be lawful for any otherpersonorpersonsowningpropertyinsaidplattoprosecuteanyproceedingsatlaworinequityagainstthepersonorpersonsviolatingorattemptingtoviolatesuchcovenantsandrestrictionsandeithertopreventhimorthemfromsodoingortorecoverdamagesorotherduesforsuchviolation.Allsubsequent owners of land in thisplatshall be bound by thiscovenant,whetherornotthesameisrecitedinanydeedorconveyancetosaidowners. Section 3.This ordinance shall takeeffectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
