1740_00001ORDINANCE NO.1740 AN ORDINANCE CREATING A PLANNED UNIT RESIDENTIAL DEVELOPMENTDISTRICTOFMOSESLAKEPURSUANTTOMOSESLAKEMUNICIPALCODE18.22.020 (8)AND MOSES LAKEMUNICIPALCODE 18.67 THE CITY COUNCIL OF THE CITY OF MOSESLAKE,WASHINGTON DOORDAIN AS FOLLOWS: Section 1.The following described property shall be permitted to develop as Planned Unit ResidentialDevelopmentDistrictNo.9,and shall be named Marina Shores Planned Unit ResidentialDistrictasrecordedwiththeGrantCountyAuditor: That portion ofGovemmentLot5,Section22,Township 19 North,Range 28 East,W.M.,GrantCounty,Washington,described as follows: Commencing fromthesouthwest comer of Section 22;thenceNorth 00°33'30"East,alongthewestlineofthesouthwestquarterofSection22,a distance of 1,327.44 feet,to thesouthwestcornerofGovernmentLot5;thenceNorth 00°33'30"East,continuingalong said west line,adistanceof84.63 feet,tothetruepoint ofbeginning;thence North 00°33'30"East,continuingalongsaidwestline,a distance of 710.92 feet,tothe southerly boundary of a certain parcelofgroundfiledunderAuditor's File #737995,records of Grant County;thenceNorth 64°36'22"East,alongsaid southerlyboundary,a distance of 740.66 feet,to thewesterlyboundary ofthatcertainparcelofgrounddeededtotheStandardOilCompanyunderAuditor's File #238249,recordsof Grant County;thenceSouth 04°38'17"West,a distance of 434.46 feet;thence south23°19'30"East,a distance of 146.02 feet,tothenortherlyright-of-way ofMarina Drive;thenceonacurvetotheleft,along said northerlyright-of-way,with a radius of 225.28 feet,and alengthof149.83 feet;thence south 58°27'23"West,a distance of692.42 feet,to thetruepointofbeginning;containing 9.96 acres more or less. Section 2.All requirements and standards ofthe R-3 Zone,Multi-family Residential,shall apply to thePlannedUnitResidentialDevelopmentDistrictNo.9 withthe following conditions: 1.A 25'bufferarea shall be maintained on the shoreline which shall be left in its natural state. 2.A designated walkway along one side and a sidewalk constructed per communitystandardsalongtheothersideofallinternalstreetsshallbeprovided. 3.The developer and its successor owner's association,as a condition of receiving water andsewerservicetoeachandeverylotofthePURDD,have in full force and effect publicliabilityinsurancewiththecitynamedasanadditionalinsuredinanamountofatleast$2 million. 4.Water and sewer will be constructed per communitystandards.City employees will bepermittedaccesstotheplattedareatoreadmeters,inspect lines,make repairs,and perlormmaintenanceasdeemedappropriatebythecity.Allstreet repairs associated with water and/or sewer line repairs willbe theresponsibilityof the owner's association. 5.Streets will be private and will be constructed per community standards to a 30'width.Thosestreetstobemaintainedandrepairedbytheowner's association. Section 3.The City Council declares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of theentire CityCouncil present vote in favorofpassage.
