AN ORDINANCE AMENDING CHAPTER 18.19 OF THEMOSES LAKEMUNICI-
PALCODE ENTITLED"R-2,SINGLEFAMILYANDTWOFAMILYRESIDENTIAL"
THE CITY COUNCIL OF THECITYOF MOSESLAKE,WASHINGTON DOORDAINAS FOLLOWS:
Section 1.Chapter 18.19 oftheMoges Lake Municipal Code entitled"R-2,Single Familyand Two Family
Residential"is amended as follows:
18.19.020 Permitted Uses:Hereafter in theSingle Family and Two Family Residential Zone,no building,
structure,or land shaH be used and no building or structure shallbe erected,altered,enlarged,
or relocated thereinwhichis designed or intended to be used for any other thanthefollowingoutrightpermittedusesorasaconditionaluse.Outrightpermitted uses or conditionalusesin.the Single Family and Two Family Residential Zone shall be in compliance with theconditions,the performance standards,and the bulk regulations of thischapter.
A.Outright Permitted Uses:
1.Duplex-a structure on one lot of record containingtwo(2)dwelling units.
2.Single familydwelling units,including
a.Singlefamilydetached dwellingunits.
b.Singlefamily dwellingunits sharing a common wall or attachment on twolots ofrecord.
c.Condominiums-single family attached dwellingunits developed as a horizontalregimeincompliancewiththerequirementsofthischapterorincompliancewith
Chapter 18.67 of thistitleentitled"Planned Development District."
3.SubordinateUses -any use which is incidental and subordinate to the principal useofthelandorbuikling;is located on the same lot with the principaluse;and is not
otherwiseprohibited.
4.Accessorybuildingsand/or structures appurtenant toany permitteduses in compliance
with Section 18.19.040 of this chapter.
5.Factory-builthousing constructed tothe standards of the UniformBuildingCode.
6.Manufactured homes
7.Keeping of household pets (dogsand cats)not exceeding three(3)in number which
are four(4)mdnths old or older.
8.Planned Development Districts in compliance with Chapter 18.67 of thistitle,entitled
"Planned Development District."
9.Parks and non-commercialrecreational uses.
10.Home occupations in compliancewithChapter 18.55 of thistitle.
11.An accessory dwelling unitintended toaccommodate a member(s)of the immediate
family requiring daily care,supervision,or guardianship in compliance with Section
18.19.190 of thischapter entitled"Residential Density."
12.Other unmentioned uses ruled by the Planning Commission to be similar to andcompatiblewiththespecifiedpermitteduses.
O 13.Family day care homes as an accessory use to a private family residence providing
care duringpart ofthetwenty-four(24)hour day to six (6)or fewer children.Family
day care homes shalLbe licensed by the State of Washington,Department of Social
and Health Services and shall operate in compliance with the licensed capacityrequirementsforfamaydaycarehomes.A city business license shall be required.
B.Conditional Uses:The following uses may be permitted by the Planning Commission asaconditionaluseincompliancewiththeprovisionsofthischapterandChapter18.51 ofthistitleentitled"Conditional and UnmentionedUses."

3.Group homes for the developmentally disabled
4.GolfCourses
.5.Cemeteries
6.Rental of an apartment appurtenant toa single family residence
7.Manufactured home parks in compliance with Chapter 18.65 of this code entitled
"Manufactured Home Parks."
8.Essential public services and utilities including buildingsand structures.
9.Boardinghouses fornot more thanthree(3)people
10.Mini Day Care Facility and Day Care Centers:
a.Mini Day Care Facility:A day care facility for the care of from seven (7)throughtwelve(12)children in the family abode of the person holding the license issued
by the State ofWashington,Department ofSocial and Health Services.
b.Day Care Center:A day care facility thatprovides for the care of from thirteen
(13)throughtwenty(20)children in the family abode of the person holding the
license issued by the State of Washington,Department of Social and Health
Services.
c.Requirements:Miniday care facilities and day care centers shall be in compli-
ance with thefollowing requirements:
1)Outdoorplayareas shall not be located in front yards.
2)One (1)on-site parking space is required for each employee in additionto
required resident parking.
3)An on-site,off-streetloading and unloadingarea shall be required.
4)A city business license shall be required.
5)Signage shall not be permitted.
6)No structural or decorative alteration whichwould alter the character or be
incompatible withthe surroundingresidences shall be permitted.
7)The use and structures shall be in compliancewith zoning regulations and
Uniform BuildingCode mquirements.
8)Miniday care facilitiesand day care centers shall be licensed by theState of
Washington,Department of Social and Health Services and shall operate in
compliancewith the licensed capacity requirement as determined by theState
of Washington,Departmentof Social and Health Services except that day
care centers shall operate in compliance with the capacity requirements asstipulatedinthissection.
9)The Planning Commission may impose conditions to mitigate any potential
adverse impacts on the surrounding area.
10)Notification and agreement of adjacent property owners of an application for
a day care facility.
11.Other uses ruled by the Planning Commissionto be a conditionaluse provided that
the use shall be similar to and compatible with the expressed permitted and condi-
tional uses.
18.19.250 Performance Standards Residential Structures:Exclusive of manufactured homes located in
manufacturedhome parks which shallbe in compliance with Chapter 18.65 of thiscode entitled
."Manufactured Home Parks."
A.Residential structures shall have a pitched roof or the pitch of the main roofshall be not
less than three inches (3")of rise for each twelveinches (12")of horizontal run.

B.The minimumwidth of the main portionof a residential structure shall be not less thantwentyfeet(20')as measured across the narrowest portion.
C.Roof constructionshall be of non-reflectivematerials.
D.Wheels and tongueofall manufactured homes not located in manufactured home parÑsshallberemoved.
E.All manufacturedhomes shall be new and previouslyuntitled and shall bear the insigniaofapprovalbytheStateofWashingtonortheU.S.Department of Housing and UrbanDevelopmentindicatingcompliancewiththeNationalManufacturedHousingConstructionSafetyStandardsActof1974(effectiveJune 15,1976).
F.Residential structures shall be constructed with a perimeter masonry or concrete founda-
tionthat is in accordance with the Uniform BuildingCode.
G.Single level residential structures shall have a floor level not more thaneighteen inches
(18")above average finished grade.
H.Residential structures shall have a hard surfaced route from the main entrance of theresidencetothestreet
I.Residential structures shall have a minimumof one (1)detached or attached covered
parking space.
18.19.055 Non-Conforming Lots:A buildingpermit maybe issued to a platted non-conforming lot thatcontainsatleastfivethousand(5,000)square feet and otherwise meets the underlyingperformancestandardsoftheR-2 Zone in at least eighty percent (80%)of the minimumbulk
dimensional requirements of lot area,width,minimumbuildingsetback line,and depth.
Section 2.This ordinance shall takeeffectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
