AN ORDINANCE VACATINGA PORTION OF COMMERCIAL AVENUE
THE CITY COUNCIL OF THE CITY OF MOSESLAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.A portionof Commercial Avenue described as follows,shall be vacated:
That portion of Commercial Avenue located in the SW¼of Section 14,Township 19 North,Range 28 East,W.M.,Grant County,Washington described as follows:
Commencing at the northeast corner of the 0.67 acre tractshown on Les Schwab Tires ShortPlatrecordedinBook4ofPlats,Pages 16 and 17,the True Point ofBeginning;thenceSouth44°45'45"West along the northerlyboundary of said 0.67 acre tract,125.24 feet to the mosteasterlypointofacul-de-sac shown on said short plat as "Dedicated to city for road r/w",apointonanon-tangent curve (radialbearing South 74°43'53"West);thencesouthwesterly andnorthwesterlyalongsaidroaddedicationandalongsaidnon-tangent curve being concave tothenorthwestandhavingaradiusof40.00 feet and a delta of 120°03'47"a distance of 83.82feetreturningtoapointonthenortherlyboundaryofsaid0.67 acre tract (radialbearing North14°4T40"East);thenceSouth 44°45'45"West along said northerly boundary 8.16 feet to themostnorthwesterlycornerofsaid0.67 acre tract,said point also lying on the northeasterlyboundaryofTaxLotNumber6710asshownontheRecordofSurveyrecordedinBook34ofSurveys,Pages 4 and 5;thenceNorth 37°13'20"West along the northeasterly boundary of TaxLotNumber6710adistanceof60.59 feet to the most northerly corner of Tax Lot Number6710,said point lying on thesoutheasterly boundary ofTax Lot Number 5878 also shown onsaidRecordofSurvey;thenceNorth 44°45'45"East along thesoutheasterly boundary of TaxLot5878adistanceof143.42 feet tothe most easterly comer of the Boundary Line AdjustmentshownonsaidRecordofSurveyrecordedinBook34ofSurveys,Pages 4 and 5 (saidpointliesSouth44°45'45"West,6.58 feet from the most easterly corner of said Tax Lot Number5878);thence South 85°30'43"East,78.64 feet to the True Point of Beginning;containing11,367 square feet.
Section2.The city shall be compensated for one half the appraised value of thevacated property.Thevacationshallnotbecomeeffectiveuntiltherequiredcompensationisreceivedbythecity.
Section 3.This ordinance shall takeeffectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
