1753_00001ORDINÄNCE NO.1753 AN ORDINANCEAMENQiNG CHAPTER18.22 OF THE MOSESLAKEMUNICl-PALCODE ENTITLED"R-3,MULTI-FAMILYRES1DENTIAL"- THE CITY COUNCIL OF THE CITY OF MOSESLAKE,WASHINGTON DOORDAIN AS FOLLOWS: Section 1.Chapter 18.22 ofthe Moses LakeMunicipal Code entitled "R-3,Multi-Family Residential"isamendedasfollows: 18.22.020 Permitted Uses:Hereafter in the Multi-family Residential 2'one,no building,structure,or landsha0beusedandnobuildingorstructyreshallbeerected,altered,or relocated herein whichisdesignedorintendedtobeusedforanyotherthanthefollowingoutrightpermittedusesorasaconditionaluse.Ouhight permittedusesor conditionaluses intheMulti-familyResidential2orieshallbeincompliancewiththeconditions,the performance standards,and bulkregulationsofthischapter. A.Outright Permitted Uses: 1.Multi-familydwelling unit structure -a structurecontainingmore thantwodwelling units on a single lot. 2.Duplex -a structure on one lot of record containingtwo(2)dwelling units, 3.Single family dwelling units,including a.Single familydetached dwellingunits. b.Single family dwelling units sharing a commonwall or attachment on two lots ofrecord. c.Condominîums -singlefamily attached dwelling units developed as a horizontalregimeincompliancewiththerequirementsofthischapterorincompliancewithChapter18.87 of thistitleentitled "Planned Development District." O 4.Suboldinate Uses -any use whichis incidental and subordinate to the principaluseofthelandorbuikling;is located on the same lot with the principaluse;and is nototherwiseprohibited. 5.Accessory buildingsand/or structures appurtenanttoany permitteduses in compliancewithSection18.22.040 of thischapter. 6.Factory-built housing constructed to thestandards of the Uniform Building Code. 7.Manufactured homes 8.Keeping of household pets (dogsand cats)not toexceed three(3)in number whicharefour(4)monthsold or older, 9.Planned Develdpment Districtsin compliancewith Chapter 18.67 of thistitle,entitled"Planned DevelopmentDistricts." 10,Parks and non-commercialrecreational uses. 11.Home occupations in compliancewithChapter 18.55 of thistitle. 12.An accessory dwemng unit intended toaccommodate a member(s)of the immediatefamilyrequiringdailycare,supervision,or guardianship in compliance with Section18.22.210 of titischapter entitled "ResidentialDensity." O 13.Other unmentioned uses ruled by the Planning Commission to be similar to andcompatiblewiththespecifiedpermitteduses. 14.Family day care homes as an accessory use to a private family residence providingcareduringpartofthetwenty-fout(24)hour day to six (6)or fewerchildren.FamilydaycarehomesshallbelicensedbytheStateofWashington,Department of SocialandHealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.A city business license shall be required. B.ConditionalUses;The followinguses may be permittedby the PlanningCommissionasaconditionaluseincompliancewiththeprovisionsofthischapterandChapter18.51 ofthistitleentitled"Conditionaland Unmentioned Uses." 1.Golf Courses ORD.1753/Page 2 2.Cemeteries 3.Manufactured home parks in compliance with Chapter 18.65 of this code entitled"Manufactured)Home Parks." 4.Clubs,lodges,and assembly halls 5.Athletic clubs 6.Boarding houses O7.Grouphomes for thedevelopmentally disabled 8.Schools 9.Churches 10.Clinics 11.Professional offices 12.Rental of an apartment appurtenant to a single familyresidence 13.Essential publicservices and utilitiesincludingbuildingsand structures. 14.Hospitals 15.Hotels 16.Motels 17.Marinas located along the lake shore 18.Mini Day Care Facilities and Day Care Centers: a.MiniDayCare Facility: 1)A day care center for the care of twelve(12)or fewer children in a facility other thanthe familyabode oftheperson or persons underwhose directcareandsupervisionthechildisplaced;or 2)For the care of from seven (7)throughtwelve(12)children in the family abode ofsuch person or persons. b.Day Care Center A day care facility thatprovides for thecare of thirteen(13)or more childrenprovided thatthe capacity of day care centers located in private family residences in residentialzones shall not exceed twenty(20)childrenat any giventimeand the permitted capacity of day care centers located in residential zones in other than private family residences shall be set by the Planning Commission on a case by case basis. c.Requirements:Miniday care facilities and day care centers shall be in compli- ance with thefollowing requirements: 1)Outdoor play areas shall not be located in front yards. 2)One (1)on-site parking space is required for each employee in addition to required resident parking. 3)An on-site,off-streetloading and unloadingarea shall be required. 4)A city business license shall be required. 5)Signage shall not be permitted. 6)No structural or decorative alterationwhich would alter the character or be incompatible with thesurroundingresidences shall be permitted. 7)The use and structures shall be in compliancewith zoning regulations and UniformBuilding Code requirements. 8)Miniday care facilitiesand day care centers shall be licensed by theState of Washington,Department of Socialand Health Services and shall operate in compliancewith thelicensedcapacity requirement as determined by theState of Washington,Department of Social and Health Services except that day ORD.1753/Page 3 care centers shall operate in Compliance withthe capacity requirements asstipulatedinthissection. 9)The Planning Commissionmay impose conditionstomitigate any potentialadverseimpactsonthesunoundingarea. 10)Notification and agreement ofadjacent property owners ofan applicationfor a day care facility. 19.Other uses ruled by the Planning Commissiontobe a conditionaluse providedthattheuseshallbesimilartoandcompatiblewiththeexpressedpermittedandcondition-al uses or other uses permittedby specificprovisionof thischapter as a conditional use. 18.22.270 Performance Standards Residential Structures:Exclusive of manufactured homes located inmanufacturedhomeparkswhichshallbeincompliancewithChapter18.65 ofthiscode entitled"Manufactured Home Parks." A.Residential structures shall have a pitched roofor the pitchof the main roofshall be notlessthanthreeinches(3")of rise for each twelveinches (12")of horizontal run. B.The minimumwidth of the main portion of a residentialstructure shall be not less thantwentyfeet(20')as measured across the narrowestportion. C.Roof constructionshall be of non-reflectivemeterials.. D.Wheels and tongueof au manufactured homes not located in manufactured home parksshallberemoved. E.All manufactured homes shall be new and previouslyuntitledand shall bear theinsigniaofapprovatbytheStateofWashingtonortheU.8.Department of Housing and UrbanDevelopmentindicatingcompliancewiththeNationalHousingConstructionSafetyStan-dards Act of 1974 (effectiveJune 15,1976). F.Residential structures shall be constructed witha perimetermasonry or concrete founda-tionthatis in accordance withtheUniform BuildingCode. G.Single level residential structures shall have a floor level not more thaneighteen inches(18")above average finished grade. H.Residential structures shall have a hard surface route from the main entrance of theresidencetothestreet. 18.22.055 Non-Conforming Lots:Abuilding permit may be issued to a platted non-conforminglotthatcontainsatleastfivethousand(5,000)square feet and otherwise meets the underlyingperformancestandardsoftheR.3 Zone inat least eightypercent (80%)of theminimum bulkdimensionalrequirementsoflotarea,width,minimumbuildingsetback line,and depth. Section 2.This ordinanceshall takeeffectand be in force five(5)days after its passage and publicationofitssummaryasprovidedbylaw.
